General Khumalo

Mr Matlala paid R50,000 (and flight tickets) on advice of former Minister Bheki Cele to avoid arousing suspicion from Brown Mogotsi and potentially get close to ministers or uncover plans involving General Khumalo and General Khanto in Crime Intelligence.

“It was because of the advice from the former Minister, Bheki Cele. ... To make him not doubt that I no longer trust him. ... Mr Senzo wants to fire General Khumalo and hire General, and replace him with General Khanto that position of Crime Intelligence.”

There was a question why a seemingly obviously wrong charge was made by the investigating team, which does not make sense to the questioner and appears to involve a 'third hand' or 'hidden hand'.

“this which looks so obviously wrong, why was it happening? Commissioner Khumalo went so far as to say there is a third hand or a hidden hand”

Advocate Khumalo accused Advocate Serunye of being scared of IDAC and thus not insisting that Advocate Hlatshwayo receive the section 27 referral document at discovery stage, which is required for the accused's rights.

“So you were scared. You were scared of the ID. That is why you did not insist that it be made available to the prosecutor”

General Khumalo was charged in relation to this matter because he failed to discipline General Lushaba and was part of a cover-up.

“What we have also heard about this is that General Khumalo is charged in respect of this because he did not discipline, he was part of a cover-up, he did not discipline General Lushaba.”

Mr Lushaba and two other Crime Intelligence officers were accused in a docket, but not Mr Khumalo, and it is unclear if he has a separate docket.

“the y accused Mr Lushaba and two other Crime Intelligence officers , but not Mr Khumalo . I am not sure if there is a separate docket of Mr Khumalo”

The arrest related to this case happened before General Khumalo and others' arrests.

“I think this case , or the arrest of this case , happened before the General Khumalo and others ' arrests . This one came first .”

A Member of Parliament alleged that General Khumalo and senior managers, together with General Lushaba, abused COVID funds, and that General Masemola might be involved in some of these allegations.

“… the very last paragraph, it says and further suspects, this is the Member of Parliament, he makes the allegation about General Khumalo, senior managers, together with General Lushaba, for abusing COVID funds … and further suspects that the National Commissioner, General Masemola, may be involved in some of these allegations.”

ADV Johnson and Mr Perumal launched an orchestrated attack on General Masemola and General Khumalo using IDAC's investigation tools.

“Advocate Johnson and Mr Perumal launched an orchestrated attack on General Masemola and General Khumalo, using IDAC 's powerful investigation tools . And this wil l become evident in my statement and testimony.”

Advocate Johnson instructed to change the letter request from Major General Khumalo to Lieutenant General Jacobs and to shred the initial letter as it was never sent to Khumalo.

“I had to change the letter request from Major General Khumalo to Lieutenant General Jacobs. I sent Advocate Johnson a WhatsApp message... Her response was that I must shred the letter because it was not going to Lieutenant General Jacobs. She said she had written to Divisional Commissioner Detective Services, Lieutenant General Sentumule.”

The request for dockets via letter to Major General Khumalo was never sent because Khumalo indicated the dockets were not with him or under his control, and the letter was subsequently addressed to Lieutenant General Sentumule instead.

“Advocate Johnson testified that we sent the letter requesting the dockets to Major General Khumalo and that he had indicated that the dockets were not with him or were not his. As stated above, the letter was never sent to Major General Khumalo and Advocate Johnson knew that because she told me to shred the letter. Advocate Johnson told me that the letter had been changed and addressed to General Sentumule.”

It is standard procedure to request certified copies of dockets and to leave originals with the owning police station; the requester noted discomfort because he was asked to request the original dockets instead.

“The request for the dockets was yet another matter that did not sit well with me. We usually request certified copies of the dockets and the originals are retained by whomever the request is addressed to... In this instance, I was asked to request for the original dockets.”

The process of requesting and collecting dockets was complicated by internal office commotion and changes in official letter addressees, resulting in Advocate Johnson instructing shredding and changing letters instead of sending original requests to Major General Khumalo or Lieutenant General Jacobs.

“There was a lot of commotion on that day... I had to change the letter request from Major General Khumalo to Lieutenant General Jacobs... Her response was that I must shred the letter because it was not going to Lieutenant General Jacobs. She said she had written to Divisional Commissioner Detective Services, Lieutenant General Sentumule... Advocate Johnson told me to ask Mr Raphesu to call Colonel Phillips and ask if Lieutenant General Sentumule had asked Colonel Phillips to hand the dockets over.”

Allegations include abuse of funds from Secret Service account contravening PFMA, involvement of General Lushaba as complainant, and Lieutenant General Khumalo facilitating defeating the ends of justice including nepotism by placing family in key positions.

“Alleges sensitive information relating to the abuse of funds from the Secret Service account that contravenes PFMA, General Lushaba was the complainant, Lieutenant General Khumalo facilitated the act of defeating, further allegations of nepotism placing persons and family members in strategic key positions.”

Lieutenant General Khumalo, Divisional Commissioner of Crime Intelligence (CI), and Major General Lushaba, the CFO of CI, are alleged to have abused power by channeling Secret Service account funds into the KwaZulu-Natal Political Task Team, which was a front for former Minister Mr. Cele, including vehicle purchases used for the former Minister's activities.

“"Alleges major abuse of power of the Secret Service account by Lieutenant General Khumalo, Divisional Com of CI, together with Major General Lushaba, the CFO of CI, funds being channelled into the KZN Political Task Team, which is a front for the former Minister, Mr Cele. Purchases of vehicles through this fund allegedly bought for the Task Team, but used for the former Minister's activities."”

Information about Lieutenant/Major General Khumalo was obtained by contacting Charity via Perumal; MS Ramsamy had no interaction with Charity in December 2024.

“On the 6th when I asked Perumal where do I get the details for Lieutenant General Khumalo... he said to me, no, hold on, I will speak to Charity... Major General... I get confused, sorry... He contacted her, and that is how I got the details... During December 2024, no, I had no [interaction with her].”

There is an allegation that IDAC actively participated in a well-coordinated attack against General Mkhwanazi, General Masemola, and General Khumalo, which Adv Johnson denies.

“there was an allegation that IDAC actively participating in a well-coordinated attack against General Mkhwanazi, General Masemola and General Khumalo, are you aware of it? You said you have heard of that allegation, but there is no truth to it.”

Advocate Manilall claimed the Section 28 summons was issued to determine if Lieutenant General Khumalo breached bail conditions by authorizing PKTT members to arrest Mr Adams, who was a state witness.

“the purpose behind it from the prosecutor was to determine whether someone else within the PKTT approved those trips, that is fine, and that if it was in fact General Khumalo who authorized those trips, then he was sending people to deal with Adams, and it could have a potential of interfering with the bail condition.”

Advocate Manilall's explanation for issuing the Section 28 summons was false because PKTT members were under no bail condition preventing them from dealing with witnesses or arresting Mr Adams.

“I want to say if that is the explanation he gave you it is a false explanation. Those individual members and anyone else in the world was under no bail condition that they could not, that is one reason, that they could not deal with any witnesses. There was nothing like that.”

IDAC prosecutors misused bail conditions against General Khumalo to insulate Mr Adams from legitimate arrest or investigation by the PKTT.

“So you are brandishing that condition over General Khumalo to say whatever wrong he commits, you dare not touch him, because he is my witness and if you do, you will be breaching a bail condition.”

Following their arrest, the accused individuals (including General Khumalo) were subject to bail conditions prohibiting them from attending their workplace, and General Khumalo was temporarily reassigned by the National Commissioner until his bail issue was resolved.

Lieutenant General Khumalo was arrested after landing at Oliver Reginald Tambo International Airport (ORTIA) while his co-accused had been invited to report to Brooklyn Police Station.

“Lieutenant General Khumalo was arrested after he had landed at Oliver Reginald Tambo International Airport, ORTIA. I do not recall where he was travelling from. I was informed that at the time his co-accused had already been invited to report to Brooklyn police station.”

IDAC investigators went to ORTIA to inform Lieutenant General Khumalo of an arrest warrant and to have him hand himself over before accompanying them to Brooklyn Police Station.

“They went to ORTIA to inform him that there is a warrant for his arrest, for him to hand himself over, and he then accompanied them to the Brooklyn police station.”

Advocate Johnson accepted the assertion that investigators went to the airport specifically to arrest Lieutenant General Khumalo, leaving him with no option but to go directly to Brooklyn Police Station.

“I am accepting your point.”

There was no intended or executed arrest on 18 June 2026 against General Masemola, General Khumalo, or General Madondo.

“There was never an intended arrest for General Masemola, General Khumalo and General Madondo.”

Crime Intelligence witnesses indicated they were subjected to intimidation and victimisation, justifying bail conditions that barred accused persons, including General Khumalo, from accessing Crime Intelligence premises.

