There was a conversation between Mr Nku and Chief Mashaba on 25 June 2021 regarding keys related to a car and an office.

Mr Nku confirmed there was a WhatsApp request from someone named Iby to Chief Mashaba to get keys related to a car that belonged to a person who was in hospital.
“there was a request ... on my WhatsApp's directly from Iby to request that Chief Mashaba get him the keys ... relating to a car which had office keys ... the person to whom those keys belonged was in hospital”
VJ is also involved with Chief Mashaba and doing operations associated with Iby.

Mr Nku intended to use his contacts within Transnet and the broader logistics environment to identify, trace and monitor the movement of the shipment and to have Chief Mashaba coordinate or facilitate operational aspects of retrieval or interception before operational steps were taken.

“Chief Mashaba on occasions when he required money would interact. He would contact me to enquire whether I had access to information concerning illegal activities from which he might benefit either through a portion of what was recovered or through exerting pressure on the persons involved”
Mr Nku sought assistance from Mr Zama Khuzwayo within Transnet to obtain tracking information about a shipment arriving in South Africa; this was necessary before operational steps could be taken.
“I enlisted Chief Mashaba to assist with the request communicated to me by Mr Mphatswe Ngibi. Before any operational steps could be taken, it was necessary for me to confirm the existence of the shipment and establish its movement once it arrived in South Africa. For that purpose, I travelled to Durban. My intention in travelling to Durban was to approach an acquaintance of mine within Transnet, Mr Zama Khuzwayo, so that he could assist in retrieving the relevant tracking information relating to the shipment”
Mr Nku's mandate was to ensure the consignment did not reach its rightful owner, consistent with what Chief Mashaba would have done if he made the bust; he maintained neutrality.
“Commissioners, my mandate was that this consignment does not reach its rightful owner. That is what Chief Mashaba would have done as long as he makes the bust. I would have remained neutral.”
Mr Nku stated that his view of Chief Mashaba was that Chief Mashaba could take a portion of the consignment and also claim victory for the bust, but he would remain neutral, his mission being to prevent the consignment from reaching its competitor.
“My view of Chief Mashaba was that he could take a portion of consignment and simultaneously claim victory for the bust. Whichever way, I was neutral, my mission would have been achieved, preventing the consignment from reaching its competitor. This view is informed by previous incidents and experiences I have observed regarding Chief Mashaba.”
Mr Nku states that his role was neutral and aimed at preventing a consignment from reaching its competitor, informed by previous incidents regarding Chief Mashaba.
“I was neutral as my mission would have been achieved, preventing the consignment from reaching its competitor... This view is informed by previous incidents and experiences I have observed regarding Chief Mashaba.”
Chief Mashaba was supposed to organize law enforcement to arrive at the 'Yellow Jersey' location at 6:30 am to confiscate drugs, but there was no reason to pay him cash for this assistance.
“Chief Mashaba was supposed to organise law enforcement and they were to arrive at Yellow Jersey at 6 . 3 0 in the morning and law enforcement confiscated all these drugs, what was going to be the benefit for him to wake up at 5 . 0 0 in the morning to be there at 6 . 3 0 for something that SAPS or DPCI was going to take and claim credit ? ... There would not have been any reason , because , hence I say , in my experience , in my past experiences , there have been instances I have given information and then things comes short . So I would not have had any need to pay him . I stayed there , hence I maintained that I was neutral . My number one objective was to make sure that there is a bust , it is a recorded bust.”
Mr Nku mainly exchanged information with Chief Mashaba within the law enforcement service before advising General Mfazi.
“I have mainly done or sent information or exchanged information with Chief Mashaba, or let me say Mr Mashaba”
MR NKU states that the need for General Mfazi arose due to the unreliability of Chief Mashaba.
“Because of the unreliability of Chief Mashaba, Chair.”
MR NKU was informed on the evening of 8 July 2021 about the Yellow Jersey truck traveling at record time towards Johannesburg, implying it did not stop at weighbridges as mandated.
“I informed Chief Mashaba of the information on or about the 8th of July 021 around about 7.30... the Yellow Jersey truck which was carrying the container in question had been travelling in record time towards Johannesburg... the truck did not stop at the weighbridges in its path to Radiokop... I would deem that as record time because it is mandatory for a truck to stop.”
MR NKU was in Durban when he informed Chief Mashaba of the Yellow Jersey truck developments at 7:30 pm, relying on sources at the destination rather than direct contact with the driver.
“Around about this time, I was in Durban... So I had my sources relaying the information... No, the driver, I never had any contact with the driver... So the sources would be at the destination and information relayed while I was still in Durban...”
Chief Mashaba instructed MR NKU to get out of his vehicle and introduced Warrant Officer Mogana, briefing him on the information; they proceeded to inspect the truck carrying the container in Aeroton.
“Chief Mashaba instructed me to get out of the vehicle. He introduced the gentleman who was driving alone as Warrant Officer Mogana. I also briefed him on the information and they proceeded to drive towards the depot... then they returned and indicated that they will inspect the truck in Aeroton.”
Warrant Officer Mogana, Chief Mashaba, Booysens officers, and members of the Flying Squad and Dog Unit were present at the scene involving the loading of bags into an NP300 vehicle and engaged in cordoning the area.
“Warrant Officer Mogana fetched his car and parked alongside the truck. Then I saw the bags being loaded onto the NP300 vehicle... Warrant Officer Mogana along with one of the Booysens officers cordoned from one end of the trailer which was carrying a container then to the other where the truck was parked.”
The individual who gave Chief Mashaba information was filming with a phone and was arrested without a reason provided at the scene by General Feroz Khan, who ordered the arrest immediately.
“I told him that I was the source and that I was the one who gave Chief Mashaba the information. He immediately instructed for Captain Cronje to be called and that I must be arrested... No reason for my arrest was provided to me at the scene despite my enquiries.”
Warrant Officer Mogana and Chief Mashaba had no business loading bags behind the NP 300 bakkie and should have protected the informant's identity.
“Warrant Officer Mogana and Chief Mashaba had no business loading those bags behind the NP 300 bakkie and they should have protected my identity as the informant”
Mr Nku received information in or about April 2021 from a known gentleman relating to an individual allegedly a key figure in kidnapping activities around the country; he forwarded this information to Chief Mashaba and commenced his own intelligence gathering efforts.
“In or about April 2021, I received information from a gentleman whom I knew... He provided me with information relating to a particular individual who was allegedly a key figure in kidnapping activities around the country... Upon receiving the individual's details, I immediately forwarded the information to Chief Mashaba and requested that he assist in investigating the matter. Simultaneously, I commenced my own reconnaissance and intelligence-gathering efforts regarding the individual concerned.”
Most of the intelligence Mr Nku provided was given to Chief Mashaba, not to other law enforcement agencies in plural.
“Most of the information that I have provided was provided to Chief Mashaba.”
Mr Nku did not refer solely to Chief Mashaba in providing intelligence but gained acquaintance with a DPCI member, Captain Dale Nortje, who was part of the arresting team and started providing information directly to DPCI members.
“Subsequent to the arrest ... I had gained the acquaintance of a DPCI member ... It was Captain Dale Nortje ... He was in the arresting team ... I started providing the information directly”
ADV Mosikili submitted that a nickname of a person referenced in Mr Nku's statement should not be redacted as it is relevant and has been mentioned by other witnesses including Chief Mashaba and Colonel Sebola.
“my submission would be that that name , first of all , is quite relevant and connects the dots . And without any reasons being given why that name should not be mentioned , we should not protect the name without any basis . ... it is out there in the public any way , the nickname that I seek to refer to .”
Mr Nku considered himself a confidential source rather than having a formal handler-informer relationship with SAPS members like Lieutenant General Mfazi or Chief Mashaba.
“I regarded myself as his confidential source, not the handler-informer relationship. ... knowing that he is not a SAPS member, in the context of SAPS, I do not think that that would be the case.”
The witness was instructed by Chief Mashaba to follow law enforcement officers during the drug bust, despite their initial expectation to only point out the location.
“...I w a s o f t h e i m p r e s s i o n t h a t a n o p e r a t i o n w a s g o i n g t o b e c o n d u c t e d a t Ye l l o w J e r s e y. H o w e v e r, a d e c i s i o n w a s t a k e n a n d I w o u l d d e e m m y s e l f a b y s t a n d e r t o t h a t d e c i s i o n b e c a u s e u p o n C h i e f M a s h a b a ' s r e t u r n w i t h Wa r r a n t O ff i c e r M a g a n e , I w a s i n s t r u c t e d t o f o l l o w b y C h i e f M a s h a b a ...”
The witness asserted that although they provided information leading to the drug bust and are recognized as a good source by Chief Mashaba, the reason for physically accompanying police to the property and parking remains unexplained by them.
“... Chief Mashaba knows that you have provided the information to him, if he is the correct person that you are seeking to impress. The questions still remains, why are you there on the day ... Why are you going with them to Scania? Why are you getting to the property? Why do you park? Why are you taking pictures? What is your interest?”
Mr Nku said that even without an instruction to go with the police, he would still have gone out of curiosity to see that the drugs end up in the right hands (the police).
“even if Chief Mashaba had not , you say he instructed you to come , even if he had not instructed you to go with , you would still have gone ? Because you are curious and you want to see that this ends up in the right hands , the right hands being the police .”
Mr Nku says that if Chief Mashaba had not instructed him to tag along, he would not have done so, as he does not know law enforcement protocols.
“I do not think I would have tagged along because I do not know the protocols of law enforcement , what is required . So , him giving that instruction , in my mind it was okay , it is okay , you can tag along .”
Advocate Baloyi accused Chief Mashaba of being untruthful when he said Mr Nku asked to join the police.
“So he was not on your account , Chief Mashaba was not truthful when he said you asked .”
Mr Nku accuses Chief Mashaba of being untruthful; Mr Nku did not ask to tag along.
“He was being untruthful . I did not ask to tag along .”
Chief Mashaba asked Mr Nku to come along and stay in the car without participating in searching the truck.
“He says : " ... Can I come with you guys ? ... The only thing I said to him , please make sure you sit in your car and you do not participate ."”
Mr Nku provided information about Yellow Jersey Logistics to Chief Mashaba; the decision to move the scene elsewhere was made without Mr Nku's presence.
“The sin that I provided was Yellow Jersey Logistics . That is the sin that I provided to Chief Mashaba . That is why all the relevant information was given to the two . It relates to Yellow Jersey Logistics . To move the sin elsewhere , it is a decision taken in my absence .”
Mr Nku requested to leave the scene at Aeroton before the arrival of Warrant Officer Phakula, and asked Chief Mashaba to leave as well, citing waiting for the Crime Scene Manager who might have questions for Chief Mashaba.
“I requested to leave . I requested Chief Mashaba to leave . And the reason provided was wait for the Crime Scene Manager, he might have questions for you .”
Advocate Mosikili accuses Mr Nku of tailoring his evidence regarding his alleged wanting to leave and being present at a scene, presenting new evidence inconsistent with prior witness statements and his own earlier statements.
“You see, that is my difficulty with your testimony all along, is that you tailor evidence as you go by. None of the witnesses who came to testify, not Chief Mashaba, said anything about you leaving. You have provided three statements. None of those statements mentioned you ever wanting to leave. It is now that you are cornered as to why you insisted on being there. You are being faced with black and white evidence as to why you insisted on being there. Now you are giving us completely new evidence that, in fact, at some stage, you wanted to be relinquished. And I put it to you, that is a typical case of tailoring evidence as you go and that is highly unsustainable because it is not supported by the true facts.”
Mr Nku asserts that he made a call to Chief Mashaba while at the scene, requesting something though the exact nature is not specified in the excerpt.
“I made a call to him while we were at the scene. While I was sitting in my car, if my memory serves me well, I did make a call to Chief Mashaba to make such a request.”
Advocate Baloyi challenges the logic of Chief Mashaba instructing Mr Nku to come to the scene, arguing it served no purpose since Mr Nku was to remain in his car and had already provided vehicle details.
“You may have made that kind of call, but I think the point is, it does not make sense that Chief Mashaba would invite you to go to the scene or to use your language, instruct you, because you serve no purpose ... You have given them the details of the vehicle, you can see it, there is the truck with the container ... So it does not make sense that he would instruct you to come with ...”
Mr Nku assumed from the time of leaving Yellow Jersey Logistics, that Chief Mashaba might have wanted him at the scene to act as crime scene manager, which prevented him from leaving earlier.
“From the initial point of leaving Yellow Jersey Logistics, I assume after the fact that maybe the reason why Chief Mashaba might have wanted me was for this crime scene manager, because that is what stopped me from leaving.”
Mr Nku called Chief Mashaba at the last moment because someone else was supposed to assemble a team to run the operation.
“The reason why I called Chief Mashaba, amongst other things, at the last moment, hence I said because someone else was supposed to assemble a team to run the operation.”
Mr Nku testifies that he did not instruct Chief Mashaba not to share information about the drugs with senior members of law enforcement, but warned him only to be careful to whom he disseminated information.
“I do not deny that. What I deny is instructing, or I would say giving him an instruction of not involving high-ranking officials while at the back of my mind, I knew that there had been an operation that was conducted through a high-ranking official ... So the warning was limited to be careful who you disseminate the information to because I knew in my mind that there is already rapport with him and the Provincial Commissioner at the time.”
Advocate Baloyi suggests that if Mr Nku said he warned Chief Mashaba not to share drug information with senior officials because of their interest, that would be incorrect or a lie.
“So if he said to us that you warned or cautioned him not to share the information with senior officials because they have an interest in these drugs, that would be incorrect? You did not say that to him?”
Mr Nku confirms that if Chief Mashaba said he was warned not to share drug information with senior officials, he must have misunderstood him; Mr Nku denies instructing such a restriction.
“He would have misunderstood me ... So, I do not deny that ... What I deny is instructing ... I would say giving him an instruction of not involving high-ranking officials ... He would have misunderstood me.”
Advocate Baloyi suggests Chief Mashaba was either dishonest about what Mr Nku said or misunderstood Mr Nku's communication.
“Or he would have been dishonest with us. Either he misunderstood you in what you conveyed, or he in fact understood you and lied to us to say that is what you said. Either or. It could be anyone of the two.”
Mr Nku met with Chief Mashaba at a filling station and drove with him towards Yellow Jersey, parking at a distant company, while Warrant Officer Magane came later.
“I met with Chief Mashaba elsewhere. I believe it was at the filling station. So him and I drove towards Yellow Jersey... I parked at a distant company... then from there, that is when Warrant Officer Magane came”
Warrant Officer Magane's statement says he found Mr Nku at Yellow Jersey, implying Mr Nku and Chief Mashaba drove from elsewhere to Yellow Jersey together.
“Warrant Officer Magane says he found you there... it may well be that you and Mashaba drove from somewhere else to there”
Mr Nku admits he did not leave the vicinity during the operations because he wanted to verify information due to mistrust in Chief Mashaba, stemming from previous experience of unreliability in information sharing.
“for me to leave without verifying ... not fully trusting Chief Mashaba ... I wanted to verify... I was forced to stay”
Mr Nku confirms he was instructed to leave, but his reasons for staying behind were not a result of that instruction, rather personal choice based on lack of trust in Chief Mashaba and wanting to verify information.
“My reasons for leaving was as a result of that instruction ... some reasons for staying was not as a result of an instruction”
Mr. Nku was certain he could have built instant rapport with the person supposed to conduct the operation, given that person's pedigree.
“considering the pedigree of the person who was supposed to have conducted the operation, I was certain that you would have instantly built rapport”
Chief Mashaba informed Mr. Nku that informants would get 1.5% of a major success, usually in the form of an offer.
“I think the Chief Mashaba had to told me that informants would get 1.5% of a major success if it is in the form of offer”
Mr. Nku started giving information to Chief Mashaba in 2019.
“Got to know Chief Mashaba in 2019 ... did you start giving him information from 2019? Indeed, Chair.”
Mr. Nku had repeated engagements with Chief Mashaba about being accepted as an informant, but these engagements felt like a perpetual 'come-back-tomorrow' scenario.
“We have had those engagements, Chair. We have had those engagements. Though I felt that it was always a come-back-tomorrow story.”
Mr. Nku did not know at the time that Chief Mashaba could not himself accept informants but later realized this.
“No, I did not know ... Ja, I did not know ... No, I see this in the light of what I know now”
Mr Nku gave preliminary information to Chief Mashaba but not detailed truck information initially.
“I gave the preliminary information , albeit not the truck details , but I gave Chief Mashaba the information .”
Mr Nku trailed the truck carrying a container of interest all the way to Johannesburg instead of relaying the information earlier to Chief Mashaba to act on it.
“Instead you trailed this truck all the way to Johannesburg . Explain that , which does not make sense .”
Chief Mashaba did not have full information about the truck's travel pattern or that it did not stop at weighbridges when he first spoke to Mr Nku; someone else was providing Mr Nku with this information.
“Chief Mashaba said he'd did not have full information when he had the first conversation with you...So it could not have been your source on the 8th that the truck has arrived in Johannesburg...So someone else told you this truck did not stop at weighbridges...Chief Mashaba could not tell you that it did not stop at weighbridges. He knows nothing about it.”
Mr Nku had previously transferred funds to Chief Mashaba before 9 July 2021 and had the means to make further payments on that date if necessary.
“...you have made payments to Mr Mashaba before, or Chief Mashaba before... ...on the 9th of July 2021, you had the means to make further payment to him...”
Mr Nku denies having paid Mr Mashaba but admits to lending him money and transferring funds towards him previously.
“I have not paid him. I would say I have lended [sic] money. I have not paid him.”
Chief Mashaba proceeded quietly with the operation without informing his superiors due to the sensitivity involving senior officials interested in the matter.
“you proceeded , you did not inform your superiors , you proceeded quietly the way that you did”
Chief Mashaba did not inform Phokungwane that the operation involved drugs or that it was sensitive, but only asked for assistance without revealing details.
“But when you ask Phokungwane for assistance , you do not tell him that the operation involves drugs , even that , or even if you do not mention drugs , you do not say to him , this is a sensitive operation”
Incoming voice (unattributed) asserts it is contradictory to act sensitively about the operation initially but not alert those asked for assistance about the sensitivity.
“how do you reconcile that you started off quite sensitive about who gets to know about this mission , and then when you now ask for assistance , you do not alert the person you are asking for assistance from , that this is sensitive because of A , B , C , D , so if you give me anyone to help me , it has to be somebody that can , that you know is not compromised”
Chief Mashaba told Phokungwane to treat the request discreetly as the operation was sensitive, and Phokungwane said he could not help but would direct someone else.
“Please treat this very discrete . It is sensitive . Come and assist . No , I cannot come because I have got this problem .”
Chief Mashaba explained to Adv Baloyi SC that he asked Phokungwane for someone in the area familiar with drug busts because Phokungwane would know a suitable person.
“I wanted somebody in the area . Number two , I know , even if Phokungwane knows she cannot do , I know he will knows somebody that can do .”
Chief Mashaba engaged in an interception and search operation of a truck in his jurisdiction without informing the Alberton Police Station due to the sensitivity and risk of compromising the operation.
“I might go there and it leaves .”
Chief Mashaba chose not to inform the Alberton Police Station about the search operation to avoid compromising the operation and because of the urgency and safety considerations.
“I do not want people who may compromise the operation to compromise it , just so that it is recorded in the books of the police and at the very least , there is an entry or an enquiry dealing with the operation that you were about to carry out that day.”
Chief Mashaba admitted that even though Nku was at the operation location to monitor the truck, he deliberately did not want to inform the local police of the operation plans due to sensitivity.
“I am being careful also as to who do I involve .”
Chief Mashaba acknowledged that not informing the Alberton Police Station was a deliberate decision to maintain operational security, despite the close proximity to the station.
“So you did not want Alberton Police Station to know that you were engaging in this operation ? No necessarily that I did not want to know .”
Chief Mashaba clarified that the operation had not started and that the distance between his residence, operation site, and Alberton Police Station is short, implying there was opportunity to inform but he chose not to.
“The operation has not started . You are at your house in the Alberton area ... Nothing stops you in 5 minutes to go to the Alberton Police Station and to say I am a Traffic Officer ...”
Chief Mashaba stated that the Station Commander might be someone he deliberately did not make aware of the operation due to sensitivity.
“The police , the Station Commander is also senior , so he might be one of the people that I might not make aware .”
Chief Mashaba confirmed that he was aware of the Gauteng Provincial Roads and Road Traffic Act 10 of 1997, which regulates the powers and duties of Traffic Officers.
“I am familiar with it .”
Chief Mashaba admitted that the Road Traffic Act does not authorize Traffic Officers to go to private premises such as warehouses to conduct searches and seizures.
“Now is there anywhere in that section where it says a Traffic Officer can go to private premises of a business and conduct a search and seizure operation ? No .”
Chief Mashaba asserts that once he involves the police, he steps back and plays a supporting role, leaving the police to take lead in operations.
“I would not want, I leave it to the police and I give it, they know what to do.”
Chief Mashaba states that in joint operations with the police, protocol dictates that police take the lead and he plays a supporting role, but he becomes busy with the suspects once drugs are secured.
“In the police, protocol dictates that police takes the lead. I will be playing a supporting role. Whatever he does, especially if he concentrates on what we are talking about now, I become busy with the suspects.”
Advocate Segeels-Ncube claims that Chief Mashaba wanted to arrest Ms Wentzel despite Magane being present, implying Mashaba did not simply leave everything to the police as he claims.
“But you did not do that. You had Magane there, but you wanted to arrest Ms Wentzel.”
Chief Mashaba admits that once he has involved the police, he leaves everything to them, acknowledging they know what to do and who to call.
“Once I involve the police, I might have maybe a big mouth standing there, but I leave everything to the police. They know who to call, what to do.”
Chief Mashaba confirms that Magane was in charge of the operation at the scene where the container was opened and seized.
“He is in charge, yes.”
Chief Mashaba explains that being in charge of an operation means taking accountability and control of the scene, but also notes he cannot command police resources and they take the lead in joint operations.
“You take accountability, you take control of the scene. ... In the police, you do not command somebody's resources. And when we are jointly working in an operation, they take the lead.”
Chief Mashaba claims that he can arrest a person independently at the scene if there is reasonable suspicion and does not need permission from Magane though Magane was in charge.
“Arresting, I do not need his permission. I can still do if there is that reasonable suspicion.”
Chief Mashaba admits that he does not have training or knowledge about the processes and prescriptions for opening and searching containers, nor has he seen any documents governing those procedures used by Traffic Police as of July 2021.

