ADV MANILALL

The team led by Advocate Manilall took over certain cases, with Advocates Ramsamy and Hlatshwayo no longer being part of the prosecution team.

“The team of Advocate Manilall took over the two cases and Advocate Ramsamy ceased to be the prosecutor in the Lushaba case, so did Advocate Hlatshwayo.”

Advocate Manilall was initially a Senior State Advocate, reporting to DDPP Advocate Witbooi, and was later promoted to DDPP.

“At the time when the streams were set up, Advocate Manilall was still a Senior State Advocate, he was not yet a DDPP and he was reporting to one of the DDPPS, Advocate Witbooi, and he only later became a DDPP. I think he went for interviews at some point for the position and was then appointed formally as a DDPP”

When Advocate Manilall was appointed and promoted to DDPP, the prosecution team grew from four to five members.

“So at some point we were five with the appointment of Advocate Manilall as a DDPP. We then became five.”

When Advocate Manilall was appointed to replace another prosecutor, DDPP Louw was overlooked and not part of the case, despite being the default.

“When he gets appointed to replace you in these matters, DDPP Louw is again overlooked. He is again not part of it. He is the default.”

There was a meeting among prosecutors from different teams including Adv Serunye and Adv Manilall, after which it was decided the case could not be saved and should be provisionally withdrawn according to NDPP's decision.

“We got together, me and Manilall and Hlatshwayo and the two other prosecutors ... our decision was that ... there is no way that this case can be saved ... then asked for a meeting with one of the Deputy Directors ... then I heard that the NDPP has decided that the case must be provisionally withdrawn.”

There was a separate review conducted by Independent Directorate Against Corruption (IDAC) distinct from the review by Advocate Mothibi's team, involving two teams who met and agreed the case was a dead horse.

“There was, by the old and the new team in IDAC ... My team and the team of Manilall ... agreed that it appears we are flogging a dead horse.”

Advocate Manilall signed a Section 28 summons under the CAS number relating to the Mokwele appointment, requesting identities and travel documents of PKTT members who arrested Mr Adams.

“That is the section 28 summons signed by Advocate Manilall, which wanted the identities and certified travel documents of PKTTT members who went to arrest Mr Adams, and he does so under the CAS number relating to the Mokwele appointment.”

Advocate Manilall claimed the Section 28 summons was issued to determine if Lieutenant General Khumalo breached bail conditions by authorizing PKTT members to arrest Mr Adams, who was a state witness.

“the purpose behind it from the prosecutor was to determine whether someone else within the PKTT approved those trips, that is fine, and that if it was in fact General Khumalo who authorized those trips, then he was sending people to deal with Adams, and it could have a potential of interfering with the bail condition.”

Advocate Manilall's explanation for issuing the Section 28 summons was false because PKTT members were under no bail condition preventing them from dealing with witnesses or arresting Mr Adams.

“I want to say if that is the explanation he gave you it is a false explanation. Those individual members and anyone else in the world was under no bail condition that they could not, that is one reason, that they could not deal with any witnesses. There was nothing like that.”

IDAC issued a section 28 summons demanding travel documents relating to the PKTT team's travel to the Western Cape for the arrest of Mr Fadiel Adams between 30 April and 8 May 2026, signed by Advocate Manilall.

“demanding details and documents pertaining to the PKTT team's travel to the Western Cape to arrest Mr Fadiel Adams ... It is signed by Advocate Manilall.”

ADV Johnson identifies members of his investigation team responsible for briefings, including Advocate Ramsamy, Advocate Manilall, Mr Perumal, Mr Padayachee, Mr Mlambo, Mr Charles Eals, and Mr Tlale (project manager).

“It would have been Advocate Ramsamy ... Advocate Manilall ... Mr Perumal, Mr Padayachee, Mr Mlambo, Mr Charles Eals, and Mr Tlale ... as the project manager, from time to time being in those briefings.”

Mr Manilall was the Deputy Director of Public Prosecutions leading all the teams at the start of the matter.

“Mr Manilall, who is, as I indicated yesterday, Chair, all the teams are led by Deputy Directors of Public Prosecutions, and that would have been Mr Manilall.”

Because Mr Manilall was busy with the Transnet matter in court, Advocate Peter Serunye, a Deputy Director of Public Prosecutions (DDPP), accompanied the prosecutors to court on an informal basis.

“because Mr Manilall was busy in court, I think with the Transnet matter, on an informal basis, we did have Advocate Peter Serunye, who would accompany the prosecutors to court”

Mr Manilall is a Deputy Director of Public Prosecutions (DDPP).

“He is a DDPP, yes, ma'am.”

Advocate Manilall, Ramsamy, Hlatshwayo, Perumal, Padayachee, Wessels, Mlambo, Eals, and Mbalo were part of the investigation team at different stages.

“It is on my document that it is Manilall, Ramsamy, Hlatshwayo, Perumal, Padayachee, Wessels, Mr Mlambo, Mr Eals, and Mr Mbalo.”

Mr Manilall together with Mr Sesoko and Advocate Johnson review documents before passing to the team leader for decision making on section 27 affidavit distribution.

“once the document is after Mr Sesoko and myself have gone through it and we decide falls within the mandate, we give it to the team leader ...”

Decisions on whether an investigator such as Colonel Padayachee will have the section 27 affidavit is made by the team leader, identified as Mr Manilall.

“who decides that Colonel Padayachee as the lead investigator will or will not have the section 27 affidavit ... team leader here ... is Mr Manilall ...”