““The assertion being that Mr Padayachee would be allowed to have access to Criminal Intelligence is incorrectly interpreted, mainly because we have witnesses at CI. Those witnesses had indicated that they had been intimidated and victimised. The condition for them not going to CI was to ensure that the witnesses were not intimidated.””

Colonel Padayachee filed an affidavit opposing the amendment of a bail condition restricting Crime Intelligence officials' access to CI offices, despite lacking security clearance to access CI information himself.

“Colonel Padayachee filed an affidavit in opposition of the amendment of that condition in circumstances where you, as his leader, knows that that condition would not make sense because Mr Brian Padayachee himself does not have any security clearance to access information that is within the CI offices?”

Division Commissioner Lieutenant General Khumalo failed to take action since February 2024 regarding General Madondo's presence in Crime Intelligence, which poses a security risk.

“The fact that no action was taken by Division Commissioner Lieutenant General Khumalo since 2024 February, raises serious concern as Madondo's mere presence in the Division Crime Intelligence poses a serious security risk to Crime Intelligence and the SAPS.”

Advocate Johnson signed and sent a letter dated 30 June 2025 to the National Commissioner stating that Generals Lushaba, Khumalo, Madondo, Lekalakala, Gabela, Ncube, and Brigadier Mokwele were prohibited by court order from entering any Crime Intelligence premises or contacting its personnel.

“On the 30th of June 2025, you penned, signed, and addressed a letter to the National Commissioner informing him that General Lushaba, General Khumalo, General Madondo, it is going to be projected here, General Lekalakala, and General Gabela, as well as Ncube, I apologise, I do not remember her rank, and Brigadier Mokwele. You state in this document... “Kindly note that none of the above named officers are allowed to enter any premises or office which forms part of the Division Crime Intelligence, or have any contact with its personnel as ordered by the Court.””

Sergeant Nkosi reported that Suneel Bellochun led a team of nine IDAC investigators on 13 July 2026 to meet him without his attorney to solicit testimony implicating Generals Khumalo and Masemola.

“The third we dealt with in this hearing, which is by Sergeant Nkosi, of Mr Bellochun leading a team of nine, let me say people, investigators and maybe others, from IDAC of the 13th of July 2026, to meet with him in the absence of his attorney and to solicit, again, it is my own summary, testimony from him that would implicate Generals Khumalo and Masemola.”

Advocate Johnson attended General Khan's 50th birthday party and shares a personal, close friendship with him beyond a purely professional working relationship.

“y o u a t t e n d e d G e n e r a l K h a n ' s 5 0 t h b i r t h d a y ... b e s i d e s t h e p r o f e s s i o n a l r e l a t i o n s h i p , y o u h a v e t h i s p e r s o n a l o n e .”

The docket suggests that General Khumalo knew of and was complicit in the fraud perpetrated by the person who made a fraudulent affidavit.

“the docket suggests he knew she had no clearance, and that she had pending matters... he must have known of the fraud”

General Khumalo is alleged to have known of the fraud and was complicit in it as per the docket.

“That is what the allegation was, yes.”

Secret Service funds were allegedly used to purchase resources for the PKTT task team, which was previously led by Divisional Commissioner of Crime Intelligence Lieutenant General Khumalo, who has close ties with former Minister B.H. Cele, and these resources were allegedly procured for the benefit of Mr. B.H. Cele and others.

“Secret Service funds were used to purchase resources for PKTT, ... led by Divisional Commissioner of Crime Intelligence, Lieutenant General Khumalo, who has close ties with the former Minister, ... benefit of Mr B H Cele and others”

There was a complaint that the appointment of Lieutenant General Khumalo as Divisional Commissioner of Crime Intelligence was effected without an interview process.

“complaint was that the appointment, original complaint, was that the appointment was effected without an interview process”

The appointment of Lieutenant General Khumalo by the former Minister of Police falls outside the mandate of IDAC and does not necessarily imply fraud or corruption within the scope of the investigation.

“this is purely a question of how General Khumalo was appointed by the former Minister of Police, and I think we have agreed that that would not necessarily fall within the mandate of IDAC”

Allegations relate to questionable appointment of General Khumalo as Head of Crime Intelligence nationally, with Minister of Police Bheki Cele involved and highly skilled generals in Crime Intelligence overlooked.

“The allegations related to the highly questionable appointment of General Khumalo as the Head of Crime Intelligence nationally. The following Minister of Police, Bheki Cele, was also involved whilst serving highly skilled Generals within CI were overlooked.”

Appointment of General Khumalo who did not qualify and others as promoted through alleged corrupt practices is questioned and signed summons require information about provincial and section heads, but relevant affidavit does not mention performance assessments.

“Mr Adams does not say anything about performance assessments. He says the appointment of General Khumalo, who did not qualify to be appointed and other Generals, and he does not say who, you sign off on a summons that requires information of provincial heads and section heads. You want the performance assessments. I do not see how that arises from Mr Adams' affidavit.”

Advocate Johnson acknowledged that paragraph 6 of Annexure B refers to the promotions of PKTT commanders and members through deviation processes.

“paragraph 1 talks to the deviation of appointment of Lieutenant General Khumalo ... paragraph 6 ... original documentary files and applications for promotions ... commanders and members of the PKTT through deviation, they tied into the deviation process.”

Advocate Johnson followed the sequence of appointments and deviations related to Lieutenant General Khumalo as a basis to sign the document regarding the PKTT, despite not addressing paragraph 6 entirely.

“I followed that sequence of appointments, deviations ... promotion of Lieutenant General Khumalo by deviation ... So it made sense in that regard.”

ADV JOHNSON was told by investigator Mlambo, who brought the summons, that Lieutenant General Jacob was precluded from returning to his post, which justified appointing Lieutenant General Khumalo instead.

“I see on the face of the summons, it is Investigator Mlambo... And that is why there have to be this deviation of an appointment of Lieutenant General Khumalo.”

Commissioner Khumalo asked why IDAC was investigating promotions and appointments within the PKTT and what interest IDAC had in the PKTT.

“What was IDAC's interest in the PKTT?”

There is an allegation that IDAC is actively participating in a well-coordinated attack against General Mkhwanazi, General Masemola, and General Khumalo.

“There is an allegation that IDAC actively participating in a well-coordinated attack against General Mkhwanazi, General Masemola, and General Khumalo.”

There is a witch hunt against Lieutenant General Khumalo because no matters were brought to IDAC before Mr Adams' referral.

“There is also no witch hunt against Lieutenant General Khumalo, because there were no matters brought to IDAC prior to the referral by Mr Adams.”

The manner in which IDAC responded to Mr Adams' complaints feeds the narrative of a coordinated attack against General Khumalo and perhaps General Mkhwanazi linked to PKTT, as supported by evidence seen so far.

“the manner in which IDAC responded to Mr Adams' complaint at the very least is feeding the narrative ... there appears to be an active coordinated attack, at least against General Khumalo ... General Mkhwanazi, to the extent that he is associated with PKTT, perhaps.”

The summons requested documents pertaining to General Khumalo's appointment and the documentary files of promotions of commanders and members of the Political Killings Task Team.

“the summons, the section 28 you signed, requesting documents pertaining to General Khumalo's appointment and the documentary files of promotions of commanders and members of the Political Killings Task Team”

IDAC officials, led by Suneel Bellochun, questioned Sergeant Nkosi about alleged corrupt relationships involving Vusimuzi Cat Matlala, National Commissioner General Masemola and Lieutenant General Khumalo.

“Suneel Bellochun ... asked me what I know about any corrupt relationship between Vusimuzi Cat Matlala, National Commissioner, General Masemola and Lieutenant General Khumalo. ...”

On the afternoon of 13 July 2026, IDAC staff investigators visited Fannie Nkosi to implicate General Masemola and Lieutenant General Khumalo by claiming a relationship between them and Mr Matlala.

“members of the IDAC staff investigators visited Mr Fannie Nkosi to get him ... to implicate General Masemola and Lieutenant General Khumalo by claiming that there is a relationship between the two and Mr Matlala.”

Former Police Minister was involved in appointing General Khumalo as the Divisional Commissioner of Crime Intelligence without an interview process and without Khumalo having experience as a senior manager in Crime Intelligence.

“The former Police Minister was also involved in appointing General Khumalo as the Divisional Commissioner of Crime Intelligence without an interview process and without Khumalo having worked as a senior manager in Crime Intelligence.”

The appointment of General Khumalo as Divisional Commissioner of Crime Intelligence by the former Police Minister was done without an interview process and without Khumalo having worked as a senior police manager in Crime Intelligence, raising questions about the legitimacy of the appointment.

