Katiso Molefe

Mr Matlala has no relationship or dealings with Ignatius Mothakathi, Andrew Boy Mthethwa or Katiso Molefe, but met them as friends of the late Mr Msibi at his farm premises.

“I do not have any relationship with Mr Ignatius Mothakathi and have never had any dealings with him. ... He is also a friend of Mr Msibi. ... I do not have any relationship with Mr Andrew Boy Mthethwa ... He is also a friend to the late Mr Msibi. ... I do not have any relationship with Mr Katiso Molefe ... He is also a friend of the late Mr Msibi.”

IDAC was not aware of investigations or allegations made against PKTT members such as Mr Matlala and Katiso Molefe.

“IDAC is not aware of these cases that were made, be they by Mr Matlala about the ft, by Katiso Molefe, the ballistic case, or any other case that has been made against any of the PKTT members. They are not all allegations that IDAC is looking at.”

General Mbotho inquired with Maj-Gen Flynn about any operations being conducted by his unit in the Sandton area on 6 December 2024 at Mr Katiso Molefe's residence.

“General Mbotho gave evidence before the Commission about a takedown operation that had been undertaken on 6 December 2024 at Mr Katiso Molefe's residence, and he said that you were one of the Component Heads that he had enquired from as to whether your unit was conducting any operations in the Sandton area”

Maj-Gen Flynn confirmed that he denied any involvement of his personnel in the operation at Mr Molefe's residence and was at the Excellence Awards of the DPCI on that date.

“I confirmed the enquiry that was made by General Mbotho. By then, on that specific date, we were at the Excellence Awards of the DPCI. I was approached by the General and he made enquiries with me, and I denied that any of my personnel are involved in any operation at Mr Molefe's residence”

Brigadier Nkwashu gave an affidavit voluntarily in response to summons to appear at the Judicial Commission of Inquiry regarding allegations of interference in the bail proceedings of Michael Pule Tau, demand for the Armand Swart murder docket, and relationship with Katiso Molefe.

“I make this affidavit voluntarily in response to the summons/subpoena...directing me to appear... in relation to my attempts to interfere the bail proceedings of Michael Pule Tau. The second one was my demand for the Armand Swart murder docket, and my relationship or connection with Katiso Molefe...”

Brigadier Nkwashu confirms that Fundiswa and Katiso Molefe were married in accordance with customary law.

“they were married in accordance to customary law.”

Brigadier Nkwashu states he did not know Sergeant Tshukudu's awareness of Katiso Molefe before their discussion.

“Commissioner Khumalo, I would not know. I would not know, but I really do not know.”

Brigadier Nkwashu clarifies he did not mention Katiso's name in a conversation with other police officers trying to discuss a case.

“I did not mention Katiso's name.”

In February 2025, while still on leave, Brigadier Nkwashu's sister Fundiswa Nyangule contacted him to inform that she was coming to Gauteng to visit her husband Katiso Molefe in prison and asked for a lift from the airport.

“In February 2025, while I was still on leave, my sister, Fundiswa Nyangule, who... contacted me. She informed me that she was coming to Gauteng to visit her husband in prison... She asked if I could fetch her from the airport because she was coming from Durban... I agreed and I went to the airport and picked her up. We drove together to Groenpunt Prison.”

Brigadier Nkwashu complied with all prison security checks during the visit and did not use his rank to gain improper access to Katiso Molefe.

“I was not given any preferential treatment. I waited my turn. I complied with the security checks. I wish to state clearly and unequivocally that... I did not use my rank to gain improper access. I was there primarily to drive my sister, who was a local visitor.”

Brigadier N Kwashu recalled that the docket related to Mr Molefe and the investigation into that case is ongoing by Organised Crime.

“there is an investigation ... on the case of Katiso Molefe ... investigated by the Organised Crime”

Sergeant Nkosi states he collected Harley-Davidson items to return to the store for Molfe, who is his mentee in bike riding, but Molfe only tried on the riding equipment 11 months later.

“Soon my way back from court , I passed by Mr Katiso Molefe's place of abode and collected bikes, gloves, helmet, shield, and T-shirt, which were to be returned to Harley-Davidson as they were smaller or could not fit him ... I think Mr Molefe only realised when he was supposed to wear those particular apparels after 11 months ... he never tried on the helmet and the gloves that Sergeant Nkosi had bought for him in December 2023 for another 11 months.”

Sergeant Nkosi confirms purchasing Harley-Davidson items in December 2023 for Mr Molefe and explains the delay in returning due to mule realization and their relationship with Harley-Davidson as a regular customer.

“The date of that invoice on page 6 is 20 December 2023 ... Yes ... these items on this invoice were items that you purchased at Harley-Davidson for Mr Molefe ... I think Mr Molefe only realised when he was supposed to wear those particular apparels after 11 months ... I would know that Harley-Davidson would replace those things because I am their regular customer, and they know me.”

Sergeant Nkosi states he was mentoring Mr Molefe in bike riding since at least October 2021 and that Molfe was practicing on another bike before his own arrived in South Africa, which was around 2022 to 2023.

