Mr Fadiel Adams

Advocate Serunye read the section 27 referral affidavit, which was similar to the complainant Fadiel Adams' statement and contained nothing of substance.

“I read and I could see as I am reading through that this affidavit is similar to the other affidavit of Mr Adams because there was nothing that stood out for me in that affidavit”

ADV Baloyi SC asserts that the document 'the 27' is a Mr Fadiel Adams document from outside the IDAC and is not an internal document as claimed by the ID.

“But you knew she is wrong. It is not an internal document. It is a Mr Fadiel Adams document, so it comes from outside into the IDAC.”

Mr Bellochun consulted with another witness from Crime Intelligence, not Mr Fadiel Adams.

“there is another witness that he has consulted with from Crime Intelligence”

Chief Perumal provided copies of between 10 to 20 pages of docket documents to the meeting, received from Mr Fadiel Adams.

“Chief Perumal brought a stack of documents ... between 10 to 20 pages ... he received them from Mr Fadiel Adams.”

MR RAPHESU had a serious concern about an A1 affidavit in the Mokwele matter being purportedly commissioned on 6 January without his presence or knowledge, and Mr Adams never mentioned the contents during his information provision.

“So my concern is , on the day in question , there were only four supplementary affidavits that were obtained , and if that purported A 1 is indicated that was obtained on that day , on the 6th , it was not obtained in my presence . So I am basically also indicating that if there is a possibility that it was obtained on that day , I cannot dispute that , but it was obtained not in my presence . I also indicate that the information that Mr Fadiel Adams provided to us on that day , he never said anything about what was contained in that A 1 , and it could not be that it was obtained at that day , because that information was not readily available at that time .”

Adv Sello SC noted an aborted arrest on June 18, 2020 in respect of docket 543-06-26, and questioned whether it or warrant applications were prompted by Mr Fadiel Adams' arrest by the PKTT.

“I call it the first arrest, and not that there was a second, but I do so to distinguish it from what I call the aborted arrest, the one of June 18th, Yes, June 18th, 2020, ja, thank you. Now, that, the one of June 18th is in respect of docket 543-06-26, the second docket. Now, it was not that arrest or application for those warrants, they were not by any, in any manner, prompted by the arrest of Mr Fadiel Adams by the PKTT, no?”

Adv Johnson confirmed there was no connection between the aborted arrest/warrant application and Mr Fadiel Adams' arrest by the PKTT.

“No.”

IDAC issued a section 28 summons demanding travel documents relating to the PKTT team's travel to the Western Cape for the arrest of Mr Fadiel Adams between 30 April and 8 May 2026, signed by Advocate Manilall.

“demanding details and documents pertaining to the PKTT team's travel to the Western Cape to arrest Mr Fadiel Adams ... It is signed by Advocate Manilall.”

ADV Johnson states he saw on television that Mr Adams was arrested but is not aware of any official investigation by IDAC regarding that arrest.

“No, I did see on television that Mr Adams was being arrested. That is a matter that must get dealt with wherever it gets dealt with ...”

ADV Johnson states there is no legal basis within IDAC investigations for any inquiry into who arrested Mr Adams, why, or the details of the arrest.

“there is no legal basis for the existing investigations in IDAC where Mr Adams made a 27 referral and however many supplementary A1's. It cannot take the matter further knowing who arrested him, why they arrested him, and so on.”

The list of names of potential offenders in the Fadiel Adams complaint was expanded from about 3-4 persons in the section 27 affidavit to 12 persons in later documentation, raising questions about the factual basis for expanding the list to 12.

“if all Mr Adams gives Mr Perumal is a list of names and it is now 12 people ... what is the factual basis for you coming to a conclusion ... that you have reason to believe that the persons in the annexure have committed the offences”

Mr Fadiel Adams made a referral which was supervised and overseen like any other referral; four dockets relevant to the referral were requested from SAPS Division Commissioner Detective Lieutenant General Senthumele by ADV JOHNSON.

“The referral was made by Mr Fadiel Adams. It was not treated any differently. It was supervised and overseen like any other. There were four dockets that were relevant to the referral. Following the common established process, I sent a letter to SAPS Divisional Commissioner, Detectives, Lieutenant General Senthumele requesting the dockets.”