“The fact that the former Police Minister appointed General Khumalo as the Divisional Commissioner of Crime Intelligence without an interview process and without General Khumalo having worked as a senior policeman in Crime Intelligence.”

The appointment of Lieutenant General Khumalo as Head of SAPS CIU was found to be regular by the PSC.

“The process followed by SAPS during the appointment of Lieutenant General Khumalo to the post Head of SAPS, CIU, is found to be regular.”

Despite the regularity of Khumalo's appointment, the PSC recommended that the Minister should facilitate corrective measures regarding sound record keeping and sensitising officials.

“Despite the determination that Lieutenant General Khumalo's appointment to the post of Head of SAPS CIU, was regular, the Public Service Commission recommends that the Minister should facilitate ... Corrective measures be put in place to ensure sound record keeping to sensitise officials regarding the importance of good record keeping.”

The complaint about Lieutenant General Khumalo's appointment was lodged by Ms Mary de Haas on 23 December 2022.

“the complaint was lodged on the 23rd of December 22, by Ms Mary de Haas.”

ADV Sellos states that an affidavit (section 27) suggested the appointment of General Khumalo was irregular, unlawful or otherwise, with the affidavit dated 3 April 2025.

“That one that suggested that the very appointment of General Khumalo to this position was either irregular, unlawful or otherwise. That was Mr Adams'. Now, we know that section 28 is dated the 3rd of April 2025.”

Following section 28, IDAC was furnished with full documents for investigation, and there is a question about whether IDAC has formally put to bed concerns raised by section 27 regarding Khumalo's appointment.

“IDAC is then furnished with full documents ... indicating that any complaint or concerns raised by section 27 referral, particularly in paragraph 5 relating to the appointment or the regularity of the appointment of General Khumalo, has been put to bed.”

ADV Johnson admits hesitancy and caution in discussing the basis for the intended arrest of General Khumalo due to potential negative implications and ongoing investigations.

“I am not vested with those matters, I become overly cautious about what I am saying and do not want any negative implications. ... That matter is still under review... There are people whose lives are involved and those are not yet accused, those are suspects. So I am cautious.”

The Chairperson finds ADV Johnson's hesitancy regarding the basis for General Khumalo's intended arrest strange given the public domain nature of the information and noise around it.

“I must say, Advocate Johnson, that I find it quite strange that you are as hesitant as you are with regards to the basis for the intended arrest ... this was out there for all to see in the public domain and there was a lot of noise around it.”

ADV SELLO SC suggested there was a coordinated attack by IDAC against Generals Masemola, Khumalo and Mkhwanazi in November 2025, which Advocate Johnson initially denied.

“Mr Nqola asked you whether there is a coordinated attack by IDAC against Generals Masemola, Khumalo and Mkhwanazi, and I think it was Ms Sangoni as well asked about the investigations against Masemola and Mkhwanazi and you said there was nothing at the time. This is November 2025.”

File 9 contains information on aborted J-50 warrants for arrest of Generals Khumalo and Madondo and is still under investigation with no charge sheet available.

“It must be close by. And just for the record, that this is the file, the docket, we said it is still under investigation. It is fairly sensitive and it concerns the, I will call them the aborted J 50 warrants of arrest of Generals Khumalo and Madondo. I do not know if the request should go to you, but I have noted that in this file, there is no charge sheet.”

Investigation into the lateral transfer of Major General Madondo from KZN to CI, assisted by General Khumalo and others, knowing she failed to secure a top secret clearance, is outside IDAC's mandate because IDAC does not investigate vetting processes.

“And assume all of that is correct. Assume all of that is correct. What does it have to do with IDAC? Is it IDAC's mandate to investigate lateral transfers within SAPS, and whether they were regularly done or not? ...But does IDAC investigate whether somebody's vetting is correct or not? Is that IDAC's mandate? No...”

The complaint alleges that nine IDAC officials conducted a prison interview with Sergeant FEN Kosi to obtain demanded information about connections between Vusimuzi Matlala, National Commissioner General Masemola, and Lieutenant General Khumalo as part of investigations into the Medicare 24 contract.

“upon or about the 3th of July 2026, a delegation comprising of nine IDAC officials visited our client in prison ... to conduct an interview with him in relation to ongoing investigations ... regarding ties between Vusimuzi Matlala, National Commissioner, General Masemola and Lieutenant General Khumalo”

General Masemola is already an accused in the trial related to the contract for which he is standing trial, and evidence is being solicited against General Khumalo and General Masemola.

“General Masemola is already an accused in that trial, and the evidence solicited in respect of the very contract for which he now finds himself standing trial”

General Khumalo's involvement in the matter with General Masemola is questioned as unclear.

“how does General Khumalo even become involved in that, or how would he?”

Advocate Johnson has received no feedback that General Khumalo's name came up in the investigation.

“At no stage in any feedback to myself has his name ever come up in this investigation”

There is another General whose name came up in the investigation, but that name does not begin or end with Khumalo.

“There is another General whose name comes up in this investigation. It does not begin with a Khumalo or end with a Khumalo”

It appears that Mr Bellochung searched to find dirt that could be used against General Masemola and General Khumalo without foundation in investigations.

“Until Mr Bellochung gives us an explanation on the face of it, it looks like he went about searching to find some dirt that could be used against General Masemola and General Khumalo when there is no foundation for it in any of his investigations. That is what it looks like.”

General Khumalo's vetting processes were allegedly fast-tracked by General Masemola who knew Khumalo did not have a top secret clearance for many years, potentially indicating unlawful conduct.

“Khumalo's vetting processes were allegedly fast-tracked by Masemola, who knew that Khumalo did not have a top secret clearance for many years. I suspect that the vetting processes were manipulated in favour of Khumalo as well.”

An allegation of fraudulent and corrupt conduct related to the questionable lateral transfer of Major General Madondo from KZN to Crime Intelligence Head Office by Lieutenant General Khumalo, assisted by other senior generals, who knew she failed top-secret clearance for many years.

“On about early October 2024 , I received information anonymously surrounding alleged fraud and corruption being perpetrated within the Division Crime Intelligence of the SAPS, the allegations related to the questionable lateral transfer of Major General Madondo from KZN to CI Head Office by Lieutenant General Khumalo, who was assisted by other senior Generalsto do so, knowing that she failed a top-secret clearance for many years.”

Only the vetting clearances of General Khumalo and General Madondo are questioned, not of other listed generals such as Madondo, Lekalakala, Van Vuuren, Bobby, and Ncube.

“In these, the vetting that has been questioned is that of General Khumalo and General Madondo. ... We account for only two ... whose vetting clearances are questioned.”

General Khumalo is facing charges and potential arrest under case 453/06/2025 related to vetting issues; however, the arrest warrant that was suspended relates to General Madondo's vetting issue and related fraud, not Khumalo's own vetting.

“We know that General Khumalo is facing charges and potential arrest under case 453/06/2025 and that is pertaining to the vetting issue. The warrant of arrest that was suspended relates to the vetting issue of General Madondo. Not General Khumalo's own vetting. It relates to a role he played allegedly in that contravention and the fraud related to that vetting.”

There was a basis to investigate allegations that General Khumalo's security clearances were a result of manipulation of vetting processes from Brigadier level upward.

“there was a basis to investigate whether General Khumalo's security clearance given when he was a Brigadier was a result of manipulation of your vetting process”

There is an allegation that secret service funds were used to purchase resources for the Political Killings Task Team (PKTT) base in KwaZulu-Natal, benefiting Mr Bheki Cele and others.

“it was alleged that secret service funds were used to purchase resources for the Political Killings Task Team base in KwaZulu-Natal Province ... resources procured under the banner of the task team were for the benefit of Mr BH Cele and others”

Allegations of fraud and corruption related to awarding tenders and contracts involve Generals Khumalo, Madondo, and Lushaba suspected of manipulating procurement processes according to Mr Adams.

“Mr Adams says he suspects that General Khumalo, Generals Khumalo, Madondo and Lushaba were manipulating procurement processes”

There is no allegation of wrongdoing by the Minister of Police, Mr Bheki Cele, in the questionable appointment of General Khumalo as Head of Intelligence within the statements examined by the Commission.

“It does not contain any allegation of wrongdoing by the Minister of Police, Mr Bheki Cele, being involved in this questionable appointment”

Certain Generals, mainly three Generals named General Khumalo, Lekalakala, and an unnamed third General, were suspected of misappropriating Crime Intelligence Slush Funds.

“certain Generals , mainly the three Generals , General Khumalo , Lekalakala , the third one escapes me now , were misappropriating Crime Intelligence Slush Funds”

The tracing and investigation of missing dockets is urgent to determine their whereabouts and register an investigation.

“The tracing of the docket su rgen t, y es... The investigation is now registered in terms of 28 (13), and the first exercise out of that in order to go forward is to trace the dockets.”