“You were mentoring him from 2021 and he was riding from October 2021 at least ... When I started to pay for the bikes, they were not yet in South Africa, they were still in Canada ... I think it could be there by 2022 to 2023 ... before Mr Molefe's bike arrived in South Africa, he was practicing with one of Mr Msibi.”

Sergeant Nkosi confirms Mr Molefe's first bike was a Can-Am three wheeler, not an ordinary two-wheel motorbike.

“So, was the first bike that Mr Molefe ever rode one of those Can-Am three wheelers? ... According to me, yes.”

Sergeant Nkosi confirms he was mentoring Mr Molefe when Molefe started buying bikes, which was around 2022 to 2023.

“When he started to buy those bikes ... That is correct ... I cannot remember vividly the exact date and month, but I think it could be there by 2022 to 2023.”

Sergeant Nkosi states Mr Molefe did not try on Harley-Davidson equipment delivered in December 2023 when it was delivered.

“When you delivered this equipment in December 2023, did Mr Molefe not try it on in your presence? No.”

Sergeant Nkosi passed by Mr Molefe's place and collected bike, gloves, helmet, shield, and T-shirts which were to be returned to Harley-Davidson, but did not go specifically for that purpose and did not actually return them to Harley-Davidson.

“I passed by Mr Katiso Molefe's place of abode and collected bike, gloves, helmet, shield and T-shirt which were to be returned to Harley-Davidson ... I did not go to him specifically for that, but that was just a pass-by ... but I did not take them to Harley-Davidson”

Sergeant Nkosi fetched a paper bag from the home of Katiso Molefe, who is an accused in the murder of Armand Swart, and this was shown in a video clip played during a public hearing.

“Previously, General Khumalo's testimony revealed that Sergeant Nkosi fetched a paper bag from the home of Mr Katiso Molefe, one of the accused in the murder of Mr Armand Swart. During the testimony, a video clip depicting this event was played, showing both Mr Molefe and Sergeant Nkosi.”

Sergeant Nkosi's statement mentions his relationship with Jothan Msibi, Vusi Cat Matlala, Katiso Molefe, General Sibiya, and General Shibiri but does not implicate any person in criminal wrongdoing.

“In his witness statement, Sergeant Nkosi deals with his relationship with Mr Jothan Msibi, Mr Matlala, Mr Katiso Molefe, General Sibiya, and General Shibiri. He does not implicate any of them or any other persons in criminal activity or wrongdoing.”

The order of 30 January 2025 to have Sergeant Nkosi testify remotely only served to shield him from the discomfort of testifying in public, and is no longer justified as there is no cogent basis for fearing for his life from the evidence he intends to present.

“The order of 30 January 2025 only serves to shield Sergeant Nkosi from the discomfort of testifying in public. This is not the purpose of full or partial in-camera hearings. The sergeant will be questioned about his visit to Mr Katiso Molefe's house, during which he was seen leaving with a paper bag, evidence already presented by an earlier witness who showed his face and identified him by name. His image and name are, therefore, known to the public. While the Commission takes the safety of its witnesses seriously and will take all reasonable measures to ensure that its witnesses are not put at risk, it is clear to me that Sergeant Nkosi is no longer justified to testify, or rather, the order that he continue testifying remotely is no longer justified. There is no cogent basis for believing that any of the evidence he intends to present will place his life in danger. It was for these reasons that I made the order of 3 March 2026.”

Lieutenant General Sibiri was aware of suspects charged with the attempted murder of Tebogo Thobejane and their connection to the Arm and Swart contract killer murders but did not know that the same suspects were a group of five or linked to other murders at the time he spoke to investigators in May 2024.

“The attempted murder, I know ... Those who were arrested on the Arm and Swart ... They are linked ... Yes ... You know about the suspects ... charged on the Thobejane one ... You did not have any knowledge of connection of those contract killers ... in May 2024 ... I knew the connection of what? ... No ... I did not know ... No, I did not know.”

Lt-General Shibiri communicated information that Katso Molefe was linked to Mswazi and they were part of a group of five involved in mining interests.

“the information you are communicating to Witness A is that Katiso Molefe was linked to Mswazi and they are part of this group of five”

The arrest of Mr Katiso Molefe on 6 December 2024 made Witness B and the speaker more suspicious about inquiries related to the Swart murder case, especially about Mr Molefe's arrest.

“the arrest of Mr Katiso Molefe on 6 December 2024 made us more suspicious of those who would enquire about the Swart murder case, and in particular, Mr Molefe's arrest”

Lt-Gen Shibiri indicated on 7 December he received a call about complaints concerning the family of Mr Katiso Molefe not knowing where he was detained and phoned around Gauteng for information.

“On the 7th I received a call to indicate that the family of Molefe is complaining about not knowing where was he detained, and I phoned around in Gauteng”

Lt-Gen Shibiri said he denied that one reason for not going to the farm was to avoid giving feedback about the Molefe case; the real reason was ill health.

“No, it was not the reason. The reason was my ill health, hence I phoned him to get more information because I knew on the 18th I was going back to work.”