“Because the PCI is captured, you made the decision that you do not want to involve them ... DPCl, okay, me knowing not all obviously it cannot be a blanket statement to all. Most of them we know it is a no-no.”
Chief Mashaba claims there is a Memorandum of Understanding (MOU) related to operations but does not clarify or identify any document governing searches by Traffic Police in 2021, and admits lack of knowledge on prescribed processes for opening containers and handling seals during searches.

Chief Mashaba was expected to call the police during the operation, but he called somebody to tag along instead to legitimize their actions since Magane was not in charge.
“What you called was somebody to tag along with you. What you called was somebody from Zonkizizwe to tag along with you, to legitimize what you were doing, because Magane was not in charge of this operation. He was following your lead.”
Chief Mashaba said even his commanders are not to be trusted for sensitive operations due to risk of interference or compromise.

Chief Mashaba trusts Warrant Officer Phokwane with sensitive missions because they are neighbours and have a close working relationship.
“Phokwane, I can say he also stays in my neighbourhood”
Chief Mashaba has worked in past operations with Warrant Officer Phokwane and knows him better than others.

Chief Mashaba admitted he does not know if Phokwane shares his suspicion of superiors and trust in secrecy for sensitive operations.

Chief Mashaba stated his trust in Phokwane is built by knowing him personally and professionally over time in their neighbourhood.

Chief Mashaba does not dispute referring to an ANC election rally in his message to Mr Nku.
“You do not dispute that you were referring to an ANC election rally, correct, in this message that you sent to Mr Nku ?”
Chief Mashaba accepts that the WhatsApp reference to 'DD' is to Deputy President David Mabuza.
“The person I was referring to ? ... I will have to accept ...”
Chief Mashaba did not recall details of the conversation about someone not being allowed on a flight from Amsterdam, denying any frequent discussions with Mr Nku about such matters.
“No, I have got no recollection of this... I cannot remember... No, we did not have... this is the only exchange.”
The Chairperson accused Chief Mashaba of being untruthful about his lack of recall regarding WhatsApp chats proving a long existing relationship and exchanges with Mr Nku.
“Honestly, you are being untruthful... You are untruthful because you see that all these chats between you and Mr Nku ... show a picture that is totally different to what you told us... You are trying to extricate yourself...”
Chief Mashaba knew what Mr Nku was talking about in the WhatsApp communication regarding postponing preparations and gave a thumbs-up to the message.
“You do a thumbs-up in your next message, in your response in that white box. You do a thumbs-up. This reflects you knew what he is talking about.”
Chief Mashaba accepts that his thumbs-up response to Mr Nku's forwarded communication means he was part of the communication circle about the person not coming from Amsterdam and postponing preparations.
“Yes, I agree. ... I agree. ... At that time, yes, even if I might have forgotten now. ... Yes, at that time it means yes, I was.”
The exchange between Iby Boss, Boss Iby and Mr Nku about the person not being let on the flight from Amsterdam was forwarded to Chief Mashaba by Mr Nku, and Chief Mashaba was part of the communication circle regarding this matter.
“The exchanges between Iby, Boss Iby and Mr Nku at page 264 about this person not being led onto the flight from Amsterdam is not coming, that it is forwarded to you by Mr Nku as we see at page 120, and your response is a thumbs up, must mean that you were part of whatever communication was happening between Mr Nku and Boss Iby, Iby Boss.”
Chief Mashaba acknowledges that according to the WhatsApp conversation dated 29 June 2021, he was part of a plan that needed to be postponed because the person was not coming from Amsterdam.
“Yes, according to this, it says obviously I am part of it.”
WhatsApp messages from 29 June 2021 between Chief Mashaba, Mr Nku, and Iby Boss show discussions about keys, a phone being off, and references to legal issues involving General Mashaba.
“Mate, he will not give me the keys or the phone. He says legally, he cannot. He put up a big stink about General Mashaba. Also, he said it was a silver X5 with two white guys. They have footage, but it is not clear...”
Chief Mashaba was communicating with Mr. Nku about a car key, suggesting involvement of an investigating officer and a vehicle, and intended to ask the investigating officer about the key.