Investigators found out on the day that the dockets must be in Gauteng and had to follow up by contacting Major General Khumalo, who indicated where the dockets were stored in a safe, but they were only available on the following Monday.

“We found out on that day that the dockets must be in Gauteng... we write to Major General Khumalo. He gives an indication of where the dockets are. ... it happened in a phased approach... when the destination of the dockets was determined... they were in a safe and that they were with a specific general, we went back on Monday.”

The summons document requests complete applications for security clearances and vetting files for various officers including General Khumalo, General Lushaba and General Madondo, despite documentation gaps in IDAC's records at the time.

“This summons effectively asks for complete applications for security clearances and vetting files for the officers listed therein, starting with General Khumalo, in respect of all the ranks he has held, starting with the Brigadier, Major General and Lieutenant General, and the pattern repeats itself. ... I think he is mentioned by name in the section 27 referral. So is General Lushaba and General Madondo. ... we have that problem of names that do not appear from documentation that IDAC has at the moment it takes this drastic step, appearing in, you know, in such documents as these summonses.”

Major General Lushaba's Sunnyside case of robbery involving official state firearm, laptop, and cellphone was covered up by instructing officials to ensure no investigation took place.

“A cover-up of Major General Lushaba's Sunnyside case of robbery, whereby official state firearm, laptop and cellphone was stolen, after acquiring the services of a prostitute on 5 August 2022, Lieutenant General Khumalo instructed Major Lekalakala and Brigadier... to ensure that there would be no investigation into the conduct of General Lushaba, as per Villieria case 38/8/22. The prostitute was paid for her silence using money from these secret Service account, new equipment was bought for Major General Lushaba, by again abusing the secret Service account. Evidence to this effect is available.”

Lieutenant General Khumalo neglected protocol and instructed Major Lekalakala and Brigadier Monyane not to conduct investigations against General Lushaba regarding the cover-up.

“It appears that suspect, Lieutenant General Khumalo from SAPS secret Services, neglected protocol and instructed Major General Lekalakala and Brigadier Monyane to not conduct investigations against General Lushaba.”

The appointment of General Khumalo as Head of Crime Intelligence nationally was highly questionable and involved the former Minister of Police, Bheki Cele, while several highly skilled generals within Crime Intelligence were overlooked.

“The allegations relate to the highly questionable appointment of General Khumalo as the Head of Crime Intelligence nationally. The former Minister of Police, Bheki Cele, was also involved in this, while several high-skilled generals within CI were overlooked.”

It is suggested that IDAC is preparing charges and an arrest for former Minister Bheki Cele and General Masemola for General Khumalo's vetting shortcomings.

“IDAC is preparing to charge and arrest former Minister Bheki Cele and General Masemola for General Khumalo's own vetting shortcomings.”

Advocate Johnson does not currently have the cases but agrees logically charging former Minister Bheki Cele and General Masemola for Khumalo's vetting failures should follow.

“I am not vested with the cases at the moment, but that logic does follow.”

It is inappropriate to investigate and potentially arrest former Minister Bheki Cele and General Masemola solely for General Khumalo's lack of vetting clearance without evidence that Khumalo lacked clearance, a prerequisite for his appointment.

“Is it appropriate to follow that line of investigation, culminating in potential charges and arrest, based on what you have at 3475? No, unless they fall within other offences that are not here. It does not have other offences thus far.”

General Madondo was laterally transferred from KZN to Crime Intelligence head office by Lt General Khumalo despite having failed to secure top clearance for many years.

“The allegations relate to the questionable lateral transfer of Major General Madondo from KZN to CI Head office by Lieutenant General Khumalo, who was assisted by other senior generals to do so, knowing she had failed to secure a top clearance for many years.”

IDAC has a charge sheet listing fraud and corruption offences relating to the case of Major General Madondo and General Khumalo.

“At 3478, it lists fraud and corruption as the offences...”

IDAC is investigating charges recommending arrest for General Madondo and General Khumalo in June 2026 under CAS 543/6/2025.

“If you look at 3481 and 3482, that is Brooklyn CAS 543/6/2025, and that is the CAS that then refers to Madondo and Khumalo.”

There were suspicions that General Khumalo, Madondo, Madondo, and Lushaba manipulated procurement processes and processes to appoint individuals, but evidence shows approvals and signatures were made by relevant officials including General Lushaba as CFO.

“I suspect that General Khumalo and some other officers in Crime Intelligence, including Madondo and Lushaba, were manipulating procurement processes and processes to appoint”

General Lushaba, as CFO, signed off on the procurement approvals and recommendations for the forklift acquisition, and it is unclear why Generals Khumalo and Madondo are implicated in the forklift acquisition issue.

“at the bottom of 3510, it is signed by Major General CFO ... General Lushaba's signature as CFO ... I do not see how General Khumalo and General Madondo are pulled into this forklift acquisition issue”

Investigations into General Khumalo and others suspected of procurement manipulation are ongoing.

“originally suspected and investigations are underway around them as well”

Commissioner Khumalo says the doctor only saw the client from a certain period and thus cannot express an opinion on the earlier period due to lack of knowledge.

“this doctor only saw your client from when, because the period from March until 13 April, he cannot express an opinion on that. He simply does not know what the position was. He was not there.”

A letter was written to both General Khumalo (Gauteng Detective Head) and Lieutenant General Senthumule (Divisional Commissioner of Detectives) to request dockets, with Senthumule facilitating the receipt of the dockets.

“we had first written that morning to General Khumalo of Gauteng, the Detective Head, and on the same day, a letter followed to Lieutenant General Senthumule as the Divisional Commissioner of Detectives ... General Senthumule facilitated the receipt of those dockets”

Mr Adams indicated he had opened dockets in Orlando, which falls under Gauteng, prompting letters to be sent both to General Khumalo and to Lieutenant General Senthumule to facilitate dockets' receipt.

“Adam had indicated he had opened dockets in Orlando, Chair. That falls under Gauteng, so we had to write to the Commissioner ... General Senthumule as the national custodian of the dockets, and General Senthumule facilitated the receipt of those dockets”

General Khumalo informed investigators the dockets were not with him, leading to follow-up inquiry which found the dockets with the Inspectorate where General Jacobs was the Head.

“He had informed the investigators that the dockets were not with him ... the dockets were with the Inspectorate, which is why I then wrote ... to Lieutenant General Senthumule as the national custodian of the dockets”

General Khumalo asserted that if the Inspectorate is already investigating the dockets, it should be their mandate and IDAC should not have to deal with it.

“When IDAC was told that the dockets are with the Inspectorate did it not cross IDAC's mind that ... if the Inspectorate is already investigating these issues, then it is their mandate. We do not have to deal with this”

General Senthumule came back to indicate that the Inspectorate was vested with the investigation, looking at a service delivery complaint, not necessarily the allegations that Adams made in his section 27 referral.

“General Senthumule came back to indicate that the Inspectorate was vested with the investigation and what that investigation was, and sorry, IDAC, goodbye, you cannot get those...The Inspectorate, from how I understand it, Commissioner Khumalo, and if I am incorrect, my understanding is they were looking at a service delivery complaint.”

Several highly skilled and qualified senior police officers were overlooked in favor of Mrs Mokwele for the position, with involvement from generals Khumalo CI Head, Lushaba CI, Madondo CI, and Ligagala CI.

“there were several highly skilled and qualified senior police officers who applied for the post , but were overlooked by the CI management , who favoured Mrs Mokwele over them . The generals involved are Khumalo CI Head , Lushaba , CI , Madondo , CI , Ligagala CI , amongst others .”

General Senthumule indicated that the docket numbers related to complaints were with the Inspectorate, as facilitated by Commissioner Khumalo, and IDAC would not have requested those dockets without that understanding.

“General Senthumule indicated, and this was a telephone conversation, Commissioner Baloyi, she indicated that she was not aware herself, that the dockets were with the Inspectorate, she would find out, and she would come back. When she later came back, she had facilitated, then the dockets to IDAC ... had she at that stage said, I am sorry, ID, these are with the Inspectorate for a very specific purpose, based on the points that Commissioner Khumalo has made, IDAC would not have asked for those dockets”

Both the vetting processes and allegations of recruitment and gratification are still under investigation.

“the vetting processes , those allegations of the vetting processes , as well as the allegations of recruitment and gratification for the matters still under investigation”

The appointment and installation of Ms Mokwele was alleged to be strategic to access funding without following proper processes, but the evidence for this allegation fell away due to lack of factual support.

“the appointment and installation of certain persons … by Lieutenant General Khumalo and his co-accused persons, help them strategically to access funding without following proper processes… her token appointment would not stop them from their unlawful acts... falls away in terms of the appointment... short of there being documents to prove the rest of the paragraph, then that falls away.”

