Ad Hoc Committee

Mr Matlala appeared before the Parliamentary Ad Hoc Committee and there are recordings mentioning people who were referred to in that appearance; he will address whether he was induced or threatened to give false evidence in a supplementary affidavit.

“this is one of the things that will be in our supplementary affidavit. ... in the recordings there are people that are mentioned here, which have been mentioned in the Ad Hoc Committee”

In November 2025, Ms Ramsamy reported to DPCI that Advocate Johnson lied to the Ad Hoc Committee and provided proof.

“In November 2025, after Advocate Johnson testified at the Ad Hoc Committee, I contacted the same officer at the DPCI. I informed him that Advocate Johnson had lied to the Ad Hoc Committee and that I had proof of this.”

It is recalled that when Advocate Johnson appeared before the Ad Hoc Committee, he did not have the Section 27 affidavit but said he would provide it after his testimony.

“you did not have the section 27 affidavit when you appeared before Ad Hoc, and I think members of Parliament engaged you on the section 27 affidavit, and if memory serves me well, you parted company on the basis that you would be providing the Ad Hoc Committee with a copy after you had concluded your testimony”

Advocate Johnson invoked the issue of sub judice in her testimony before the Ad Hoc Committee and indicated she would not respond to certain questions on charges tied to Brigadier Mokwele's appointment because those matters are sub judice.

“I am unable to expand on ... those matters are in court and sub judice... I read it as to that question I would not respond ... in the Ad Hoc Committee ... issues relating to Brigadier Mokwele’s appointment and the subsequent charging of the five or six people involved”

Advocates Johnson and Khumalo testified in the Ad Hoc Committee late last year in relation to the same issues.

“you testified in the Ad Hoc Committee sometime late last year? That is correct, sir. And you testified in relation to the same issue? Yes”

Advocate Khumalo states it would be unusual for Advocate Johnson to be comfortable answering subjudice issues before the Ad Hoc Committee but not now before this Commission due to the change in the nature of the forum and applicable powers.

“The attitude to the same questions would change. I would find that strange, because the same risk would arise if you answered these questions before the Ad Hoc Committee.”

Following the media briefing by General Mkhwanazi, an Ad Hoc Committee was established in Parliament to examine the matters discussed.

The Ad Hoc Committee relied on investigative material compiled by the police and documents from witnesses' statements and whistleblowers to conduct its work.

“the committee relied upon the investigative material compiled by the police, as well as a document compiled by the witnesses' statements submitted by Evidence Leader and whistleblowers.”

The Ad Hoc Committee does not possess extensive independent investigative resources and therefore relies on material provided to it using analytic rigor to connect relevant facts and evidence.

Mr Shongwe, alias Thulani, confirmed that the evidence he wishes to speak to relates to incidents following the questions he raised in the Ad Hoc Committee concerning allegations against Major General Feroz Khan.

“the evidence that you want to speak today is what followed, incidents that followed the questions that you raised in the Ad Hoc Committee.”

The witness was prompted by the Ad Hoc Committee not to summon General Khan, with political shielding of President Ramaphosa by the ANC and reluctance to summon General Khan despite serious allegations.

“Certain members of the Ad Hoc Committee did not see the necessity of summoning General Khan for questioning ... In the case of President Ramaphosa, I understood from the political standpoint that he would be likely be shielded by ... ANC. However, with respect to General Khan, I could not understand the reluctance to call him before the committee, particularly the weight and seriousness of allegations that had been formulated and tabled against him.”

Mrs Hongwemp has no clear recollection of the 10 March 2026 call and possibly dropped it due to being busy with Ad Hoc work; she did not consent to engage further in the call.

“I do not have a clear recollection of yona lento le (this thing)... if I am busy maybe with Ad Hoc I will pick up and say, hey I am busy, I will call you... I am not agreeing to it, but I do not remember it only.”

Mrs Hongwemp did not report the matter to the Ad Hoc Committee but spoke about it during questioning of General Masemola.

“I did not, I would not use the word report it. But when I went to the committee on that day, I spoke about it when I was questioning General Masemola.”

Mrs. Shongwe expressed that the assistance expected from the Ad Hoc Committee in investigating matters like the alleged cigarette factory and drugs issue is very limited and poor.

“The level of assistance we are supposed to get or I think we should be getting in the Ad Hoc Committee, is zero. Because this matter, it is only here that I am speaking about this matter.”

Mrs. Hongwe P states that she was never asked about the matter related to Cat Matlala and drugs during the Ad Hoc Committee discussions, and she saw the incident on TV before informing her family.

“even that matter , I was never asked ... I saw it on the news on Friday , then I informed my family . But in the Ad Hoc , we have never spoken about this”

Mrs. Hongwe P asserts that the Madlanga Commission is the only body that has spoken to her about the matter regarding the call and offer from General Khan, and that she deemed mentioning it in the Ad Hoc Committee sufficient, feeling protected by laws and the committee.

“It is only the Madlanga Commission that has spoken to me about this matter , apart from my political party . And in my thinking , I think mentioning it there in the Ad Hoc , for me it was enough . I did not even see a need to open a case or do anything further because that space , I think it is a protected space . We are governed by certain laws there . We are protected by certain laws .”

Mrs. Hongwe P expresses cautious optimism about the Madlanga Commission's work and hopes for meaningful crime fighting in South Africa, contrasting it with earlier commissions like the Zondo Commission.

“I appreciate the level of the Madlanga Commission work ... I was seeing a Zondo Commission 2 ... it was not going where we wanted to ... But when we as the MKP members in the Ad Hoc changed the notch , people in South Africa focused so , so much in the Ad Hoc until something changed here . ... I appreciate you guys for being fair and honest ... The South Africans are seeing that exactly as I see it ... I hope we work together in fighting this crime in South Africa ...”

The statement was obtained by Robert McBride and filed with the Ad Hoc Committee, which called witnesses but did not call Mr. Khuba as a witness.

“Robert McBride obtained this statement and tried to persuade the Ad Hoc Committee to call Mr Khuba as a witness, but they did not”

The Ad Hoc Committee did not obtain the statement; Robert McBride obtained it and produced it quickly with limited detail before his appearance at the committee.

“My understanding is that Robert McBride obtained the statement and that when he obtained it, with all due respect, he did not spend long enough cobbling it together. It could have contained a lot more detail and this was a quick rush job done before his appearance at the Ad Hoc Committee”

General Sibiya was not moved until General Khumalo testified at the Ad-Hoc Committee, after which he was moved and suspended.

“I was not moved anywhere until General Khumalo testified at the Ad-Hoc Committee. Then... I got the letter to be moved somewhere. And then after that I got the letter of suspension.”

There is a team wanting to make sure those not toeing the line are gotten rid of.

“There is a team there wanting to make sure that those who are not toeing the line with us, we get rid of them.”