Mr Nku and Iby Boss (Alpha) were involved in a transaction regarding car keys with an investigating officer, and Chief Mashaba attempted to influence the investigating officer to release an exhibit (the key) at Mr Nku's behest.
“The picture that it creates is you, Mr Nku, and Boss Iby or Iby Boss, who is also referred to as Alpha, were involved in a transaction that included car keys that are with an investigating officer, possibly as an exhibit, that are with an investigating officer and you wanted that key to be released ... you are interfering and speaking to influence an investigating officer to release an exhibit ... you say I will speak to the investigating officer ... and you do so at the behest of Mr Nku.”
Chief Mashaba acknowledges that it is improper to speak to an investigating officer to release a key that is an exhibit, even if asked by his brother Mr Nku.
“Mr Nku be cause you are asking? Do you accept it would be improper to do that? - I accept. - Okay. - I accept.”
Chief Mashaba confirms he would not negotiate with the investigating officer to release an exhibit key if it would put the officer at risk or risk his job.
“but I will go and negotiate for something that I know I will be putting the IO at risk, or risking his job, to do something impossible for me. That I would not do.”
Chief Mashaba says he would try by all means to assist Mr Nku, whom he considers a brother, especially with police issues where Mr Nku seeks his assistance regarding difficult investigating officers.
“like taking Nku as my brother, if he needs assistance, I would try by all means to assist him because I know on many things he relies on me. Especially police issues, where he would say maybe, can you maybe assist ? I have got this problem , or I have got this , for instance , I have got this IO that is giving me difficulties . If it is possible , can you maybe try talk to him ?”
Chief Mashaba did not recall why he took a picture of a car key and sent it to Mr Nku, despite the key and the conversation being very specific and unusual.
“I cannot remember. Honestly, I cannot remember …”
Chief Mashaba said there is no danger about the car keys and the investigating officer in question.
“So you do not think there is any danger about … No, I mean, if maybe the Commission think I am hiding the car key, if I remember exactly, if you are talking the car key, it is not like you are talking a picture of maybe a bag of drugs or something.”
Chief Mashaba received a call from Mr Nku on the 8th of July confirming the truck with drugs from Durban to Johannesburg had arrived, but Mr Nku did not provide any new information other than the truck's arrival.
“Mr Nku called you and said to you that there is a truck with drugs coming from Durban to Johannesburg … on the 8th , you told him to confirm it positively, and he did so the morning of the 9th of July… He did not give you any new information other than to say the truck is now in Joburg.”
Chief Mashaba denies speaking to Mr Nku on 7 July 2021 despite Mr Nku's claim that he communicated knowledge of drugs in the shipment on that date.
“But on the 7th of July, he did not — we did not speak .”
Mr Nku told Chief Mashaba that the drugs were already in the truck by Thursday night 8 July 2021 and no longer just a suspicion but confirmed information.
“when he speaks to you on the 8th of July, Thursday the 8th of July, he already knew positively that the drugs were there . And I am suggesting to you that he told you the drugs are there already on Thursday night, not Friday morning. He knew positively because he says he knew on the 7th of July already.”
Chief Mashaba insists they did not speak on 7 July 2021, implying he did not receive prior confirmation of drugs before 8 July 2021.
“Like I am saying, we did not speak on the 7th, and that was his information . He said to me on the tht that I have got this information .”
Chief Mashaba admits he spoke to Mr Nku on 8 July 2021 and was informed about the shipment of drugs in the truck.
“Yes, correct . Correct, Chair.”
Chief Mashaba says that on Thursday (8 July 2021) he received information that the truck was from Durban and the shipment contained drugs, but he needed confirmation on Friday (9 July 2021).
“The information I got, it is from Thursday. The confirmation … That the truck is from Durban. With drugs . All I needed on Friday was a confirmation .”
Chief Mashaba says the confirmation he sought on Friday was that the truck had landed and was physically there, which for him constituted confirmation.
“He saying the truck is here, landed already and I am here, please come . To me, it is confirmation …”
Mr. Nkusa gave Chief Mashaba all the information considered sufficiently specific to warrant operational follow-up regarding the Yellow Jersey truck on the evening of 8 July 2021.
“he had given you all the information which for him was specific enough to commence the operation”
On 9 July 2021, Mr. Nkusa met with Chief Mashaba and provided a briefing, but did not call to give confirmation to activate the plan.
“on the morning of 9 July, I met with him and provided a briefing ... He does not say that on the 9th he called you to give you this information that you needed to activate the plan”
Chief Mashaba states he received a call on the morning of 9 July and was sent a location relating to the Yellow Jersey operation, contradicting Nkusa's claim that no such call happened.
“On the 9th, in the morning, he called and sent me location ... I did not even know that is Yellow Jersey ... He had to even send me a location .”
Chief Mashaba asserts that Nkusa called him on Friday morning and not only met with him in person on 9 July 2021.
“I am saying to the Commission he called on Friday. Friday morning.”
Chief Mashaba saw bags seized at Aeroton on 9 July 2021, which appear to be the same bags as those in the dated images on Nkusa's phone.
“you saw those bags on the 9th of July ... does that look like the same bags?”
Mr Nku gave Chief Mashaba sufficient information including photographs, details of the truck, and license plate to take lawful steps to seize drugs by 8 July.
“he had given you sufficient information in order to do the operation follow-up”
Chief Mashaba claims he did not have details of the truck such as license plate and destination and therefore needed more information to act.
“I need the details of the truck”
Chief Mashaba states Mr Nku did not give him full details including license plate prior to operations, contradicting Ms Segeels's assertion.

Chief Mashaba required confirmation of the truck landing and truck details before acting on information about drug transport from Durban to Johannesburg.
“That the truck has landed, and if it has landed, give me the number plate, the details of the truck. That is all I needed from him”
Chief Mashaba acknowledged that according to Mr Nku, a truck from Durban to Johannesburg was transporting drugs, but questioned how Mr Nku confirmed this information.
“There is a truck coming from Durban to Joburg transporting drugs ... I do not know how he confirms that”
Chief Mashaba expressed he was waiting for positive confirmation that the truck would land on Friday before proceeding with action.
“I am waiting for the confirmation to say it will land on Friday”
Chief Mashaba communicated that once he received confirmation of the truck landing and drugs in it, he would mobilize resources to seize.

Chief Mashaba's insistence that he should be told the truck was in Gauteng before going there does not make sense because he would have needed such positive confirmation to travel to an unknown location.

Chief Mashaba receives messages from Mr Nku containing number plates to check and is able to check vehicle ownership using a device as part of his duties.
“A message from Mr Nku ... he says: “Ask them to check this number plate.” ... you say thumbs up ... you are able to check”
Chief Mashaba acknowledges he can check number plates but claims not to recall specific instances or reasons for checking number plates given by Mr Nku.
“I know that I can check number plates . So , this I do not recall”
Chief Mashaba admits he can check number plates unofficially, for example, checking a car parked next to his yard even if off duty.

Chief Mashaba asserts that he cannot check number plates randomly or for personal reasons without a lawful basis or reasonable cause.

Checking number plates at the request of Mr Nku could not have happened in the course of Chief Mashaba's lawful official duties as a Traffic Officer because it was done for Mr Nku and not in discharge of official functions.

Chief Mashaba agrees that looking up vehicle registration details for Mr Nku, who is his funder, was not official police work but side hustle.

It is reasonable to conclude that checking number plates for Mr Nku was side hustle by Chief Mashaba in 2019 since there is no official or lawful explanation given for such checks.

Chief Mashaba denies controlling or agreeing with the conclusion that this is a side hustle with Mr Nku involving registration numbers.

Chief Mashaba denies knowing Sergeant Mataboge or having a personal relationship with him.
“I do not even remember. I do not know a Mataboge”
Adv Baloyi SC disputes Chief Mashaba's claim of not remembering Sergeant Mataboge, stating there is evidence of a meeting and communications between them involving Mr Nku.
“It is simply not true that you do not remember who he is and what it was about”
Chief Mashaba estimates that over the years Mr Nku has given him between R20,000 and R50,000, inclusive of payments into Shilobane Lodge company.
“It would not be more than R 50 000 ... It includes payment into Shilobane Lodge”
Chief Mashaba and Mr Nku planned an operation to intercept a truck on or about 9 July 2021 based on information and location details sent by Mr Nku.
“I met Mr Nku and he gave me a briefing on his information and the truck in question. After the briefing, I decided to engage the process of intercepting the truck and to have it searched”
Coordination of location coordinates was asserted to have been sent shortly after midnight on 9 July, but Chief Mashaba denies the timestamp of 22:25 on 8 July at which the coordinates were allegedly sent.
“you said he sent you the pin location”
Chief Mashaba disputes that the pin location was sent on the evening of 8 July at 10:25 PM, instead insists it was sent after 5 AM on 9 July morning.
“He sent me in the morning after 5 .”
Communication between Chief Mashaba and Nku on 8 and 9 July 2021 took place via Telegram app, including messages conveying the need to go to a stated location.
“you and Nku were communicating via Telegram , and according to this report, he sent you the location at 25 minutes past 10 on the 8th . And then just after midnight , before your conversation in the morning , just after midnight , you then opened the message .”
Chief Mashaba does not recall accessing the location message just after midnight on 9 July and says he was sleeping on the 8th.
“I was sleeping on the 8th .”
Chief Mashaba and Nku switched communication from WhatsApp to Telegram at some point, but Chief Mashaba does not know why and does not even remember using Telegram.
“I do not even remember we used Telegram .”
Chief Mashaba downloaded Telegram app but says he had no specific reason to switch from WhatsApp other than preference, denying he recalls the reason for moving to Telegram.
“No specific reason per se . If I am in WhatsApp and say let us switch , it would mean we are giving WhatsApp a break . Let us go to Telegram .”
Warrant Officer Phokungwana referred Chief Mashaba to Warrant Officer Magane early in the morning hours after 3:41 AM on 9 July 2021, as Phokungwana could not assist.
“Warrant Officer Phokungwana could not assist you and he referred you to Warrant Officer Magane .”
ADV BALOY SC alleges that Chief Mashaba already knew at 03:41 that assistance from Phokungwana and Magane was needed for an operation, contradicting Chief Mashaba's earlier evidence that he only knew in the morning after meeting Mr Nkuo on the 10th.
“at 03:41 already you had called Phokungwana to say I need assistance...your earlier evidence ...cannot be true”
Chief Mashaba denies knowing before the morning about needing assistance for the operation.

ADV BALOY SC challenges Chief Mashaba's denial and states there is evidence that Chief Mashaba had called Phokungwana at 03:41 saying he needed assistance, disproving Chief Mashaba's earlier evidence about timing of knowledge.

Chief Mashaba complains that he is being forced to accept a document's contents which he disputes and calls it a lie, demanding the authenticity be investigated.

ADV BALOY SC accuses Chief Mashaba of being untruthful and continuing to be untruthful about his engagement with Mr Nkuo on the day he operationalised the information.

Chief Mashaba denies having communication with Warrant Officer Magane after 5:00 or 7:00 on 9 July 2021; he confirms speaking to Magane only after 5:00.

Chief Mashaba disputes the timeline in a document showing communication with Warrant Officer Magane around 04:40 a.m. on 9 July 2021, arguing he received the number only after 5:00 a.m.

Chief Mashaba states he always refers matters outside his jurisdiction or area of responsibility to the police and does not act outside his powers in drug busts or seizures.

Advocate Baloyi suggests that operations known to Chief Mashaba, such as the airport operation, were conducted outside his jurisdiction and no police were called, questioning Chief Mashaba's claim that he always calls police when things are out of jurisdiction.

Chief Mashaba did not specify the specialties needed for the drug bust operation to Warrant Officer Phokungwane and only asked for assistance.

Chief Mashaba trusted Warrant Officer Phokungwane's recommendation even though he was warned by Mr Nkuwa to be cautious due to possible involvement of high-profile or high-ranking officials.

Chief Mashaba explained that in their line of work, if he is unavailable, people seek assistance from someone he trusts to do the job competently and not compromise the mission.

Chief Mashaba told Phokwane the mission was sensitive and expected him to keep it secret.

Chief Mashaba believes the Criminal Procedure Act grants him powers similar or equivalent to police powers including search, seizure and arrest.