Lieutenant General Khumalo, as Head of Crime Intelligence, controls the funding, so he would not need to go through hoops to access funds, contrary to the suggestion that he must strategically place others (like Ms Mokwele) to access funds unlawfully.

“Lieutenant General Khumalo is the Head of Crime Intelligence. He has got access to the very funds… He is responsible for that budget… he does not have direct access to funding. He has to work through the CFO, who is General Lushaba… on your theory, they must all be beholden to him which would mean everybody in Crime Intelligence because they are beholden to General Khumalo…”

Several highly skilled and qualified senior police officers who applied for the post were overlooked by CI management in favour of Mrs Mokwele.

“there were several highly skilled and qualified senior police officers who applied for the post, but were overlooked by the CI management, who favoured Mrs Mokwele over them. The generals involved are Khumalo CI Head, Lushaba, CI, Madondo, CI, Ligalagala CI, amongst others.”

The investigations, not just Mr Adams' complaint, depict the capture of systems and processes for private interests by General Khumalo and other senior managers.

“the investigations , I will take it the investigations , not only his complaint , depict the capture of systems and processes for private interest by General Khumalo and other senior managers”

A lot of the discussion about capture and appointments revolved around the appointment of Brigadier Mokwele, which was the key allegation regarding systems capture.

“it does revolve around the appointment of Brigadier Mokwele , which we have now dealt with . That was the systems and the capture . Those were the allegations .”

General Khumalo states that gratification itself is not an offence, but gratification in order to do something improper is the offence.

“My reading of PRECCA is that gratification itself is not an offence . It is gratification in order to do something . That is the offence .”

General Khumalo would comply if he requires funds.

“should General Khumalo require funds , in all likelihood he would comply”

General Khumalo will give funds, indicating an arrangement between him and another party.

“He will give him funds .”

There is an arrangement between General Khumalo and another individual regarding funds.

“you say there is that kind of arrangement between them .”

General Khumalo does not face the charge of covering up or sweeping under the carpet issues affecting General Lushaba.

“No , General Khumalo does not face – I speak under correction . That is not the charge he faces . He does not face such a charge .”

When General Khumalo came to know about the incident involving General Lushaba, he did not act promptly for disciplinary reasons; disciplinary action was only taken after the IDAC charge.

“when it did come to the attention of General Khumalo , he did not act for this reason ... disciplinary action was taken , but well after the fact . I think it was after he was charged by IDAC”

General Khumalo was acting as the head of Crime Intelligence at the time of the incident but only acted for a very short time and could not charge General Lushaba himself.

“he was acting for a very short time ... but he could not charge him self”

General Sibiya was above General Khumalo at the time of the incident and should have disciplined General Lushaba.

“General Khumalo of all s under General Sibiya ... Somebody else in the position of either General Sibiya or whoever would have been in that position ... would have been the person that should discipline him”

General Khumalo is not charged with any offense related to failure to discipline General Lushaba, and neither is General Sibiya or his equivalent charged or arrested.

“why are you not charging General Sibiya as well ... why are you not arresting that person ?”

General Khumalo is the head of Crime Intelligence and others are senior managers implicated in the capture of systems and processes for private interest.

“the head of CI… and other senior managers ... depict the capture of systems and process for private interest”

Advocate Khumalo argues that a Section 27 affidavit containing only a list of names without linking them to specific offences or providing any complaint or allegations against them is insufficient to form a view that these people have committed serious offences and should be investigated.

“But if the prosecutor has not engaged with Mr Adams, and all you have given the prosecutor is the section 27 affidavit, how can the prosecutor come to you and say, I have reason to believe that people whose names are not mentioned in the affidavit, whose conduct is not mentioned in the affidavit, have committed such serious offences as you list in 1.1 to 1.11 on page 3282.”

Advocate Khumalo states that the Section 27 affidavit does not mention most of the people in the annexure, nor does it say that these people have committed offences - thus only giving a list of names without any allegations does not justify investigation against them.

“My difficulty is this, that you give her the affidavit. We have seen the section 27 affidavit. It does not mention most of the people in the annexure. It does not say any of these people have committed offences... All you gave her was a list of names.”

Advocate Khumalo states that people not mentioned in the affidavit and against whom no allegation is made should not have been included in the annexure list, as there is no basis for investigation against them.

“They should not have been included in this annexure, because even you, as you got the application, you would say to her, but these people are not in the affidavit. No allegation is made against them.”

Mr Adams stated he has intelligence documents that were placed under ADV BALOY ISC's door which suggest General Khumalo and others have committed offences.

“Mr Adams tells you that I have intelligence documents that were shoved under my door and from those documents, I have even more reason to believe that Khumalo and them, General Khumalo and them have committed offences”

The section 28(13) investigation uncovered sufficient evidence to conclude reasonable and probable cause for prosecution and to formulate charges against Lieutenant General Khumalo.

“The investigation unearthed sufficient evidence: (i) To conclude that there was reasonable and probable cause for the prosecution, and (ii) Formulation of the charges against Lieutenant General Khumalo.”

Advocate Johnson admits it is incorrect that Mr Adams' referral landed on his desk in mid-December 2024; he had authorization from the prosecutor by 6 December 2024 and had already engaged on the matter.

“This is incorrect, yes.”

Mr Adams suspected General Khumalo and others due to finding an envelope pushed under his office door at Parliament containing Crime Intelligence procurement and vetting documents using secret funds.

“My suspicion about General Khumalo and others became more clearer when I found an envelope pushed under my office door at Parliament which contained some Crime Intelligence procurement documents using secret funds and vetting documents.”

Mr Adams claims to have intelligence documents shoved under his door suggesting offences committed by General Khumalo and others.

“Mr Adams tells you that I have intelligence documents that were shoved under my door and from those documents, I have even more reason to believe that Khumalo and them, General Khumalo and them have committed offences .”

Advocate Johnson states the affidavit referred to information pushed under his door that included crime intelligence procurement documents secret funds and vetting documents.

“He found an envelope pushed under his office door that contained Crime Intelligence procurement documents using secret funds and vetting documents.”

The investigation team advised and showed that a letter was first written to General Khumalo of Gauteng in the morning, followed by a letter to Lieutenant General Senthumule as Divisional Commissioner of Detectives, who facilitated receipt of the dockets.

“the investigation team advised and in fact showed that we had first written that morning to General Khumalo of Gauteng ... and on the same day, a letter followed to Lieutenant General Senthumule as the Divisional Commissioner of Detectives”

A letter to General Khumalo was because Adam indicated he had opened dockets in Orlando, which falls under Gauteng, thus requiring writing to the Provincial Head.

“When the letter was written to General Khumalo, it was because Adams had indicated he had opened dockets in Orlando, Chair. That falls under Gauteng, so we had to write to the Commissioner”

Mr Adams told the team on the 6th itself that the dockets were with the Inspectorate, prompting letters to both General Khumalo and Lieutenant General Senthumule for explanation.

“you write to General Khumalo on the 6th, but on the same day you write to General Senthumule for the explanation that you have just given ... because Mr Adams told you that the dockets are with the Inspectorate”

General Khumalo informed investigators that the dockets were not with him, which led to follow-up inquiries that found the dockets were with the Inspectorate.

“He had informed the investigators that the dockets were not with him ... we then made the follow-up on where the dockets were ... subsequently found out that those dockets were with the Inspectorate”

The National Director of Public Prosecutions (NDPP) has the authority to review prosecutorial decisions on matters such as the Lushaba and Mokwele cases, and cases with warrants of arrest for Generals Khumalo and Madondo.

“The NDPP has the right to review, or have to be reviewed the Lushaba matter, which is in court, the Mokwele matter, which is in court, and the matter for which warrants of arrest had already been obtained for Generals Khumalo and Madondo”

Advocate Khumalo claims the national instruction requires a person appointed to have at least a three-year degree or diploma in specified fields such as policing, public administration, criminology, intelligence, or engineering.

“It requires that the person must have at least a three-year degree or diploma ... in policing or public administration or criminology or intelligence or electrical or mechanical engineering ...”

The IDAC investigation team that culminated in the arrest of General Khumalo and others was constituted from a group of prosecutors and investigators with designated leadership roles.

“In the investigation conducted by IDAC that culminated in the arrest of General Khumalo and others... the matter was allocated to a group of prosecutors... led by Advocate Ramsamy and Advocate Joy Hlatshwayo.”

Mr Bellochun was mentioned in relation to the matter because he went to inform General Khumalo at Otia about an arrest warrant.

“he was the person who had gone to Otia [ ? ] to inform General Khumalo that there was a warrant of arrest”

The section 27 affidavits specifically identify General Khumalo, General Madondo and General Lushaba, but do not reference persons identified under items 4 to 12 in the annexure.

