The applicant claimed to be a middle manager at BMW since 2016-2017, but affidavits from BMW state she was never a manager or supervisor there, amounting to misrepresentation.
“she says in her CV , I have been a middle manager in BMW since , I think she says 2016 or 17 ... affidavits from BMW ... both of them say Mokwele was never a manager in BMW”
The applicant's claim in her CV that she saved over one million in IT security project costs and reduced maintenance costs was not confirmed by BMW and viewed as misrepresentation.
“on the last page of the CV, under accomplishments ... she saved over one million in IT security project costs ... BMW cannot confirm that ... then she is making a misrepresentation”
BMW provided witness statements that the applicant was never a manager or supervisor there, contradicting her CV's claim of managerial experience, raising concerns about her shortlisting for the position requiring three years managerial experience.
“witnesses from BMW, Human Resource and immediate supervisor ... both would have said to the Court, she was never a manager ... how is she then shortlisted if one looks at the requirement of three-year managerial experience”
The question asked to BMW regarding Ms Mokwele's managerial status was the wrong question because the role does not require being a manager at BMW, but having appropriate managerial experience above supervisor level.
“what IDAC people did was they went and obtained a 4 July 2025 affidavit from Mr Simon at BMW. But the question they asked is the wrong question because their question was, is Ms Mokwele a manager at BMW? But that is not what the role requires.”
Investigators were engaging with BMW management and interviewing senior managers as early as February 2025, before the official designation in May 2025, which caused confusion about the timing of their designation.
“the designated investigator came to you in February to say, please authorise summons so that we can get these documents in relation to the generals that appear in those summonses ... summons went to BMW again in February ... they could not do that unless they were designated as investigators ... if that designation only happens at the end of May, what were they doing talking to BMW management in February 2025 and interviewing senior managers”
The initial summons to BMW in the investigation was issued on 31 January 2025 and was the starting point of requesting employment-related documents for Mrs. Mokwele.

The investigation process identified Mrs. Mokwele as the subject related to BMW through inquiries even though initial documents only referenced BMW generally.
“By the time we prepared the summons, we knew who she was. Through investigation we identified her and we knew who she was.”
The investigations relied on an A1 statement that mentioned BMW but did not name Mrs. Mokwele initially, requiring further investigation to identify her.
“First of all, on the A1 statement, paragraph 2, there is no name of Mrs Mokwele on there, just BMW”
The investigation started with only the name Mrs Mokwele and the general link to BMW, and only later were detailed documents and identities obtained from the National Commissioner and BMW in February 2025.
“All we had was the name. We did not know exactly initially which BMW it was ... It is when we got the actual documents from the National Commissioner and that you will see we got it in February.”
A civilian from BMW was allegedly favoured for an appointment as per an advertisement that allowed outsiders to apply.
“The allegations that are brought to you is that a civilian from BMW has been favoured ... The adverts said outsiders can apply.”
The initial subpoenas for investigation were sent to BMW and involved looking into security clearances from Brigadier to Lieutenant General level within SAPS.
“The very first subpoena you send to the National Commissioner ... is to BMW ... looking into security clearances of people from Brigadier level to Major General level to Lieutenant General level ... within SAPS.”
Colonel Padayachee had knowledge of requests from BMW relevant to investigations and was physically present when the documents were prepared, confirming his awareness and involvement.
“I had knowledge. The request from BMW, I had knowledge ... I was right there when he was preparing it ... I am aware about it and I confirmed it.”
Colonel Padayachee identified the need to request employment history and related documents from BMW, and would have sought such information with the Chief present.
“I would have asked, okay, I want the employment, the history, everything from BMW. And it would also, the Chief would have been there with me while we discuss it and then I would have said it like that”
General Khan and Mr Vally discussed purchase and customization of BMW vehicles including M5 and M3 models in October 2020 and February 2021.
“General Khan says: “How is the new M5?” ... Mr Vally responds: “Amazing car, get this car bro.” ... General Khan says: “Price.” And Mr Vally says: “I paid for this 2.3 with carbon ceramics ..." ... On February 12th 2021, General Khan says to Mr Vally: "Bro, work out a special price on the V8 M3 for me."”
General Khan and Mr Vally discussed acquisition and readiness of BMW M3 and M5 model vehicles and related registration papers from August 2021 to February 2021.
“General Khan says: “I am not ready now. Got to replenish 10 bars stock in the four shops.” ... Mr Vally says: “M3 be 100 percent ready Jumapolished done. Latest.” ... General Khan and Mr Vally chat about M3 and M5 vehicles and collection details across various dates including August 2021 and February 2021.”
Umama Johnson and her husband were involved in an interview process for an Intelligence post, where the husband was called for the interview and reportedly got the post, but the wife claimed she was not on the panel and did not know about the post, which was inconsistent with the scoring system explained.
“You are arresting Mr Khumalo General Khumalo for hiring a lady from BMW. But you yourself were in a panel that interviewed your husband... The husband gets called there. He gets the post... She says no but that one she told me, and then he told me, and then it ended there... It did not make sense to me.”
General Khumalo was arrested due to allegations involving a woman from BMW, raising suspicions about the legitimacy of the arrest and whether the hiring was done properly.
“Mr Khumalo was arrested for a lady from BMW. Some even thought it was his woman. And even that issue, we still want to check it, as to is it true now that the lady was hired in the right way.”
Brigadier Mokwele was working at BMW head office prior to her appointment.

Warrant Officer Rikhotso pointed Lieutenant Colonel Sebola to the BMW vehicle at the scene with police officers.
“Warrant Officer Rikhotso pointed to me the BMW that he said , this BMW it is together with these police officers”
On 13 May 2025 Major Phiri received R151,462.07 from BMW and R145,000 from We Buy Cars, using a loan from a friend to finance these transactions.
“On the 13th of May, I received R151462.07 payment from BMW. ... on the very same day I received R145000 from We Buy Cars. And on the very same day I received this money that I borrowed from this friend of mine.”