Phakula was told to go to Alberton because the plan was to take the collected items there, but Chief Mashaba did not wait for Phakula before opening the container and arresting people.
“Phakula in fact says she went to Alberton because he was told that once you have collected what you were collecting, you will be taking it to Alberton... you had already opened the containers, you had already arrested people.”
Chief Mashaba said they did not know how long Phakula would take to arrive and were under the impression everything started and would end in Alberton.
“Well, we did not know how long will Phakula take to arrive... We were under the impression that because everything started in Alberton...Because everything started in Alberton, it will end in Alberton.”
Chief Mashaba admitted they were going to take the bags (seven in number) to the impound in Alberton, detain if necessary, and take the cargo to 13 in Alberton.
“We were going to detain, if need be, and take the cargo to 13 in Alberton... To 13 in Alberton, yes.”
Chief Mashaba called General Mawela first when he was placed under arrest, not any other police officers because of harassment and bullying of General Khan.
“The first person you called was General Mawela, right? ... Because of the harassment and the bullying of Khan, General Khan.”
Chief Mashaba distrusted many senior officers because they had interests in the case but trusted General Mawela since the operation was in progress and there was no risk of sabotage or disturbance to the operation's success.
“You do not trust all these senior officers ... but I think because the operation is in progress ... there will be no disturbances or sabotage for this to be a success.”
Despite the drugs being in full public view after the container was opened, Chief Mashaba did not mobilize other SAPS units or call the appropriate people, relying on Magane and others to know what to do.
“You do not call other SAPS ... You say we are under the impression Mr Magane ... will know what to do ... I left everything to Magane ... for him to say, I called Phakula ... then I know we are safe now because they are calling the relevant people.”
Chief Mashaba physically fought with General Khan on scene despite other SAPS officials taking charge who were appropriately qualified, raising questions why he fought with them.
“You fight with Khan when he comes there and takes charge ... other people are now there ... you and Magane are completely inappropriate for this operation ... Why do you fight when SAPS officials, appropriately qualified, come and take control of the scene?”
Chief Mashaba denied fighting but said General Khan was fighting them.
“I was not fighting. Khan was fighting us.”
Chief Mashaba alleges General Khan bullied the police officers on the scene by bypassing the first responders and approaching Scania personnel instead during a police operation.
“So Khan came, bullied us. Number one, every policeman that comes on the scene, you go straight to the first people, first responders on the scene. That did not happen. Instead, he went to, I can say, Scania people and we all are looking at that.”
Chief Mashaba claims General Khan commanded regard and salutes on the scene but then questioned traffic officer Magane in a demeaning way.
“Only when he comes nearer to us, I hear and see people saluting, yes, General, yes, General, yes, General. Then I started maybe becoming, I do not know what is the right word, when he started saying to Magane, who are you, where are you from, who is the driver of the bakkie, sitting your car.”
Chief Mashaba wanted to remove Sergeant Warrant Officer Magane from the vehicle, considering the conduct as bullying and abuse of power by General Khan.
“I wanted to take Magane out of the bakkie.”
The SAPS operation at the scene was under the control of a General, and Chief Mashaba questions why he was actively trying to remove Magane, who was believed to be under arrest.
“It is a SAPS operation. It is not a Traffic Department operation. It is a SAPS operation. You continue to, you want to continue to be active to a point of wanting to take Magane, who you think is under arrest, you want to take him out of that arrest which has been ordered by a General.”
Chief Mashaba confirms that Mr Nkua accompanied him from Yellow Jersey to Aeroton to avoid misunderstandings about information he provided to others.
“Mr Nkua asked me that will it be a problem for me to accompany you guys, because other informations that I gave to other people, I get to be told they were unsuccessful or I get to be told stories or excuses. Can I come with you guys? I said, I do not see this as a problem because I know I have worked with a lot of police that comes with their informers. The only thing I said to him, please make sure you sit in your car and you do not participate.”
Chief Mashaba denies knowledge that Mr Nkua took photographs at the scene during the operation.
“I am not aware.”
Chief Mashaba states that at Yellow Jersey Logistics, police officers were told they did not have necessary paperwork (such as search and seizure warrant) to access the container/truck, and to open the container at the client's premises instead.
“No, they said it, what if you open here and then we get in trouble with the client, rather preferably go and open it at the client.”
There are many bogus police officers operating, evidenced by their use of grey Golf 7 vehicles, lack of uniforms, and possession of fake police cards that look more authentic than originals.
“There is a lot of bogus cops operating. So they can see a Golf 7 that is grey. We are not in uniform. Even the cards, the bogus cards, they look more authentic than originals.”
Police officers presented themselves as Crime Intelligence officers to Jolene Wentzel at Scania, but Chief Mashaba denies having told them that they were from Crime Intelligence.
“They have introduced themselves as police officers from Crime Intelligence. ... No, people that want to defend themselves would say anything. So how do I say to a person, I am Crime Intelligence?”
Chief Mashaba admits placing people under arrest until cargo can be confirmed, and states K9 unit was on its way to assist.
“Remember, we, I place you under arrest until we confirm the cargo, hence, K9 was on its way.”
Chief Mashaba states drugs were secured as exhibits and asserts that he was not in possession in the legal sense when overseeing the handling of the drugs during the operation.
“It is securing exhibit.”
Chief Mashaba disputes that he introduced himself as Crime Intelligence during the operation and denies the allegation despite it being contemporaneous and from a statement by Jolene Wentzel.
“I cannot do that. ... I do not know why she said that because I did not say that.”
Advocate Segeels-Ncube alleges police acted under false pretences, creating the impression they were from Crime Intelligence when they were not.
“Well, you were there under false pretences because you created the impression that you were from Crime Intelligence.”
Advocate Baloyi SC challenges how Chief Mashaba could take instructions from Yellow Jersey managerial staff when he is conducting a law enforcement operation on their property involving narcotics.
“How do you take instructions from the Yellow Jersey people not to conduct an operation. Here you are in a lawful operation. Let us assume this is a lawful operation. How do you get told by the people that, according to you, at that point are in possession, because Yellow Jersey is in possession at that time, because this is their property.”
Chief Mashaba claims he was only "advised" by Yellow Jersey Manager and did not receive dictation on not to take action regarding the narcotics inside the truck which was Yellow Jersey property.
“It is not dictated upon, it is being advised. ... Because Yellow Jersey Manager also did not know what is inside.”
Advocate Baloyi SC accuses Chief Mashaba of negligence for not acting swiftly despite knowing drugs were in a truck parked and notifying police beforehand, implying missed opportunity to mobilize resources.
“You left your house knowing there is a truck that is parked that we are going to open because it has drugs in it. You knew that before you arrive on the scene. You had ample opportunity to mobilize resources.”
Chief Mashaba feels dismissed as his statements and footage obtained by Captain Sebola are not being considered, denying him a fair chance to explain the events of the scene.
“I do not know why do you crush or dismiss me when I say I become happy when we talk the scene, because we know that Sebola obtained a video of footage, we know. So I am being dismissed, the video of footage has been dismissed, and we know that is where the truth is. So whatever that will be asked about the scene, I will still be not listened to because I am also saying, please, can we get the video of footage. I am being dismissed, so ...”
Mr Nku was found with R60,000 in cash on the day in question but did not disclose this to Chief Mashaba, who was unaware of the amount or its purpose.
“Mr Nku was found with large amounts of hard cash on him on the day in question? ... R 60,000.00. Now, were you aware that he was carrying that amount of cash on the day? ... I was not aware. ... Did he tell you what that amount was for? ... No.”
Chief Mashaba advised that if someone requests not to open something and to escort it to the client first, this is to maintain the relationship between him and his client and prevent it from turning sour.
“I am advising that please, please, I am not saying do not open, but I am advising please escort it to the client, then you open so the client can see what is …”
Adv Baloyi SC suggested that Chief Mashaba did not operationalize at New Jersey and acted on the advice of suspects in possession of the Yellow Jersey truck, which led to aborted action at that location likely because he feared they did not trust him and might call the police on him.
“...that you did not operationalize this at New Jersey, you tell us you acted on advice of people who are suspects themselves. You acted on their advice. It does not make sense. And then I say, this is what it looks like, it looks like you aborted Yellow Jersey because you saw these people do not trust you, thought they will call the police on you, and you were hoping at the second location you will be able to take the drugs and do a quick get away, which I suggest you were doing with a black van.”
Chief Mashaba stated he would not comment on Adv Baloyi SC's suggestion that he aborted Yellow Jersey because of mistrust, saying he would not attempt to say Adv Baloyi SC was wrong.
“I would not even attempt saying you are wrong. I have learned to accept that. I do not think I will ever make sense to you, Commissioner, because ...”
Chief Mashaba was informed recently by Nku that General Mfazi died on 8 July 2021.
“I was told by Nku recently that he died, I think on the 8th of July.”
Nku intended to involve Chief Mashaba in offloading drugs from trucks, offering tips to execute a legitimate operation, but there is no confirmation Nku previously engaged General Mfazi who died 8 July 2021.
“He involves you in that you say he was giving you a tip off so that you could execute a legitimate operation. And really, we do not have anyone to confirm that he had previously engaged with General Mfazi because General Mfazi is no more about the same information that he gives you on the 8th of July 2021. Correct?”
On 9 July 2021 at 10:34, Director Pompi phoned Chief Mashaba, Acting Deputy Director in the Southern Corridor, to join a visit to all the K78 roadblocks to give support to officers, indicating an urgent matter he was attending to though he did not disclose details.
“On the 9th of July 2021 at 10:34 I phoned Mashaba as the Acting Deputy Director in the Southern Corridor to join my visit to all the K78 roadblock in our area to give support to our officers. He indicated to me that he has an urgent matter that he is attending to, but he did not mention the matter. I respected what he told me due to the nature of his meetings and operations...”
Chief Mashaba did not tell Director Pompi at 10:34 on 9 July 2021 about the massive drug bust he had just made and chose not to mention it during the call to join the visit to K78 roadblocks, despite it being a significant operational event.
“Why did not you at 10:34 when you received the call from the Director to join, that is, do you dispute that when the call was made it was to join you to visit the matter at the K78 roadblock?... This is not even you calling Director Pompi. Director Pompi is calling you to ask you to join on the road block... Why do not you mention it then? ... You have just made a significant drug bust, 700 kilograms. You do not see that when your boss calls you out to join on a roadblock that you say, listen, I have done something bigger here?”
Chief Mashaba said he was going to tell Director Pompi about the drug bust call but did not see any urgency at the time and the scene was chaotic, expecting to get time to call Pompi later.
“No, I was still going to tell him. As to what time, I did not see any urgency. The scene was a chaos this time already. So I knew I was going to get time to call him, because here we were still, I can say we were still having some misunderstandings with other police as colleagues.”
Advocate Segeels-Ncube alleges that Chief Mashaba engaged in a side hustle operation with Mr Nku and only informed superiors like General Khan when under pressure, implying intentional concealment of his actions.
“Chief, I am going to suggest that you did not tell Director Pompia about your discovery because you were not on a legitimate operation. It was your side hustle with Mr Nku. That is why you did not say anything. You only involve people when you are now in a bind because you have been arrested, because you are being bullied by General Khan.”
Chief Mashaba denies having control over whether he informed Director Pompia and seems to accept the statement as is, but Chairperson challenges this denial noting he had control to inform his superiors.
“Well, you are telling me I do not have control over that. I will just accept what you are telling me. ...No, you did have control over telling your superior what you were doing. You cannot hide behind what you have just said. Nothing stopped you from telling him.”
Chief Mashaba agrees that if the operation was illegitimate, he agrees with the opinion but denies stealing or wrongdoing and states it is his word against others'.
“That she is put to me that it is because it was illegitimate. So I am saying I agree with you because that is your opinion. I cannot say anything. ... If you are saying I was stealing, it is your word against mine. It is fine. I will accept what you are saying.”
On 9 July, Chief Mashaba and Magane introduced themselves to Yellow Jersey personnel as Crime Intelligence officers and tried to open a container without documentation, leading to a police callout due to aggressive and suspicious behavior.
“If you look at paragraph 3, they say on the 9th of July, Mr Van Niekerk was at home when Hardus, their Director, gave him a call stating that there are people from Crime Intelligence here asking to open the container. ... they say the reason for calling Booysens Police was because you did not want to identify yourselves, you were aggressive and you were behaving in a suspicious manner.”
Chief Mashaba was operating as a bogus Crime Intelligence officer on 9 July, impersonating a police officer according to Yellow Jersey employees' account.
“If what they are saying is true, it means you were impersonating a police officer. You were operating as a bogus Crime Intelligence officer if what they are saying is true.”
Yellow Jersey employees refused to open the container because Chief Mashaba and party did not have documentation and behaved aggressively, which led to involvement of the Booysens Police.
“They asked for documentation and you did not have documentation. ... the Booysens Police was called because you did not want to identify yourselves, you were aggressive and you were behaving in a suspicious manner.”
Chief Mashaba admits that some people changed their statements in relation to the incident at Scania, but he does not know when this happened.
“I want to put to you, Commissioners, that ourselves, upon our investigations also, we know people were made to change their statements. ... As to when, I do not know.”
Mr Riekert, a retired SAPS Captain and Security Manager at Scania, states that during the investigation, Chief Mashaba was very aggressive, obstructed others' work, and intimidated by threatening arrest if interference occurred.
“He says: 'Being a retired Captain in the Police, I asked him why they were not following normal investigation protocols. With a very aggressive attitude he told me not to try to do his work and that he would arrest me for interfering in the investigation.'”
Mr Riekert states Chief Mashaba produced a police ID identifying himself as a Warrant Officer but became aggressive when Mr Riekert tried to record information.
“He produced a police ID card identifying himself as a Warrant Officer. When I wanted to write down the information on the card he became very aggressive.”
Mr Riekert reports that when he tried to take photos of the events at Scania, Chief Mashaba and Magane were aggressive towards him and even told police who arrived to go away, claiming it was their scene.
“He says in paragraph 10 that even the police who arrived, you were aggressive towards him and you told them to go away because this was your scene.”
Chief Mashaba denies being aggressive towards Captain Opthof of the Flying Squad, noting Opthof was in official uniform and the police got control of the scene when they arrived.
“With Opthof, I was not aggressive. Opthof was in uniform officially in a police car. ... More police then arrived and took over the scene.”
Chief Mashaba denies being a bad person, asserts respect for Ms Mazibuko who he describes as motherly and morally upright, and states he continues learning from her.
“I am not that bad or I am not bad like how people perceive ... I wish to clear Ms Mazibuko because that person I take as a mother ... She does not mix with the wrong things ... I continue learning from her”
After harassment by General Khan, Chief Mashaba called Provincial Commander General Mawela who chaired a meeting and was advised to talk to General Mthombeni; General Mthombeni said they were busy and advised speaking to Brigadier Shibiri.
“After the harassment of General Khan, I called PC, General Mawela, and PC said to me he is chairing a meeting, I must talk to General Mthombeni. After I spoke to General Mthombeni through PC's phone, General Mthombeni said, hey, we are busy, just talk to Brigadier Shibiri and maybe she will come and assist you guys there.”
There was a misunderstanding between Booysen's team and Chief Mashaba's team about a hijacking complaint and the location of the arrest, resolved with agreement to book the driver and consignment at Booysen's location.
“We spoke to Booysen's Sector bakkie, they said guys, we are attending to a complaint that there is a hijack or you guys are bogus, can you please identify yourselves? We identified ourselves, and then they were happy. ... The driver of the truck is going to be arrested. ... The argument that is being said was that there was a misunderstanding between us and them ... that where are we going to detain, or where are we going to book the consignment ... we said we will go back to Alberton. They said, no, no, no, we cannot go to Alberton. It is happening now. You opened it in our area in Booysen's, so we will have to book them here in Booysen's.”
Chief Mashaba spoke to General Mawela who gave the phone to General Mthombeni; General Mthombeni told him to talk to Brigadier Shibiri who would come and check the situation but Brigadier Shibiri never arrived on the scene.
“I spoke to General Mawela. General Mawela gave, he said, I am chairing a meeting. He gave the phone to General Mthombeni. General Mthombeni said, what is the problem? I said, we are having a problem here, there is a general here, Khan, he is harassing us. He said, what is the problem? I said, we were following on information of drugs, of a truck carrying drugs. Well, he said to me, okay, let me, we are busy, let me give you Shibiri, talk to Shibiri, on one phone, General Mawela's phone. Then I spoke to Shibiri. Shibiri said, okay, where are you guys? I said, we are in Aeroton. Then they said, General Mthombeni said Shibiri will come there and check what is happening and assist where possible. I did not see him. He did not come.”
Chief Mashaba was Acting DD in 2021, second in charge of Sedibeng district, overseeing three or four offices including Ratanda, Heidelberg Weighbridge, Heidelberg region, and Vereeniging region, responsible for monitoring performance, attending complaints and holding meetings.
“in 2021 , the Acting DD that I was , I was in charge of , I was second in charge of the district , Sedibeng , heading three , four , yes , four offices . That is Ratanda , that is Heidelberg Weighbridge . That was , that is Heidelberg region . Vereeniging region . Meaning the four , the three , the four were reporting to me , I would go and inspect the offices . I will go and attend meetings in the district with the police , the district office in Vereeniging and come back and brief the Heads of , of the offices that is Vereeniging , Heidelberg , Heidelberg Weighbridge and , well , Ratanda is just a satellite small station because it is , it is small . So our duty , my duty is to monitor the performance of the offices , the three offices , to attend to complaints of the members , to hold meetings with the offices and address challenges there of .”
There is a perception or confusion that a Traffic Officer cannot do law enforcement, but Chief Mashaba states they have the authority and power to fight crime as peace officers under the Criminal Procedure Act 51 of 1977.
“a Traffic Officer is a Policeman specializing in roads ... what gives us the authority and power, it is the Act now as law enforcement officials and peace officers that we also have a mandate to fight crime . So I think that what gives us the power and the authority to, from time to time, work with the Police in fighting crime .”
Chief Mashaba confirms Traffic Officers have blanket power to do any and all things members of SAPS are empowered to do, except investigating dockets, and in crime in progress situations they support SAPS which takes lead.