“I cannot find in the section 27 the persons identified under items 4 to 12 ... It does not reference any of the people listed from 4 till 12.”

The referral affidavit raises concerns about General Khumalo, General Lushaba, and General Madondo manipulating procurement processes to appoint and promote certain members.

“I suspect that General Khumalo and other senior officers in Crime Intelligence, including Madondo and Lushaba, were manipulating procurement processes and processes to appoint and promote certain members.”

The same affidavit alleges that persons appointed to strategic positions are suspected to be loyal and close to Khumalo, Lushaba, and Madondo or those close to them.

“It speaks of persons being appointed to strategic positions and that such persons are suspected to be loyal and close to Khumalo, Lushaba, and Madondo and those close to them.”

There are multiple separate investigations related to the Section 27 affidavit referral, including the Lushaba matter, the Mokwele matter, and a third investigation involving Lieutenant-General Khumalo and General Madondo.

“There is then a third investigation. That is the one for which the warrants were held over, just for context, in terms of Lieutenant-General Khumalo and General Madondo. And then there are other matters that also emanate from this complaint.”

An allegation is made about General Khumalo involving the former Minister of Police, Minister Cele.

“I see reference to General Khumalo where an allegation is made about the former Minister of Police, Minister Cele.”

There are at least six separate investigations relating to a Section 27 referral involving General Lushemba matter, Mokwele matter, and others including Lieutenant-General Khumalo and General Madondo.

“When the prosecutors got the Section 27 referral, Counsel, they broke it up as follows. Started with the General Lushabama matter. Yes. That is the first matter. The Mokwele matter being ... there is a third investigation ... warrants were held over for Lieutenant-General Khumalo and General Madondo ... there are other matters ... five, six ... there would be six.”

Mr Adams has a growing concern that General Khumalo, General Lushaba, General Madondo, and other senior Crime Intelligence officers are involved in systematic capture of the Crime Intelligence division.

“it expresses his growing concern that the Head of Crime Intelligence, General Khumalo, General Lushaba, General Madondo, and other senior Crime Intelligence officers are busy with systematic capture of Crime Intelligence division”

There is suspicion that former Minister Bheki Cele appointed General Khumalo without an interview process and that Khumalo had no prior experience in the relevant role.

“an allegation that the former Minister appointed General Khumalo without an interview process and without Khumalo having worked as a ...”

General Khumalo, General Lushaba, General Madondo and appointees are suspected of siphoning money from secret fund accounts across about 10 secret fund points in the country, which need investigation.

“My suspicion is that General Khumalo, Lushaba, Madondo and many of those who they have appointed are actively syphoning money from the secret fund accounts in the country. I understand that there are about 10 secret fund points in the country where monies can be drawn from and all of these extraction points need to be investigated.”

The section 27 affidavits specifically identify General Khumalo, General Madondo and General Lushaba, but do not include the persons identified under items 4 to 12 in the annexure presented by Advocate Johnson.

I t d o e s n o t r e f e r e n c e a n y o f t h e p e o p l e l i s t e d f r o m 4 t i l l 1 2 .”

Advocate Khumalo states that the authorization to conduct an investigation should be preceded by an application, and then the authorization follows the application.

“I had understood that what should precede this authorisation is an application.”

Mr Adams has growing concern that senior Crime Intelligence officers, including General Khumalo, General Lushaba, and General Madondo, are involved in systematic capture of the Crime Intelligence division.

“It expresses his growing concern that the Head of Crime Intelligence, General Khumalo, General Lushaba, General Madondo, and other senior Crime Intelligence officers are busy with systematic capture of Crime Intelligence division.”

There is an allegation that former Minister Bheki Cele gave a General Khumalo an appointment without an interview process and without Khumalo having worked as a...

“There is a second leg to it, an allegation that the former Minister appointed General Khumalo without an interview process and without Khumalo having worked as a...”

Mr Adams suspects that Generals Khumalo, Lushaba, Madondo, and many they have appointed are syphoning money from secret fund accounts across approximately 10 secret fund points.

“My suspicion is that General Khumalo, Lushaba, Madondo and many of those who they have appointed are actively syphoning money from these secret fund accounts in the country. I understand that there are about 10 secret fund points in the country where monies can be drawn from and all of these extraction points need to be investigated.”

General Khumalo, Lushaba, Madondo and other senior Crime Intelligence officers are busy with the systematic capture of the Crime Intelligence Division.

“the suspicion is General Khumalo, Lushaba, Madondo and others senior Crime Intelligence officers were busy with the systematic capture of the Crime Intelligence Division”

General Khumalo and other senior officers in Crime Intelligence, including Madondo and Lushaba, are suspected of manipulating procurement processes and appointing or promoting certain members to higher positions.

“he says "I suspect that General Khumalo and other senior officers in Crime Intelligence , including Madondo and Lushaba , were manipulating procurement processes and processes to appoint and promote certain members to higher positions."”

General Khumalo did not provide IDAC with the information that was slipped under his door regarding Crime Intelligence corruption suspicions.

“he did not give IDAC that information which was slipped under his door”

Advocate Johnson's suspicion became clearer upon finding an envelope with Crime Intelligence procurement documents using secret funds pushed under his office door at Parliament.

“My suspicion about General Khumalo and others became more clearer when I found an envelope pushed under my office door at Parliament , which contained some Crime Intelligence procurement documents using secret funds of Crime Intelligence and vetting documents.”

General Khumalo, Lushaba, Madondo and other senior Crime Intelligence officers were suspected of systematic capture of the Crime Intelligence Division.

“That General Khumalo, Lushaba, Madondo and other senior Crime Intelligence officers were busy with the systematic capture of the Crime Intelligence Division.”

An envelope containing Crime Intelligence procurement documents using secret funds and vetting documents was pushed under Mr. Adams' door at Parliament, leading to suspicion regarding General Khumalo and others.

“That suspicion became even clearer when an envelope pushed under his door at Parliament contained Crime Intelligence procurement documents using secret funds of Crime Intelligence and vetting documents.”

The suspicion about systematic capture of Crime Intelligence involves manipulation of procurement and appointment processes to appoint and promote certain members to higher positions.

“I suspect that General Khumalo and some senior officers in Crime Intelligence, including Madondo and Lushaba, were manipulating procurement processes and processes to appoint and promote certain members to higher positions.”

Mr. Adams' suspicion became clearer when he found an envelope containing Crime Intelligence procurement documents using secret funds and vetting documents pushed under his office door at Parliament.

“My suspicion about General Khumalo and others became more clearer when I found an envelope pushed under my office door at Parliament, which contained some Crime Intelligence procurement documents using secret funds of Crime Intelligence and vetting documents.”

IDAC wrote to Major General Khumalo on 6 December formally requesting dockets in Gauteng as part of the preliminary investigation.

“It would have been one of the investigators ... who indicated that we need to write a letter to the Head of the detectives in Gauteng, who was a Major General Khumalo. ... I did pen a letter under my hand to the Major General, indicating that IDAC was now vested with an investigation and would require the dockets ...”

A decision to authorize a preliminary investigation under section 28(13) was taken on 6 December 2024, the same day a request for dockets was made to Major General Khumalo.

“Major General Khumalo was requesting the dockets was on the 6th of December. ... That is the same day a decision was taken to authorise a preliminary investigation.”

The dockets were no longer in Cape Town but were opened in Gauteng, requiring engagement with detectives in Gauteng and formal letter requests to Major General Khumalo.

“in Cape Town, these dockets were no longer there ... he opened dockets in Gauteng ... we engage then with detectives in Gauteng ... write a letter to the Head of the detectives in Gauteng, who was Major General Khumalo. It is a formal approach in terms of acquiring those dockets.”

A letter from IDAC was sent to Major General Khumalo requesting the dockets as part of the investigation as per the Minister's letter and Mr Adams' communication.

“I did pen a letter under my hand to the Major General, indicating that IDAC was now vested with an investigation and would require the dockets as per the letter, which were the dockets that were referred to in the Minister's letter and subsequently by Mr Adams.”

There are concerns regarding General Khumalo, General Lushaba, and General Madondo manipulating procurement processes and appointing/promoting certain members loyal to them in Crime Intelligence.

“I see concerns regarding General Khumalo, General Lushaba, General Madondo. ... I suspect that General Khumalo and other senior officers in Crime Intelligence, including Madondo and Lushaba, were manipulating procurement processes and processes to appoint and promote certain members.”

Allegations are made about the former Minister of Police, Minister Cele, in connection to General Khumalo.

“reference to General Khumalo where an allegation is made about the former Minister of Police, Minister Cele.”

A letter was written to the provincial commissioner of detectives, Major General Khumalo, requesting police dockets to locate whether they were intercepted.