The letter from Mr Nkabinde's office referred a complaint by Mr Fadiel Adams, a member of Parliament, and concluded by advising Mr Adams to await a decision from the Minister's office.

“this letter ... complained by Mr Adams, a member of Parliament ... Honourable Fadiel Adams was advised by this office to await your decision in this regard”

ADV Baloyi clarified that the letter did not contain a copy of an affidavit but only a copy of written correspondence addressed to the Minister by Mr Adams.

“this letter does not say here is a copy of an affidavit. It says a copy of a written correspondence addressed to the Minister.”

Advocate Johnson agrees that referring to a copy of written correspondence by Fadiel Adams which sets out serious allegations contained in the letter explains why there is reference to the dockets, but emphasizes that the written correspondence would have set out the serious allegations.

“I agree with the reading of a copy of a written correspondence, which would have set out those serious allegations as contained and therefore the reference to the dockets because he refers to the dockets, but that the written correspondence would have set out those serious allegations.”

Advocate Johnson maintains that the Minister's referral and request for investigation per Section 27 deals with serious allegations set out in written correspondence by Fadiel Adams to the Minister and those probably refer to the dockets.

“I still maintain that although you have that email, this letter tells your referral and request for investigation in terms of Section 27. It does talk to copy of written correspondence to the Minister by Fadiel Adams. And therein are serious allegations. And due to the nature of these allegations, they are referring them to those, to the allegations as he makes out in his written correspondence, which must almost invariably, it would seem, refer to the dockets.”

The referral made by Mr Fadiel Adams (Mr Adams) was supervised by usual protocols, with a letter sent to SAPS Divisional Commissioner Detective Lieutenant General Senthumule requesting dockets.

“The referral was made by Mr Fadiel Adams (Mr Adams). ... Following the common established process, I sent a letter to the SAPS Divisional Commissioner of Detectives, Lieutenant General Senthumule, requesting the dockets.”

The application for the issue of warrants of arrest forms the end point of the investigation timeline relevant for the commission's purposes.

“The end point being the application for the issue of warrants of arrest”

Honourable Fadiel Adams made a complaint implicating very senior members of the South African Police Service in relation to the Langlaagte CAS case and others opened between 29 October and 1 November.

“The allegations contained therein implicate very senior members of the South African Police Service and are reviewed in a serious light and CAS dockets were registered as follows . ... one Langlaagte case and three of those Orlando cases that Mr Adams registered between the 29th of October and the 1st of November .”

Fadiel Adams opened different CAS cases in Cape Town, Orlando, and Langlaagte police stations to ensure complaints reported in Cape Town did not disappear, but did not specify the nature of the Langlaagte case complaint.

“he states : “ A few days after I opened the three cases at Cape Town police station , I decided to go to Gauteng and I went to Orlando Police Station where I opened another three cases based on the three cases I opened in Cape Town . I did this to ensure that what I had reported in Cape Town does not disappear . I also opened a separate case at Langlaagte police station . ” ... He does not say what the Langlaagte case is about .”

There was a WhatsApp communication dated 6 December 2024 from IDAC to Major-General Khumalo regarding the Fadiel Adams dockets.

“Good day, General. Please let me know when I can call. It is in connection with the Fadiel Adams dockets. IDAC is here with me pertaining to the dockets”

The affidavit of Mr. Fadiel Adams was commissioned by Chief Investigator Dylan Perumal, who was physically present in Cape Town when the affidavit was taken, despite the office address of the Commissioner of Oaths being Pretoria.

“That affidavit was commissioned by Chief Investigator Dylan Perumal. ... I believe Chief Investigator Perumal was physically in Cape Town.”

The affidavit signed by Mr. Fadiel Adams bears the Pretoria office stamp, although it was commissioned in Cape Town. This is unusual as stamps normally indicate location of commission and it is not obligatory to stamp an affidavit.

“He stamped it with a Pretoria date stamp, even though he is in Cape Town. ...we do not necessarily put a stamp on the affidavit.”