“Yes, I can do, except investigating a docket. That, and I do not have the power over, but other than that, as a law enforcement official, it does not mean when I see, for example, a crime in progress, let us say rape, I cant turn a blind eye. I can not turn a blind eye, and I can not just turn a blind eye because I do not work with rapes. It is not my line of duty, but it is crime in progress. I can not just turn a blind eye. But when I am with the Police, jointly working, the protocol dictates that the Police will take the lead. I will be playing the supporting role.”
Chief Mashaba clarifies as a Traffic Officer he does not investigate serious crimes such as murder or armed robbery on his own accord, but would report such crimes to SAPS if brought to his attention.
“No. Hence I am saying … Specifically, not that I can out of my own way go investigate a murder, but if it is brought to my … I would not do that . I will either , either I will report to SAPS .”
Chief Mashaba says as a law enforcement official, he must report to the relevant authority when intervening outside his immediate jurisdiction and in related crimes off the road.
“I must do something as a law enforcement official. Step number one, I will have to report, make the relevant authority aware”
Chief Mashaba says he can enforce law on the road within Gauteng as a Traffic Officer, without needing permission from SAPS, but for other crimes he must seek SAPS assistance.
“Well, on the road, I do not need any permission from SAPS on the road because that is where my crime scenes are. As a Traffic Officer. But on other related, no related, on other crimes committed, I will have to seek assistance that SAPS”
Chief Mashaba states his jurisdiction as Gauteng province covering all Metros and Local Municipalities, not limited to the Sedibeng district where he is based.
“My jurisdiction is Gauteng. I am not like your JMPD that works within their boundary. I am not like Tshwane. I am not like Ekurhuleni. I am not like Emfuleni. I cover all the Metros and the Local Municipalities. That is my jurisdiction.”
Chief Mashaba confirms he would invite SAPS when conducting searches or raids inside a commission's premises as he would not act alone.
“I would invite SAPS. I would invite SAPS. No necessarily that I cannot, but I am saying, well, to limit a lot of issues, a lot of questions, it is simply, it is quite simple to just invite SAPS because they are the ones that quickly can apply for search warrants and stuff like that.”
Chief Mashaba states SAPS officers chosen to assist in operations depend on the information he gets; he does not just choose any officer arbitrarily.
“Depending on the information that I get, I do not just choose. I do not just choose.”
Chief Mashaba explains SAPS officers have specific operational areas and he must relate information to the relevant SAPS member before acting in that area.
“I need to relate that to a Diepkloof member because that is his area of operation.”
Chief Mashaba was promoted to Chief Provincial Inspector at the Premier's office in 2013 but was politically removed and suspended, and then reinstated and transferred to Vereeniging regional office as Head of the service point region.
“I was promoted to a Chief Provincial Inspector post... You then say you were politically removed and the following day the matter was not placed on the roll. I was then suspended and my reinstatement, I was transferred to Vereeniging regional office as the Head of the service point region.”
In 2020, Chief Mashaba was appointed Acting Deputy Director for Sedibeng District, Southern Corridor, a district role not provincial.
“I was appointed as an Acting Deputy Director, Sedibeng District, Southern Corridor. That is very specific. You are not in a provincial role then.”
Chief Mashaba accepts he was only Acting Deputy Director for Sedibeng District but says he occupies that position in the provincial office in the district of Sedibeng.
“I am occupying that position in the provincial office, in the district of Sedibeng. I am placed in Sedibeng.”
Chief Mashaba's daily Deputy Director responsibilities included visiting three offices and addressing complaints, challenges, resource and conflict management, and non-performance issues.
“My role was to address complaints, address challenges, be it resources, be it conflicts among the members, be it non-performance from managers. Those were my responsibilities there.”
Chief Mashaba admits he did not report to his Director Pompithe on 9 July 2021, contrary to expectations.
“On that day of ? The 9th of July 2021. No, I did not report.”
Chief Mashaba claims the information he received about the matter involved senior law enforcement officials and was sensitive, requiring caution.
“I want to emphasize that the information is sensitive information. I need to be careful because it involves senior law enforcement officials.”
Chief Mashaba was instructed by Mr Nku to be careful about who she informed regarding an operation because senior law enforcement officials were involved.
“you did not report to your Director because you said you were told by Mr Nku that you must be careful as to who you inform of this operation because there are senior law enforcement officials involved”
Chief Mashaba considered reporting to Director Pompi as a compromise of the operation based on information from a civilian.
“So you considered reporting to Director Pompi as being an issue that will compromise this operation”
Chief Mashaba acknowledged having a good relationship with the civilian source and also with her boss.
“I also have a good relationship with my boss also, correct”
Chief Mashaba did not inform her boss about the operation because the information involved sensitive issues.
“I am not taking this information light because it talks about sensitive issues there”
Chief Mashaba stated Mr Nku does not know Director Pompi.
“Mr Nku does not know Mr Pompi”
Chief Mashaba determined not to inform Director Pompi because he is a senior law enforcement official and such reporting might risk the success of the operation.
“It is because my boss is one of the senior law enforcement officials... so when he says to me, be careful who you involve, I know running a risk of reporting such information to bosses, sometimes you get to not become successful because the boss might have an interest whatever information you got”
Mr Nku's warning to Chief Mashaba about involving senior law enforcement officials referred generally to SAPS, metros and others, without specifying which agencies.
“Nku was trying to say, I understood it, because he is not a law enforcement official. I knew that he means it can be SAPS, it can be metros, and others. When he did not say do not be careful not to involve Samuel Mashaba... he did not specifically say SAPS”
Chief Mashaba preferred to involve only herself from Gauteng Traffic Police for this operation because the information came directly to her.
“For the purposes of this operation, you preferred that only you from Gauteng Traffic must be involved”
Chief Mashaba kept a diary recording her operational activities but the diary was stolen from her car.
“Yes, I have got my diary, Chair...My car, when I was locked up that day, I had a lot of things in my car...the diary was also in there...it was stolen”
Chief Mashaba heard that Mr Nkuh warned not to involve high-ranking officials and decided to deal with the matter on his own, not informing his superiors.
“...he warns you not to involve a high-ranking official... you are going to deal with it on your own...”
Chief Mashaba was not told the identity of the high-ranking official Mr Nkuh initially wanted to involve.
“No, he did not.”
Chief Mashaba took seriously the caution from Mr Nkuh about being careful who to share information with.
“I did not take it light, yes.”
Chief Mashaba was told there is a truck carrying drugs but was not informed of the exact size of the consignment or specifics of the drugs.
“He did not tell me exactly how big the consignment is... there is this truck.”
Chief Mashaba was informed on Friday morning that the truck was at the Yellow Jersey truck stop in Johannesburg.
“Yes, in the morning, Friday. ... Yellow Jersey truck stop.”
Chief Mashaba knew of the possible drug trafficking as early as Thursday night.
“Correct.”
Chief Mashaba asked Mr Nku to confirm that the information about the truck carrying drugs was correct before activating manpower to deal with it.
“Please make sure it is positive... I then asked Mr Nku to first confirm if the information was positive before I could act on it.”
Chief Mashaba said he could not carry out the operation alone and needed assistance (manpower).
“Mashaba alone cannot do that. I will need assistance from other people. That is the manpower I mean.”
Chief Mashaba developed the plan to activate manpower only after Mr Nku confirmed the truck carrying drugs was on its way.
“This plan you only come up with after he confirms to you that there is, in fact, the truck does have drugs and it is on its way.”
Chief Mashaba confirmed the truck was already at the Yellow Jersey truck stop when Mr Nku called him on Friday morning.
“Yes.”
Chief Mashaba was not told the location of the truck the night before the call.
“No, he did not tell me.”
Chief Mashaba only knew that there was a truck coming from Durban carrying drugs and was asked for assistance, without any additional information about the drugs or consignment size.
“He said to me, there is this truck coming from Durban, it is carrying drugs, can you assist?”
Chief Mashaba acted on the information provided by Mr Nku without independently verifying details of the drugs or consignment size.
“I do not know. Remember, I am only acting on the information he gives.”
Chief Mashaba asserts that as a law enforcement officer he knows how to verify information without needing the details told to him and that when he said he was following information about a truck from Durban to Johannesburg, it means the information is positive and established according to his understanding.
“the answer that I am giving is that if you receive an information as a cop, as a law enforcement official, I know how to verify without you telling me the details of that information. If you say to me, I am following on information from Durban to Johannesburg ... it means it is positive.”
Chief Mashaba says he was satisfied that the truck was carrying drugs from Durban and this knowledge was the reason why he acted on the information that the truck was already in Johannesburg.
“Yes, I was satisfied because at the back of my mind, the information I got is the truck will be carrying drugs from Durban.”
Advocate Segeels-Ncube challenges Chief Mashaba that his statement mentioned the truck was 'allegedly suspected' to have drugs, implying it was an allegation or suspicion rather than confirmed fact, and questions the factual certainty of the information.
“In your statement you say, which was allegedly suspected to have drugs in its cargo... It was an allegation and earlier on you dealt with it on the basis of a suspicion.”
Chief Mashaba confirms that Mr Nkukne knew as a fact that the truck was carrying drugs, and this information was given to him before Thursday night.
“Mr Nkukne knew because he is the one who has got details of that truck ... The truck is carrying drugs ... Yes, I knew the Thursday.”
Chief Mashaba admits that he did not do any verification of the information from his side or from a civilian side and that verification would only be to physically open and check the truck when it is in Johannesburg.
“No verification done by your, on your side?... The verification would be, I need to come and okay with the truck, I need to come and open. That is the only verification.”
Chief Mashaba states that Crime Intelligence was not involved on Thursday night because the operation was already in progress Friday morning and he did not have the luxury of time to wait for confirmation.
“Crime Intelligence, this thing already it is Thursday. On Friday it was in progress already. I do not think I had that luxury of time.”
Chief Mashaba admits he waited and slept before activating his plan the next morning after being told Thursday night about the truck carrying drugs.
“I slept and waited for his call then next morning.”
Chief Mashaba claims he did not have time to involve Crime Intelligence earlier because the operation was already in progress by Friday morning.
“I am saying to you I did not have time and there was no time because how do I have time where this thing is in progress?”
Chief Mashaba states he would have known if the truck carrying drugs had passed the Heidelberg Weighbridge because it would have been overloaded and would not be allowed to pass unnoticed; he also concedes he is not personally responsible for following or ensuring compliance on the roads.
“If it would have passed the weighbridge, I would have known because it was going to be overloaded, it was not going to pass...”
Advocate Segeels-Ncube challenges Chief Mashaba that since he is in charge of the Heidelberg Weighbridge and was given details of the truck including license plate and driver, he had the opportunity and resources to stop, inspect, and verify the truck but missed this opportunity allegedly intentionally to allow the truck to pass out of his district.
“You are in charge of the Heidelberg Weighbridge ... You could have asked your members to stop that vehicle at the weighbridge... but you missed that opportunity intentionally so that it can go to Johannesburg which is out of your district. Why would you do that?”
Chief Mashaba states he received information about the truck on Thursday but the detailed information about the truck was only given to him on Friday morning.
“The details of the truck, I got it on Friday morning.”
Chief Mashaba denies receiving detailed information about the truck on Thursday and clarifies he only got information on Thursday, not the details, which he received only on Friday.
“I did not say I had the details of the truck on Thursday. I said I got the information on Thursday. That is what I remember saying.”
Chief Mashaba states he treats information about a truck suspected of carrying drugs as sensitive and does not share such information with his team to avoid complications.
“Well, yes. ... It depend, because hence I am saying, I am treating it, it is sensitive information. I will not just say, look out for the truck, as if I am interested in, or doing business with such things. Hence I am saying, it depends.”
ADV Segels-Ncube accuses Chief Mashaba of not asking for the detailed information to activate the team to monitor the truck at the Heidelberg Weighbridge on Thursday night, even though he could have.
“You could have asked him for the details of the truck to get more information from him, correct? You could have. ... If you had gotten the information which you say you did not have, the details of the truck, the license plate, if you had elicited that information from him the Thursday night, you could have activated the team at the Heidelberg Weighbridge to be on the lookout for that truck, correct?”
Chief Mashaba admits he could have asked for truck details on Thursday night but says he did not think it appropriate to instruct his team based on sensitive info.
“I could have. ... No, you do not just say that. If I am saying, look out, be on the lookout for this truck, what is it doing, how about this truck? Look out for? ... Hence I am saying, it depends. I was not going to do it.”
Chief Mashaba claims the information about the truck did not fall under their mandate, so he did not tell his team to look out and did not report to SAPS, requesting manpower instead.
“Remember the information I got, it is, it does not fall under our mandate. So if I would have said that to them, I am saying that to them to do what? To call me, and then? I was not going to do it, because I know it is going to give us difficulty in dealing with it. It still needed SAPS. ... I did not report. I requested manpower in the morning.”
Chief Mashaba would have reported murders or armed robberies to the relevant SAPS police station where the crime occurred, e.g. Alberton.
“I will report to a police station that is where that murder has occurred. Let us say if it happened in Alberton, I will report to Alberton.”
Regarding narcotics suspected to be transported from Durban to Gauteng, Chief Mashaba states jurisdiction and reporting would be to Alberton police station within SAPS.
“Let us start with its jurisdiction of that narcotics, where is it. ... Albertont. Because it is in Yellow Jersey. Yellow Jersey is policed by Alberton.”
Chief Mashaba did not report the operation involving narcotics to SAPS as required by prescripts because he was cautioned by Mr Nku, a civilian.
“I did not report”
Chief Mashaba acknowledges he did not comply with prescripts by not reporting the narcotics operation, but disputes that this means he 'bowed' to Mr Nku.
“I did not bow to the civilian ... you get information and still use your own discretion”
Chief Mashaba says he is entitled to use his discretion even if it means acting contrary to prescripts, so long as the decision can be substantiated.
“I apply my mind ... as long as the decision you are taking, you will be able to substantiate”
Chief Mashaba accepts that if his discretionary action is contrary to prescripts, it would be unlawful.
“If it finds me to be in the wrong, it is unlawful”
Chief Mashaba did not report a narcotics operation to SAPS because he was cautioned by Mr Nku, a civilian, and this decision led to him breaching existing prescripts.
“you are saying Mr Nku said do not comply with your prescripts .. you do not comply with your prescripts”
Chief Mashaba maintains he did not choose to breach prescripts but says if found wrong, his actions were unlawful.
“I do not choose ... if I will be found to be in the wrong, yes, I would agree”
Chief Mashaba admits the prescripts require reporting narcotics-related operations to SAPS, which he did not do in this case.
“you have to report something like this to SAPS and we know that you did not report”
Chief Mashaba says he did not have SAPS members with him during the operation but called SAPS afterward.
“I did not have a SAPS member with me. I called the SAPS member after”
Chief Mashaba preferred to give the information about suspected narcotics to SAPS to avoid operational problems, rather than involving his own team.
“this thing is going to give us problems ... let me just give it to SAPS. That is where it belongs”
Chief Mashaba went to Yellow Jersey Logistics with a civilian and without any official police team or backup.
“you say when you went to the Yellow Jersey Logistics, you did not go with the police officer. Yes. So you went there with the civilian, or you met the civilian there. You met Mr Nkute here, correct ?”
Chief Mashaba did not instruct or mandate his team at the weighbridge to pull over the vehicle linked to an investigation, choosing instead to verify information first and act accordingly.
“why do you got to Yellow Jersey Logistics without the SAPS member ... but you cannot mobilize your official team at the weighbridge to look out for this vehicle and pull it over? ... Because the information came to me. I wanted to verify. If I saw it fit, nothing would have stopped me to call my team.”
Chief Mashaba went to Yellow Jersey premises with Mr Nkute and Mr Magane, got on the road behind the truck, and followed it to Scania premises where they conducted an operation involving opening a container that led to drugs being found and moved onto a van.
“you, Magane, went to Yellow Jersey property ... You enter that property, right? ... You then left the property following the truck. The truck left for Scania. You were behind the truck ... You all went to the property, I am right so far... You instruct the Scania people to open the container, the drugs fell out, and they were put onto a van.”
Chief Mashaba states he was refused entry to Yellow Jersey property initially but did enter the property with Mr Magane.
“I did not try to enter and I was refused. ... I did not enter. I entered with Magane.”
Chief Mashaba asserts as a Traffic Officer he is permitted by law to enter property and conduct operations except investigate docket, and he needed SAPS involvement for expertise but could have acted alone.
“He said as a Traffic Officer, it is something else. As permitted by law, under 334, nothing stops me. He said the only thing that I cannot do is to investigate the docket. Other than that, I can ... I need SAPS, but ... nothing would have stopped me from doing that if I was following or did exactly what I did from Yellow Jersey.”
Chief Mashaba confirms he could have conducted the operation at Scania without involving SAPS but still needed SAPS presence for ease and expertise.
“I could have done that. ... To make things easy, you quickly involve people you know life will be easy because that is the area of expertise, so that is SAPS.”
Adv Baloyi asserts that Chief Mashaba did not need to involve SAPS to conduct the operation at Scania and the operation was legally within his powers as a Traffic Officer.
“there is nothing that obliged you to bring the SAPS on to this operation ... it is an operation that, in terms of the law, your prescripts, your rules, your protocols, you are entitled to do exactly what you did without the SAPS.”
Chief Mashaba knows Mr Nku through a forum of businessmen against crime in 2019.
“I know him through a friend in 2019 as a businessman in a forum of business against crime”
Chief Mashaba's relationship with Mr Nku was a social contact but not a friendship or business relationship.
“Not friends. A contact, I will say”
Chief Mashaba clarified that he socializes with Mr Nku but they are not in business together.
“socially it means I will go out with him, maybe go drink or maybe go party or something. I am not in business with him, and I do not do that with him. It is just a contact, a person that I know”
Chief Mashaba once received and acted upon information from Mr Nku regarding fake diesel in Vereeniging, involving the police.
“he once gave me the information of diesel, this fake diesel in Vereeniging and we did it with the police”
Chief Mashaba said Mr Nku provided other information outside of his jurisdiction which he did not act on.
“other informations were out of the province, out of my jurisdiction. I could not assist”
Chief Mashaba considered Mr Nku as an informant because he volunteered information.
“I would say an informant because he was doing it voluntarily”