“A letter was written to the provincial commissioner detectives, Major General Khumalo, requesting the dockets.”

The provincial commissioner of detectives Major General Khumalo indicated he knew about the dockets but they were not with him and that the dockets could be with the Directorate for Priority Crime Investigation (DPCI), but the dockets were actually with the SAPS Inspectorate headed by General Peter Jacobs.

“General Khumalo ... indicated that he knew about these dockets, but ... these dockets were not with him ... indicated that the dockets could be with the DPCI ... the dockets actually were with the SAPS Inspectorate, more so the head of the Inspectorate, General Peter Jacobs.”

An investigation was undertaken upon receipt of the dockets, concluding there was reasonable and probable cause for prosecution and formulation of charges against Lieutenant General Khumalo and his co-accused.

“Following upon receipt of the dockets, the information contained therein was analysed. Thereafter, an investigation was undertaken. The investigation unearthed sufficient evidence to: conclude that there was reasonable and probable cause for the prosecution; and formulation of the charges against Lieutenant General Khumalo and his co-accused.”

Advocate Johnson agrees that facts do not change based on whether matters are representations or court cases, and that historical facts remain facts independent of legal processes.

“Facts do not change because they are representations.”

Advocate Johnson states that upon receipt of the dockets, an investigation was conducted and it unearthed sufficient evidence to conclude that there was reasonable and probable cause for the prosecution of Lieutenant Khumalo and his co-accused.

“Following upon receipts of the dockets, the information contained therein was analysed. Thereafter, an investigation was undertaken. The investigation unearthed sufficient evidence to conclude: that there was reasonable and probable cause for the prosecution; and formulation of the charges against Lieutenant Khumalo and his co-accused.”

Advocate Johnson agreed she will respond to questions but will invoke her right to refuse on a question-by-question basis if she feels a question is sub judice, rejecting blanket refusal of questions.

“can we leave it here that you will respond to questions but where you feel that you cannot respond to a specific question, you will invoke your right as you wish on a question-by-question basis so that there is no blanket refusal to respond to these questions? ... That is correct.”

Advocate Johnson as the Head of Office makes the prosecution decision and communicates that decision to the office of the Director of Public Prosecutions (DPP).

“As the Head of Office, I communicate the decision. And to communicate the decision, Commissioner Khumalo, I must have reconciled myself with that decision.”

There are two perspectives on prosecution decisions: one based on reviewing all facts to decide on prosecution, and a second where a charge sheet is prepared and the decision to prosecute is made by the team.

“One is to say, we have investigated this case. These are all the facts. Please look at all the facts and decide whether this person should be prosecuted or not. That is one way of looking at it. The other way of looking at it is that you say, we have conducted an investigation. We have prepared a charge sheet. I am satisfied that there is a prima facie case. I have made a decision to prosecute.”

Advocate Johnson affirmed that the investigation had sufficient evidence to conclude reasonable and probable cause for the prosecution and formulation of charges against Lieutenant Khumalo and co-accused.

“The investigation has sufficient evidence to establish the two factors ... the investigation unearthed sufficient evidence to conclude ... That there was reasonable and probable cause for the prosecution; and formulation of the charges against Lieutenant Khumalo and his co-accused ... I am informed through the team to myself here in 24 that there is sufficient information, sufficient evidence.”

Previous investigations into senior police officials do not impact the current matter involving the arrest of General Khumalo.

“No, it was just merely to indicate that there were other matters of also senior police officials within the SAPS environment.”

Lieutenant General Khumalo was arrested at Oliver Reginald Tambo International Airport, with his co-accused already invited to report to Brooklyn Police Station at the time of his arrest.

“Lieutenant General Khumalo was arrested after he had landed at the Oliver Reginald Tambo International Airport, OR TIA. I do not recall where he was travelling from. I was informed that, at the time, his co-accused had already been invited to report to the Brooklyn Police Station.”

Investigators informed Lieutenant General Khumalo of a warrant for his arrest at ORTIA and requested him to hand himself over, with warrants also sought for his co-accused at Brooklyn SAPS.

“The investigators went to OR TIA to inform General Khumalo that there was a warrant for his arrest and for him to hand himself over. They had a warrant of arrest for him. Warrants of arrest had also been sought and obtained for his co-accused before they were requested to hand themselves over at the Brooklyn SAPS.”

Lieutenant General Khumalo personally thanked Chief Investigator Perumal for treating him and his co-accused respectfully during the arrest process, indicating no ulterior motives by the unit involved.

“Once Lieutenant General Khumalo had been processed at Brooklyn Police Station, he personally thanked Chief Investigator Perumal for treating him and the other co-accused in a respectful and dignified manner. This talks to anything but the conduct of a unit that is motivated by ulterior motives other than to address alleged criminality.”

It is false to suggest Lieutenant General Khumalo was arrested because he was the coordinator of the Political Killings Task Team (PKTT).

“I would be remiss if I do not dismiss the suggestion that Lieutenant General Khumalo was arrested because he was the coordinator of the Political Killings Task Team (PKTT). This suggestion is anything but true. It is false as it is unfortunate.”

A section 28 summons dated 6 February 2025 required original complete applications for security clearances and vetting files for senior officers of the South African Police Service including Generals Khumalo, Lushaba, Madondo, Ncube, and others.

“section 28 summons dated the 6th of February 2025 ... required original complete applications for security clearances and vetting files ... for the following senior officers of the South African Police Service ... Lieutenant General Khumalo, Lushaba, Madondo, Ncube, Janse van Vuuren ...”

The subpoena specifically pertains to documentation relating to the bigger investigation into security clearances, not the arrests of General Khumalo and others.

“the subpoena must be responded to positively because it does not deal with the arrest of General Khumalo and the others”

Advocate Johnson was divested of the power to be involved in matters involving General Khumalo and others by a request granted by the National Director of Public Prosecutions.

“she made a request to be divested and it was granted by the National Director of Public Prosecutions”

IDAC received cyber search warrants for Matlala's cellphones and electronic devices presented by Lieutenant Colonel Khumalo to investigate the tender matter.

“IDAC did get cyber search warrants for the cellphones and electronic devices of Matlala. These were presented to IDAC by a Lieutenant Colonel Khumalo. The data was downloaded in his presence and he left with the devices.”

Lieutenant-General Khumalo's arrest and co-accused preceded a death threat received directly on the cell phone of an NPA prosecutor involved in the investigations.

“I received a death threat directly on my cell phone. I read: “Mrs IDAC, you and your guy Chabalala, Perumal, Padayachee, and Belochana have went too far. You are going to wish you did not … with us, get body bags ready.” In my long career as a prosecutor, this is the first time that I received a death threat.”

General Khan made contact again indicating that detectives had allocated a new investigative team, but no arrests have been made yet in that matter despite follow-up by Commissioner Khumalo.

“there was a time when he did make contact with me again to indicate that the detectives had allocated a new team... I am aware, Commissioner Khumalo, that he did follow up that. And I am aware that they actually had a proper engagement with him. I am not sure where that engagement is now, given there is no arrests in the matter”

The appointment and installation of certain persons in positions within the Crime Intelligence Unit (CIU) by Lieutenant General Khumalo and co-accused enabled them to strategically access funding without following proper procedures, and token appointments did not stop their unlawful acts.

“The picture that has emerged is that the appointment and installation of certain persons in certain positions within the Crime Intelligence Unit, CIU, by Lieutenant General Khumalo and his co-accused persons helped them strategically to access funding without following proper processes. This is because the token appointments would not stop them from their unlawful acts.”

Lieutenant General Khumalo was arrested on 26 June 2025 at Oliver Reginald Tambo International Airport by two senior criminal investigators from IDAC, Mr Suneel Bellochunan and Ayan Dambalo.

“Lieutenant General Khumalo was arrested on 26 June 2025 at Oliver Reginald Tambo International Airport, OR TIA. Only two senior criminal investigators within IDAC were tasked with the exercise and affected his arrest. It was Mr Suneel Bellochunan and Ayan Dambalo (the investigators).”

Lieutenant General Khumalo and his co-accused face charges including contraventions of sections 4(a) and 4(b) of the Prevention and Combating of Corrupt Activities Act and fraud.

“The charges which each of the accused persons, Lieutenant General Khumalo in particular, is facing. The Commission will note that they are facing, among others: 1.1 Contraventions of the provisions of section 4(a) of the Prevention and Combating of Corrupt Activities Act, 12 of 2004; 1.2 Contraventions of the provisions of section 4(b) of the Prevention and Combating of Corrupt Activities Act, again 12 of 2004; and 1.3 Fraud and other related offences.”

Advocate Johnson asserts that he has not been directed, encouraged, permitted or participated in any politically motivated prosecution or investigation against Lieutenant Colonel Khumalo or any crime intelligence official.