Chief Mashaba was unaware of the type of business Mr Nku was conducting and whether Mr Nku had a boss.
“I was not aware”
Chief Mashaba does not know if Mr Nku was reporting to a boss or had a boss.
“No, I do not know”
Chief Mashaba never was informed by Mr Nku that he had a boss whom he did certain work for.
“No”
Chief Mashaba confirmed that the number saved as 'Doggy Hawks' in WhatsApp messages linked to Mr Nku is his own number.
“I still use the number, yes... That is my number”
In WhatsApp chats dated February 18, 2019 between Mr Nku and Chief Mashaba, Chief Mashaba used the phrase 'I sent my boys' in a message, but he cannot recall who the 'boys' refer to.
“this is in February, the 18th of February 2019 ... you say thumbs up and you say, I sent my boys ... Like I am saying, I would not remember”
Chief Mashaba does not believe 'my boys' referred to members of his team.
“I do not think so”
Chief Mashaba acknowledged the phrase 'I will bring back your dignity to your bosses' in a WhatsApp message but does not know who the bosses are or recall relevant details.
“I do not know him as having any boss and I do not even know and I do not remember what we were talking about here”
Chief Mashaba stated he does not know anything about Mr Nku's life other than socializing, does not know where he stays even today.
“I know nothing about his life. I do not even know where he stays. Even today, I do not even know”
Chief Mashaba could not recall any further meaningful information about his relationship or activity with Mr Nku from 2019.
“I do not know, I am not, I cannot recall”
Chief Mashaba states there is a possibility that the content of his cell phone chats may have been tampered with.
“There is that possibility.”
Chief Mashaba accepts that if the WhatsApp message to Mr Nku is accurate and from him, he must have known something about his bosses.
“Let me accept until this is brought to me exactly where was this conversation going.”
Advocate Baloyi SC argues logically that Chief Mashaba must have known something about his bosses given the content of messages attributed to him.
“I am saying you must. It seems logical.”
Chief Mashaba admits he does not know who Iby Boss is and only refers to him as boss because Mr Nku tells him so.
“If Nku says to me, I talk to the boss, that necessarily mean I know that person he is talking to. I will only refer him as the boss because Nku says to me, that is my boss. I do not even know this I by Boss. I do not know.”
Chief Mashaba did not know that Mr Nku had bosses but referred to 'boss' because Mr Nku said so, though he did not know who the boss is.
“I did not know who the boss is. Like I am saying, when he talks to me and say the boss, that is the boss said, I will also refer that person as the boss. That does not necessarily mean I know the person.”
Advocate Baloyi SC asserts Chief Mashaba knew that Mr Nku was dealing with someone he refers to as boss, though he may not know the identity of the boss.
“You knew that he is dealing with someone that he refers to as boss and you also, you just continued to use the same descriptor.”
Advocate Segeels-Ncube asks Chief Mashaba if he recalls what the drug and money laundering inquiry was about; he replies he does not recall.
“Do you recall what the drug and money laundering enquiry was about? I do not recall.”
There was communication about opening an enquiry related to drugs and money laundering, and the enquiry must not come to the 'big boss' empty-handed.
“Either they take it or leave it, enquiry will be there but you cannot go to big boss empty-handed. We need to open their mouths with something.”
Chief Mashaba states he was aware that the drugs and money laundering enquiry was opened, and that he would have asked someone in SAPS to open such an enquiry.
“Yes, according to this, yes, I would have known. Maybe the person that I referred to opened that enquiry and confirmed to me that the enquiry is opened. Ask them to open an enquiry.”
Chief Mashaba admits that he himself and someone else would have approached the 'big boss' regarding the enquiry because it involves drugs and money laundering, which he said he could not deal with and had to refer within SAPS.
“When I say we, it means yes, I am involving myself. Because he is talking drugs and money, I know I would have done nothing about it. I would have referred it to somebody else and that will be in SAPS and nowhere else. Because he is talking about big boss.”
There have been WhatsApp messages and bank account exchanges indicating money transactions between Chief Mashaba and Mr Nku, implying a financial relationship.
“...there are WhatsApp messages that involve money conversations between you and Mr Nku and bank account exchanges and confirmations of proof of payment.”
Chief Mashaba acknowledges knowing about certain conversations about opportunities guaranteeing a formidible financial future connected to Mr Nku, but claims he cannot recall details now.
“At that time, it means I knew, but I cannot recall.”
Chief Mashaba indicates reluctance or inability to recall details about the financial conversations with Mr Nku, despite prompts from counsel.
“I cannot recall. Exactly. I can not. I do not want to. You will not. You just will not recall for us. You do not want to.”
Chief Mashaba denies gaining any financial benefit from communications with Mr Nku promising opportunities for a formidible financial future.
“I do not, because I know there is nothing that came to me as a benefit financially this time. I do not know of that. I would not know.”
Chief Mashaba received money from Mr Nku, possibly as a friend or contact.
“Well , for money , yes . He gave me , he gave you money .”
Chief Mashaba considers Mr Nku a contact but denies social or business ties with him and denies knowing what business Mr Nku does.
“He is a contact , yes , but I know I do not go out with him and I do not do business with him because I do not know what kind of business he does .”
Chief Mashaba met with Gauza once at his house; did not meet with Mvinjelwa; met with Mosa alone; and discussed different issues with Gauza and Twala separately.
“I met with Gauza at his house alone . I met with Mosa alone , not with Gauza . This Mvinjelwa I do not remember .”
Chief Mashaba wanted Gauza to assist or meet with somebody regarding a case that Gauza was uniquely capable to assist with.
“I wanted him to assist , I wanted him to assist or I wanted him to meet with somebody regarding the case that that person said Gauza is the only one that can assist .”
Chief Mashaba claims he has not spoken to Gauza for more than five years and never met or talked to him about operations involving Giyani, despite WhatsApp messages suggesting otherwise.
“I have never met , I have never spoken to Gauza. I am sure it is more than five years not talking to Gauza.”
Chief Mashaba claims he might be lying about the truthfulness of WhatsApp messages exchanged with Mr Nku, acknowledging that not all WhatsApp communication is necessarily true.
“I would have maybe , I would have maybe talking to Nku here , but because I do not even recall , I might maybe be lying here because you know for a fact not everything in the WhatsApp or in the message you say or you type is correct or true .”
Chief Mashaba says he met with Mashego to assist someone with a case, preferring not to be a middleman in the matter.
“What I remember exactly with Mashego was that there is a case that he needed to assist somebody with. That is why I went to him.”
Chief Mashaba does not recall or remember Mvinjelwa50.
“Mvinjelwa, I do not remember.”
Chief Mashaba admits he sent a WhatsApp message that could be interpreted as meeting multiple people at once, though he claims he met them on different days.
“Hence I am saying I do not recall meeting the three of them at once.”
Chief Mashaba sent a WhatsApp message 28 March 2019 stating "We winning Tumza dignity is going" referring to a contested dignity issue.
“On the 28th of March 019 at 3:14 p.m. you say: “We winning Tumza dignity is going.””
Chief Mashaba clarifies that "dignity is going" means the dignity has not yet been restored, indicating a lack of success.
“I said I will bring it back, now it is going. It means nothing happened.”
Chief Mashaba says he provided his business bank account details via WhatsApp to someone, with a message not to feel annoyed or taken advantage of.
“Do not feel annoyed and I am not taking advantage. And then you send him a bank account details. Whose bank account details are those? It is my business bank account.”
Chief Mashaba admits the business bank account he gave has been closed long ago but was active at that time.
“Yes, closed. I do not even remember, this time it was open, but it is my business.”
Chief Mashaba says money was deposited into his business bank account by someone, possibly as a boost or borrowing, but does not recall details.
“Maybe he would have, maybe he give it a boosting or borrowing me, I do not know.”
Chief Mashaba acknowledges that money was deposited into his account, indicates thanks and calls it a lifesaver but cannot recall details about the transaction or why he was saved.
“Thank you very Tumza. It has reflected. Lifesaver my brother. So he saved your life. How often did he save your life by paying you? Maybe he saved it this time. I do not remember what we were talking about or what transaction we were talking about here.”
Adv Baloyi states that WhatsApp messages indicate Chief Mashaba received money from Nku to distribute to others, under pressure to provide proof of payment.
“Can I say Chief, this sequence of WhatsApp messages speak to your receiving money from Nku to pay other people, to distribute to other people? That is what this speaks of, and that is the important thing...it was to pass it on or you were going to pay other people that required proof of payment that were putting you under pressure.”
Chief Mashaba admits that the payments in the WhatsApp messages were not for boosting him personally, but rather to pay other people he and Mr. Nku were involved with.
“this series of WhatsApp messages where you say they are putting me under pressure, send me proofs so I can show them, what it demonstrates is that whatever transaction or dealing you and Mr Nku were doing, these WhatsApp messages was about payment to your accounts so that you can pay other people known to you and Mr Nku”
Chief Mashaba states that if he was doing something wrong, he would not have left a paper trail as seen in the WhatsApp messages on Mr. Nku's phone.
“if really I was doing something wrong, I would not leave paper trail like this”
The WhatsApp messages were found only on Mr. Nku's phone, not Chief Mashaba's phone.
“this does not come from your phone. It comes from Mr Nku's phone. So he is not like you, clearly. It was found in his phone.”
Chief Mashaba acknowledges he gave Mr. Nku his account number and that the money he was receiving was to be distributed to other people as well.
“Established fact, which you admit, you did give him your account number. And I understood you to accept that you are saying to him, you are being put under pressure and saying they want proof of payment...it demonstrates or at least suggests that the money you were receiving was to be distributed to other people as well.”
Chief Mashaba denies knowing exactly what he and Mr. Nku were doing, admits they were communicating constantly, but he does not remember any dodgy deals with Mr. Nku.
“most of the time when he calls or called, he would need favours... I cannot remember exactly what we were talking about or what deals we were talking about... because I do not remember any dodgy deals with him”
Chief Mashaba confirms that his relationship with Mr. Nku in 2019 was a side hustle, including receiving unofficial financial assistance from Mr. Nku.
“Nku would be very much helpful to me... financially, yes. Not official... maybe I am renovating at home, I would cry to him and say can you please assist?”
Chief Mashaba admits receiving financial assistance from Mr Nku but denies any quid pro quo arrangement where he did something in return.
“No thing . Depending on what assistance will he be asking from me , I will then assist if I can .”
Chief Mashaba confirms Mr Nku was more than a source because he also assisted financially.
“he was not just a source . He was something more , because he also assisted you financially .”
Chief Mashaba explains Mr Nku often does not respond to phone calls, possibly due to travel or dislike of phone, leading to perception of being ignored.
“it is somebody who does not like the phone , or somebody that travels a lot . You might call him and call him and not get ... maybe he was out of the country . He is like that .”
Chief Mashaba admits regularly seeking financial assistance from Mr Nku, describing messages and calls showing reliance on him for money.
“you were looking for money from him ? Yes .”
Adv Baloyi accuses Chief Mashaba of working on something with Mr Nku, not merely receiving money, and implies this relationship was not disclosed as a friendship in earlier statements and affidavits.
“This is about something you are both working on . And then you say to him , if there is a stop to this work together , let me know so that I can stop and then not call you . So you were working with Mr Nku in 2019 April on something .”
Chief Mashaba denies lying under oath about Mr Nku's role as a source or informant, stating the relationship was based on information sharing not friendship or financial support.
“I was not lying , Commissioners . Maybe it is because we are talking about the Aeroton matter ... The role he played is he gave me information . I was not lying under oath .”
Adv K Humalo SC argues that if Chief Mashaba had described Mr Nku as a friend who often gave him money, the handling of investigations by IPID and other institutions would have been different.
“But do you accept that how IPID and other institutions would have dealt with the information would have been different if you said this is a friend of mine who often gives me money ... ?”
Adv K Humalo SC insists that Chief Mashaba was funded by Mr Nku, which is a problematic matter as Mr Nku is involved in drug-related activities.
“That is a fact . He was funding you .”
Adv Baloyi SC raises concern that Chief Mashaba accepted money from a person involved in drug deliveries and drug transportation arranged outside law enforcement channels, questioning how this is not problematic for a police officer.
“How should we look at a law enforcement officer like yourself being funded by a person like that ? How is that not problematic”
Chief Mashaba was angry about a genuine operation in 2021 and disputes that the complaint caused division within SAPS and Crime Intelligence.
“I was very angry about what happened on 021. I still am because that was a genuine operation.”
Chief Mashaba was not truthful in affidavits about the relationship with Mr Nku and withheld material information about their relationship from the commission.
“you were not truthful in all those affidavits when you described Mr Nku as a source, because he was more than a source to you”
Chief Mashaba admitted that Mr Nku is more than a brother in their relationship.
“he is more than a brother even now”
Chief Mashaba was not truthful about the true nature of his relationship with Mr Nku because he feared it looked like a police officer being funded by somebody, which is why he withheld the material information.
“You were not truthful in not disclosing the nature of what you say now in this last engagement... You say, I could not disclose then because then what would it look like, that a police officer is being funded by somebody?”
Chief Mashaba acknowledged that the relationship with Mr Nku involved unofficial funding but denied lying about it in his official capacity.
“If it is taken as a funding, it is unofficial. But on my official capacity and basis, I do not think I was lying.”
Chief Mashaba did not recall the amounts received from Mr Nku into the business bank account but admitted the relationship started in 2019.
“Honestly, I do not recall. ... Your relationship with Mr Nku started in 2019.”
Chief Mashaba received R20,000 from Mr Nku around March 2019 and felt comfortable enough to send business details by then.
“In March you already feel comfortable enough to ask him for money and send him your business details ... He gave you R20,000 in March and your relationship started earlier that year.”
Chief Mashaba did not do anything for Mr Nku to get that R20,000.
“And you did nothing for him to get that R20,000? No, nothing.”
Chief Mashaba did not recall other payments from Mr Nku in May 2019 or related communications or meetings discussing these payments.
“Do you recall that? No, no, no. ... I do not recall, Commissioner. No, I do not know.”
Chief Mashaba claimed to have forgotten details from 2019 about his relationship with Mr Nku and denied lying under oath about that relationship.
“In 2019 honestly, honestly, I do not remember what we were busy with... I would not say I have seen it, that I am lying under oath... I gave a wrong picture about my relationship with Nku because, truth be told, something of 2019 I forgot about it.”
The Chairperson suggested Chief Mashaba is feigning forgetfulness about the relationship details.
“For you to say that you have forgotten everything about this, to me it looks like you are feigning this forgetfulness.”
Chief Mashaba asserts that in 2019 the only thing he was busy with was renovating, not involving money, implying the texts discussed were not about financial matters.
“That is the only thing that I remember I was busy with in 2019 .”
Chief Mashaba denies ever traveling overseas, stating he has never traveled overseas.
“I have never travelled overseas .”
Chief Mashaba admits not recalling specifics about what unfinished business he had with Mr. Nku and states he is unsure about the nature of the tasks Mr. Nku refers to.
“I do not recall who or what was this all about .”
Chief Mashaba acknowledges that the firm 'Firme Welenaa' has gone under but does not elaborate on this fact within the chats, implying it may relate to his friendship with Mr. Nku.
“You are interpreting it correctly, Commissioner. ... It can be our friendship that I am talking about here.”
Chief Mashaba says Mr. Nku is a businessman involved with Coca-Cola, but he does not know what exactly he does there.
“I just know him as a businessman. He is in business with Coca-Cola. Ja, that is what I know of. What he is doing in Coca-Cola, I cannot tell.”
Chief Mashaba admits being the one to initiate multiple chats with Mr. Nku regarding unfinished business and expresses frustration at not recalling details about the nature of this business in 2019.
“I do not want unfinished business . So you have business with him ? It is a difficult one because I even hate now to say I do not remember. I do not recall.”
Chief Mashaba acknowledges that if something had happened in 2019, he would remember quickly, but currently he does not recall the incidents or context involving Mr. Nku's tasks or clearance.
“Actually, it frustrates. ... if really, really, something happened in 2019, I was going to quickly, rather than what I have mentioned, I was going to quickly remember.”
Chief Mashaba characterizes the rift or distraction involving Mr. Tumelo in 2019 as related to ANC issues and a rally, acknowledging Tumelo as an ANC person.
“Like I am saying , 2019 . Like I am saying , I know if it is something to do with rallies, it is ANC things . So I cannot remember 2019 , what was happening or what was the rally all about or which rally was this .”
Chief Mashaba asserts that his involvement with Mr Nku on 9 July 2021 was related to a drug bust, denying any unrelated involvement.
“My involvement with him on the 9th had everything to do with the drug bust.”
Chief Mashaba was asked to assist police with recovering money stolen at the airport involving persons known to Mr Nku, including Gauza.
“I wanted Mashego to assist Nku about maybe recovering whatever that was lost at the airport because they were working there, or they are still working there. I do not know.”
Communications between Chief Mashaba and others show arrangements related to visits to the airport counter and requests for details on shift times, linked to investigation efforts.
“Get and send more details ... bring more, maybe surname and shift times so we can quickly visit.”
Chief Mashaba personally went to OR Tambo International Airport to find Khensani and investigate stolen items.
“you actually went to the airport yourself ... You were not forwarding this information that Mr Nku gives you ... You actually went to the airport yourself”
Chief Mashaba was introducing Mr Nku to Gauza and others at OR Tambo Airport for assistance regarding stolen dollars at the airport.
“I think it was maybe introducing him to Gauza and them ... For him because he needed assistance. There is dollars that got stolen at the airport.”
Chief Mashaba denies putting up a team himself but requested assistance from others who work at the airport to recover stolen items.
“I do not put up a team. I ask if they can assist ... They will go because they work there. I do not work there.”
Chief Mashaba admits his team was complaining about not being topped up with money for the operation to recover stolen goods.
“My team is complaining ... I am winning, trust me ... It means I made money here.”
Chief Mashaba confirms that no money was given from Nku for the operation, and the top up did not materialize.
“I know for a fact, Commissioners, nothing was given from Nku ... the top up would mean or he means ... it never materialised ...”
Chat language 'Rashota' means short of cash, not enough money; Chief Mashaba agrees and says no money was made available so he cannot recall what happened exactly.
“Rashota means you are short of cash. It is not enough ... I am not excluding myself because I can see here is rashota ... because it never materialised that is why I could not remember exactly what was happening because it went nowhere.”
Chief Mashaba admits constituting a team of police officers (Mashego, Twala, Mvinjelwa) arranged with Mr Nku to be paid (topped up) in the context of the stolen goods recovery operation.
“So you were arranging for police officers Mashego, Twala, and Mvinjelwa to be paid by Mr Nku ... you constituted a team of the three and they are all police officers.”
Chief Mashaba confirmed that he constituted a team of police officers who were doing a favor for Mr Nku and were paid by him, working outside their official duties.

Chief Mashaba admitted that none of the materialised plans to grab Khensani were successful, and that he does not remember much about the event.
“Like I am saying , none of this materialised . So we were not successful ... So why did Mr Nku then send you R1000 on the 25th of May ?... I do not remember much of anything .”
Chief Mashaba received R1000 from Mr Nku on 25 May as some form of assistance due to their relationship, unrelated to grabbing Khensani.
“Clearly , it was not for this . It was for something else ... I would say because of our relationship . Maybe for trying to assist him . That is what he did .”
Chief Mashaba was politically and forcefully removed, arrested, detained, and suspended in 2018, then reinstated later that year after not being taken for a hearing within the suspension period.
“You say you were arrested and then the matter was not placed on the roll . You say that, and you were then released the following day ... that did not happen ... That is how I was reinstated ... I know I was locked up in 2018 ...”
In 2019 Chief Mashaba was the Head of Service Point at Vereeniging Regional Office, not Head of SAPS.

Chief Mashaba was involved in an operation in OR Tambo in 2019, but jurisdictional limitations applied.

Chief Mashaba confirms that OR Tambo is an airport and that police operations, including traffic officers giving tickets, do occur there but not inside the terminal building.

Chief Mashaba admits he was at the airport assisting Mr Nku and introducing the group to Nku but denies participating in the actual operation or arrest.
“I did not participate in that operation. I was at the airport trying to assist Nku and introduce the guys to Nku. It necessarily does not mean I went inside the airport or I was part of the operation.”
Chief Mashaba acknowledges a WhatsApp message stating they would 'grab him' but insists that does not mean he was part of the team planning or effecting an arrest, highlighting the distinction between presence and active participation.
“it does not mean necessarily that I was part of the team. But because of the airport, if that is what I meant that it is going to happen, I am also here around. Not necessarily that I am part of that operation”
Advocate Baloyi accuses Chief Mashaba of associating himself with a team making a planned arrest outside his traffic officer duties, questioning his role in the process.

Advocate Khumalo accuses Chief Mashaba of lying to the Commission by giving untruthful evidence about Mr Kebby Maphatsoe's return date.
“Chief Mashaba, in the era of Google, you should not be lying about facts that are publicly verifiable. And what you are doing now is you are lying to the Commission ... I do not often use that word, lying ... why are you lying on such a meaningless issue?”
Chief Mashaba denies lying and claims if it was DD Mabuza, he would have no reason to lie about a late person.
“I am not lying, Commissioners. I know Mr Nku calls Kebby DD. Like I am saying, if it was DD Mabuza, I would see no reason to lie about a late person.”
Chief Mashaba initially did not understand the question about May 29 but later, on being reminded, said he remembered that the person was back in the country, though he was unsure of the purpose.
“Now that you are telling me ... what I was meaning here is he is back in the country, now that you are reminding me, I remember ... maybe he was back for this, I do not know.”
Chief Mashaba says there was a lot that 'he' was doing for Nku as an uncle, implying that Kebby Maphatsoe (uncle) was involved in affairs concerning Nku.
“I know that there is a lot, or there was a lot that he was doing for Nku as an uncle.”
Chief Mashaba accepts that the cabinet announcement date was 29 May 2019.
“I accept that now you are saying the date and …”
Chief Mashaba accepts that on 29 May 2019, Deputy President DD Mabuza had returned to his position of Deputy President of the country.
“Yes, I accept.”
Chief Mashaba is refusing to accept that his statement about 'he is back' refers to Deputy President DD Mabuza rather than 'uncle'.
“What you are refusing to accept is that you are talking about him here, DD, that is back ... Yes, I do not mean DD. I meant the uncle.”
Chief Mashaba refuses to comment further on the issue of who 'he is back' refers to.
“I would not comment any further, Chair.”
Chief Mashaba suggests that the referenced uncle may have had involvement in his dealings and that the uncle may assist in his business or for career growth.
“The issues that this uncle maybe would assist as an uncle maybe would be in his business ... But to my benefit, it would mean maybe I will use it at my advantage maybe for a growth career-wise ...”
Chief Mashaba admits that his uncle was involved in assisting Mr Nku in his businesses.