“I have not been directed, encouraged, permitted or participated in any politically motivated prosecution or investigation against Lieutenant Colonel Khumalo or any crime intelligence official”

Advocates Johnson and Khumalo testified in the Ad Hoc Committee late last year in relation to the same issues.

“you testified in the Ad Hoc Committee sometime late last year? That is correct, sir. And you testified in relation to the same issue? Yes”

Advocate Johnson indicates that facts about what happened in 2024 do not change because of representations or judicial matters and should remain valid regardless of ongoing processes.

“Facts do not change because they are representations. If we are looking at what happened in 2024, those are facts... those facts remain, unless somebody changes them as they go along. But if they are what they are, and they have always been what they are, that should not be an issue”

General Khan made contact indicating that detectives had allocated a new team to investigate, but no arrests have been made; Commissioner Khumalo followed up and engaged properly with General Khan.

“there was a time when he did make contact with me again to indicate that the detectives had allocated a new team. I am not sure if it ended up being to his satisfaction, as I am aware that there have not been arrests made on the matter. But I am aware, Commissioner Khumalo, that he did follow up that. And I am aware that they actually had a proper engagement with him”

Lieutenant General Khumalo was being investigated by IDAC in his capacity as Divisional Commissioner of Crime Intelligence for alleged unlawful conduct related to his execution of duties.

“The truth is that IDAC was investigating Lieutenant General Khumalo in his capacity as the Divisional Commissioner of Crime Intelligence for alleged unlawful conduct that manifested itself in the execution of his duties in that capacity.”

The fact that Lieutenant General Khumalo held a portfolio related to the PKTT was unknown to the investigating body and irrelevant to his arrest.

“The fact that Lieutenant General Khumalo also held another portfolio in relation to the PKTT was not within our knowledge. At no stage was I, as the Head of IDAC, aware that Lieutenant General Khumalo had anything to do with the PKTT, let alone being its convener. In any event, even had I been aware of same, such would have been irrelevant because of the reasons for his arrest.”

Advocate Johnson denies being directed, encouraged, permitted or participating in any politically motivated prosecution or investigation against Lieutenant Colonel Khumalo or any crime intelligence official.

“I have not been directed, encouraged, permitted or participated in any politically motivated prosecution or investigation against Lieutenant Colonel Khumalo or any crime intelligence official.”

Advocate Johnson confirms that the National Director removed Lieutenant Colonel Khumalo from the specific matter but not from office, and that a review is to be held.

“Not from office, but from the matter. The National Director in the email also says, Advocate Sello, that there is a review to be held. And so my having asked to be removed and being released...”

General Khumalo was due to be arrested on about 16 June 2026 within the context of the fourth docket involving extensive investigations.

“we now learnt that General Khumalo was due to be arrested on the 16th of June 2026”

Appointment and installation of certain persons in Crime Intelligence Unit (CIU) by Lieutenant General Khumalo and co-accused helped them access funding without following proper processes, and token appointments did not stop their unlawful acts.

“the appointment and installation of certain persons in certain positions within the Crime Intelligence Unit , CIU , by Lieutenant General Khumalo and his co-accused persons helped them strategically to access funding without following proper processes . This is because the token appointments would not stop them from their unlawful acts .”

The documents concerning the arrest and prosecutions related to General Khumalo and others are no longer in the possession or responsibility of Advocate Andrea Johnson or IDAC Head.

“The instructions are the documents concerning the arrest and prosecutions relating to General Khumalo and others are no longer in the possession of Ms Johnson, nor is she responsible for them”

IDAC is not involved in any investigation relating to Molefe. IDAC's only interest in Vusimusi 'Cat' Matlala's case arose from a section 27 referral from SAPS concerning the unlawful awarding of a tender to Matlala's company Medicare 24, and allegations of collusion and corruption with Matlala and some SAPS officials. Cyber search warrants for Matlala's phones and electronic devices were obtained and the data was downloaded in the presence of Lieutenant Colonel Khumalo, who then left with the devices.

“IDAC is not involved in any investigation relating to Molefe. With regards to Vusimusi “Cat” Matlala (Matlala) IDAC's only interest arose out of a section 27 referral from SAPS with regards to the unlawful awarding of a tender to his company, Medicare 24, and allegations of collusion and corruption with Matlala and some SAPS officials. IDAC did get cyber search warrants for the cell phones and electronic devices of Matlala. These were presented to IDAC by a Lieutenant Colonel Khumalo. The data was downloaded in his presence and he left with the devices.”

Advocate Johnson received a death threat message on his cellphone following the arrest of Lieutenant-General Khumalo and co-accused, which stated that individuals including members of IDAC had 'went too far' and were going to 'wish you did not ...' with a threat to have body bags ready. This was the first death threat he had received in his long career as a prosecutor.

“I received a death threat directly on my cell phone. I read: “Mrs IDAC, you and your guy Chabalala, Perumal, Padayachee, and Belochan have went too far. You are going to wish you did not … with us, get body bags ready.” ... In my long career as a prosecutor, this is the first time that I received a death threat.”

A report by Major-General Acting Divisional Commissioner Inspectorate NMD Ladla dated 4 November 2024 outlines the opening of two sets of dockets and discusses criminal allegations against Generals Khumalo, Lushaba, Madondo and Brigadier Ncube including abuse of secret service accounts, cover-up of criminal incidents, tax evasion, and nepotism.

“The criminal allegations in the six cases which were opened are levelled against Generals Khumalo, Lushaba, Madondo and Brigadier Ncube and are centred on four specific matters, namely: Abuse of Secret Service Account ... Cover-up of criminal incident linked to Villieria CAS number ... Failure to address Major-General Madondo's results of the polygraph examination ... Practices of nepotism”

IDAC had involvement with the dockets by 6 December 2024, confirmed by WhatsApp communication to Major-General Khumalo.

“IDAC is here with me pertaining to the dockets”

There was a WhatsApp communication dated 6 December 2024 from IDAC to Major-General Khumalo regarding the Fadiel Adams dockets.

“Good day, General. Please let me know when I can call. It is in connection with the Fadiel Adams dockets. IDAC is here with me pertaining to the dockets”

The initial docket mentioned General Khumalo appointing family members and friends in positions at Crime Intelligence, but this was insufficient and needed more information.

“The initial docket just talked about General Khumalo, if I can recall, appointing family members and friends in positions at Crime Intelligence ... it needed more information.”

Lieutenant-General Khumalo allegedly appointed friends and family members in the division without providing details of their identities, which hindered investigation into the allegations.

“No details are provided regarding the identity of the friends and family members of Lieutenant-General Khumalo, who was allegedly appointed in the division. (This would at least have enabled the investigation into the allegations.)”

The complainant alleges that none of the people appointed in Crime Intelligence have the necessary skills, qualifications and experience and that many appointees are associates and relatives of Lieutenant-General Khumalo.

“The complainant alleges "none of the people appointed in CI have the necessary skills, qualification and experience", and that many of these appointees are associates and relatives of Lieutenant-General Khumalo.”

Secret Service Account was abused by Lieutenant-General Khumalo and Major-General Lushaba, who failed to pay authentic sources but channeled funds to purchase vehicles for the KwaZulu-Natal Political Task Team, a private service or front for former Police Minister General Bheki Cele.

“It further alleges that the Secret Service Account was abused by Lieutenant-General Khumalo and Major-General Lushaba, who failed to pay authentic sources but channelled funds to purchase items such as vehicles for the KwaZulu-Natal Political Task Team. According to the complainant, this task team is a private service to or front for the former Minister of Police, General Bheki Cele.”

Lieutenant-General Khumalo was involved in a cover-up of CAS 38 where an official laptop and cellphone were stolen by a sex worker, with monies from the Secret Service Account used to pay the sex worker and purchase new equipment.

“Lieutenant-General Khumalo was involved in the cover-up of the CAS 38 wherein Major-General Lushaba, the Division Crime Intelligence, where an official laptop and cellphone was stolen by a sex worker. Monies from the Secret Service Account was utilised to pay for a sex worker and purchase new equipment.”

The docket for CAS 404 contained an allegation of cover-up against General Khumalo but lacked necessary facts to support the complaint.

“404 say that General Khumalo was involved in a cover-up, and the summary, as I understand it, of this docket, 404, is it lacks the necessary facts to support the cover-up complaint.”

The Inspectorate received many complaints including the allegation of cover-up by General Khumalo, and they investigate even scant complaints starting with a CAS number and a link to the station.

“The Inspectorate, any complaint that is given to them, they receive many complaints. They will go and look at what the complainant is saying, even if it is scant, go and look at it. Try to determine what is this person saying. But here you have a CAS number, a starting point, a link. Go to the station, you do not even have to go, you summon the docket.”