Chief Mashaba acknowledges that working with Mr Maphatsoe (uncle) benefits his career growth and progression.
“I would have say how, but … When I say career-wise, obviously I would mean growing at work. … Maybe here I would mean a position maybe. With that, yes.”
Mr Nku made a guarantee in February 2019 to Chief Mashaba of a formidable financial future with types of opportunities to be opened up.
“He guaranteed you a formidable financial future. That is the guarantee he made to you on the 18th of February 2019. He said types of opportunities will be opened up.”
Chief Mashaba accepted that his businesses must be financially related benefit to him.
“So our businesses must be financially related benefit to you. Do you accept that? I accept that.”
Chief Mashaba sent a WhatsApp message on 4 June 2019 about looking after Faith Mazibuko, the MEC for Community Safety appointed on 13 May 2019, indicating things are going to change for his benefit.
“On the 4th of June, you sent a message: ‘Tumza, morning. Are Sebetseng Mfethu. I want us to look after Faith. She is now my MEC. Things are going to change for the best and beneficial to me. Please, Mfowethu.’ You were speaking about Faith Mazibuko.”
Chief Mashaba told Mr Nku they must keep working together to look after MEC Faith Mazibuko, implying a side hustle to benefit from her position.
“You are saying to Nku that you guys must work because you want to look after the MEC. Things are going to change for the best and beneficial to me. Please, Mfowethu. Let us keep working, let us keep doing what we have been doing.”
Chief Mashaba acknowledges he is engaged in off-the-books unlawful operations with Mr Nku involving misuse of SAPS members and their positions.
“We know that you have off-the-books operations with him and your team that he is paying ... operations that are not authorised by law ... unlawful conduct that the two of you are engaging in using your position and getting SAPS members to use their positions to do things that are not in ...”
The witness was briefed only by Warrant Officer Phakula, not by Sergeant Magane or Chief Mashaba.
“I got a briefing from Phakula only. He is the one who was briefing me, Warrant Officer Phakula.”
Chief Mashaba applied to testify partially in camera, remotely, and not to have his face shown due to medical unfitness and to avoid giving an impression of running away from the proceedings.
“The reason ... I am not well. Medically, I am unfit. ... I have seen it necessary that I physically come so that it must not give the Commission an impression that maybe I am running away or something like that. ... I am struggling to also walk properly. Maybe that is the reason why I said I cannot. I am also coughing.”
Advocate Pooe opposes Chief Mashaba's application to testify partially in camera due to the medical note not covering the current period, lateness of application, and availability of accommodations for witnesses with health issues.
“The first is, as Chair has noted, the sick note does not cover the current period and so as matters stand, we do not have anything from Chief's doctor asserting that he is unwell, except hissay-so. The second is that the application itself is quite belated. ... The Commission, when approached by witnesses who have health reasons and need reasonable accommodations so that they are able to testify, we have... done so, including having intermittent breaks for witnesses to be able to take medications or indicate if they are uncomfortable and I see no reason why the same approach should not be adopted with Chief Mashaba.”
Chief Mashaba reiterates that although his application to testify remotely is late, he can still come physically if the Commission sees fit, and does not want to be seen as delaying or running away from the proceedings.
“Well, it was explained to me, Chair, that my application is late, but I still reiterate that if the Commission sees it fit, I can still come, because I do not want to be seen as I want to maybe delay or I am running away from the proceeding.”
Chief Mashaba confirms that he was suspended following the letter of suspension and subsequently went back to work without a disciplinary process being followed.
“I was suspended ... Yes ... The disciplinary process was not followed ... Then you went back to work? Yes”
Summary of allegations regarding an incident on 8 and 9 July 2021 involving Chief Mashaba receiving information on suspected drugs, assistance in escorting the truck, discovery of drugs, arrest of driver and recipient, involvement of Dog Unit, LCRC, Hawks, and later arrest and charge of Chief Mashaba and others for drug dealing.
“It is alleged that on Thursday, 8 July 2021, Chief Mashaba received an information about the suspected drugs that were to be transported from Durban to Alberton. The following day, on the 9th of July 2021, the information was followed and Chief Mashaba asked for assistance and he was assisted by Warrant Officer Magane and Warrant Officer Phakula. The truck was then escorted to the destination at Aeroton where the container was opened at the receiving bay. While searching the container, the drugs were found. The driver of the truck and the person who were to receive the cargo were placed under arrest. The Dog Unit and the LCRC were summoned at the scene while still compiling the docket. While compiling the docket, the Hawks member arrived at the scene. Chief Mashaba and members who recovered the drugs were later arrested as per Booysen CAS 8/07/2021 and charged for dealing in drugs. The driver of the truck and the person who was to receive the cargo were then released. The Hawks members found the Booysens Police who attended to a complaint and have given their feedback indicating all was in order and that the police have recovered the drugs and the suspects were arrested.”
There were people from Gauteng Traffic Department trying to remove contents of a container suspected to contain drugs, intention to remove those drugs together with Chief Mashaba.
“there were people from Gauteng Traffic Department who were trying to remove the contents of a container that he suspected to contain drugs. That is true because Warrant Officer Magane testified before the Commission that that was their intention to remove those drugs together with Chief Mashaba.”
General Mthombeni stated he called Chief Mashaba with instructions from General Mawela related to the drug trafficking investigation.
“which you say that he states that indeed he did call Chief Mashaba with the instruction of General Mawela”
Chief Mashaba was introduced to General Mthombeni during a vaccination drive and indicated that police were about to arrest a suspect related to drug information, and that the matter should be dealt with by Directorate of Crime, DPCI (the Hawks).
“During the vaccination drive, I remember speaking to an official attached to the Gauteng Traffic Police, who introduced himself as preferred Chief Mashaba, who indicated that he was following information on drugs and he indicated that the police are about to arrest him ... the matter to be dealt with by the Directorate of Crime, the DPCI, known as the Hawks”
Brigadier Shibiri acted as contact between Chief Mashaba and the Directorate of Priority Crime Investigation (DPCI) to deal with the drug trafficking matter.
“The Acting Deputy Provincial Commissioner Brigadier Shibiri gave me a feedback that he spoke to the Gauteng Police Traffic official referred to as Mashaba that the matter to be dealt with by the Directorate of Crime, the DPCI, known as the Hawks ... Brigadier Shibiri further indicated that he will liaise with the DPCI Provincial Head, Major General Kadwa, to deal with the matter”
Chief Mashaba was arrested by the Hawks while involved in an undercover drug operation which he could not disclose due to the nature of the operation.
“At about 11:26, I received communication from Deputy Director Sekhonyane that Chief Mashaba is being arrested by the Hawks. I called Chief Mashaba and his phone was off. And just a few minutes after that, he called me. He then told me that he could not tell me that they had an undercover operation of drugs when I asked him earlier to join me for the visits to the K78. He told me that the operation was successful, but they are just having a misunderstanding with other members of Crime Intelligence.”
Warrant Officer Phakula, Warrant Officer Magane, Chief Mashaba of Traffic and an unknown male were placed under arrest per General Khan's directive, which Witness I considered an abuse of power and an effort to protect the suspect driver and obscure the vehicle's origin.
“Warrant Officer Phakula, Warrant Officer Magane, Chief Mashaba of Traffic and one black male unknown to me were placed under arrest as per instruction or directive of General Khan ... As weeks passed, my observations of the scene indicated potential abuse of power and rank ... I was concerned that these actions appeared to be an effort to protect both the driver of the truck ... and to obscure the origin of the vehicle and its contents”
Chief Mashaba called Warrant Officer Phokungwana according to the phone call log evidence under discussion.
“Mashaba phoned Phokungwana”
The call log shows Chief Mashaba called Phokungwana first, Phokungwana then called Magane, and Magane called Phokungwana afterwards.
“Chief Mashaba called Phokungwana ... Phokungwana called Magane ... Magane also called Phokungwana”
There is a table indicating RICA numbers and chat participants, confirming communication between Chief Mashaba and Warrant Officer Phokungwana.
“it indicates the two participants of the chat ... the RICA number of Warrant Officer Phokungwana is the one that ends with 794 ... and ... for Mr Mashaba”
There is an organized scheme involving people like Nku, Chief Mashaba, and others, monitoring containers, vessels, and jets, yet no prosecutions have occurred despite evidence from WhatsApp messages and other communications.
“there is organized conduct where containers, vessels and jets seem to be monitored... Nku and Alphas speak about... we have our guy there... is there a reason that there hasn't been any prosecutions of people that have been identified?”
Brigadier Sekgobel would be the person to account for why there has been no investigation or prosecution concerning identified persons outside and inside SAPS involved in the Aeroton case.
“Brigadier Sekgobel would be the person to account or give an explanation why has there been no investigation... I am speaking about Mr Nku, Alphas person, Chief Mashaba... I am going to throw them in anyway, but starting with the investigation, why has there been no investigation?”
Director Maphosho conducted an investigation into complaints by Warrant Officer Phakula, Warrant Officer Magane, and Chief Mashaba against General Khan, Kadwa, and three others concerning defeating the ends of justice.
“Director Maphosho conducted a investigation into the events that arose at Aeroton... complaint by Warrant Officer Phakula, Warrant Officer Magane and Chief Mashaba who laid a complaint against General Khan, Kadwa and three others... investigating a case of defeating the ends of justice.”
Complaints from Chief Mashaba, Warrant Officer Phakula, and Warrant Officer Magane were lodged at IPID National Office on 2021-10-13 accusing police officers of defeating the ends of justice; these complaints were registered at Booysens Police Station as Booysens CAS 252/10/2021.
“On 2021-0-13, the complainants, that is, Chief Mashaba, Warrant Officer Phakula, and Warrant Officer Magane, came to IPID National Office to lodge a complaint of defeating the ends of justice. The complainants were interviewed by the members of NSIT, and I was part of the interview. ... The case was opened at Booysens Police Station and registered as Booysens CAS 252/10/2021”
On 2021-10-28, NSIT members interviewed a former called Tumelo (Mr. Nku), who had provided complainant Mashaba with information about drugs.
“On 2021-10-28, NSIT members interviewed the former, Tumelo, who gave the complainant Mashaba information about the drugs”
On 8 July 2021, Chief Mashaba received information about suspected drugs being transported from Durban to Alberton, followed the truck to the depot where it was parked, assisted by Warrant Officers Magane and Phakula.
“It is alleged that on Thursday, 8 July 021 , Chief Mashaba received an information about the suspected drugs that were to be transported from Durban to Alberton. The following day, on the 9th , the information was followed and indeed the truck was followed to the depot where it was parked. Chief Mashaba asked for assistance and he was assisted by Warrant Officer Magane and Warrant Officer Phakula.”
Members of the DPCI arrived and arrested police officers involved in the drug bust, charging them with dealing and possession/use of drugs.
“Members of DPCI , amongst others , General Kadwa , Brigadier Sekgobela , Colonel Steyn , Captain Sebula , arrived at the crime scene , and they arrested the police officer who made the drug bust . That is Warrant Officer Magane , Warrant Officer Phakula , Chief Mashaba , and Tumelo . They were charged with dealing in drugs and possession of drugs / use of drugs .”
Assistant Director Maphosho and colleagues did not verify if Mr Nku was a registered informer despite being told by Chief Mashaba he was his informer.
“You d i d n o t a n d y o u d o n o t c h e c k t h a t t o v e r i f y w h o t h i s s u p p o s e d s o u r c e i s ... w e d i d n o t v e r i f y .”
Assistant Director Maphosho relied solely on the information from Mr Nku as an informer to Chief Mashaba without verifying the basis of the information.
“You proceeded solely on the basis that he is an informer of Mashaba, who is his handler.”
Chief Mashaba is involved in receiving information related to drugs, despite questions about his job description and role in drug matters.
“that he even has this informer who is assisting him about drugs? It just does not make sense.”
Chief Mashaba, Mr Nku, and Warrant Officer Magane were the first to arrive at the crime scene and opened the container, unpacked, and took the drugs onto Warrant Officer Magane's van without LCRC presence or a dog for inspection.
“they got there , the three of them , which is Mr Nku , Mr Magane , Warrant Officer Magane , and Chief Mashaba . They got there , opened the container , and then unpacked , took the drugs onto Warrant Officer Magane ' s van . When there is no LCRC , there is no dog”
Lt-Col Sebola conducted his own checks regarding communication and suspected a witness might be connected to a company involved in the investigation, based on a call made by Chief Mashaba on 8 July.
“I had to do my own checks... On the 8th of that July, Mashaba called someone who was working in that company. So, now my suspicion was, what if that one is my witness?”
The call referenced was made on Chief Mashaba's phone.
“It was on Chief Mashaba's phone.”
When the witness first met Chief Mashaba in 2018 at Winnie Mandela's funeral, they only exchanged greetings; and that was the only contact prior to the 9 July 2021 events. On 9 July 2021, Chief Mashaba was at the scene with Warrant Officer Magane.
“I first met Chief Mashaba at the funeral of Mama Winnie Mandela in Orlando West in 2018...When I saw Chief Mashaba at the scene, I then concluded he was together with Warrant Officer Magane.”
Warrant Officer Magane received a call from Chief Mashaba about the drugs container; Chief Mashaba had received the information from his informer. They first went to Roodekop at Yellow Jersey Logistics, found the container, then escorted it to Aeroton for an expected client.
“I was informed by Warrant Officer Magane that he received a call from Chief Mashaba about a container with drugs and Chief Mashaba received the information from Chief Mashaba's informer. They first went to Roodekop at Yellow Jersey Logistics and found the container there and then they escorted it to Aeroton so the client was expecting the order.”
The driver of the truck was already under arrest and was told to stand next to the truck by Chief Mashaba.
“Chief Mashaba who told me the driver is already under arrest and he was told to stand next to the truck”
Two other people who were receivers of the cargo were placed under arrest by Chief Mashaba.
“Chief Mashaba also told me he placed two other people who were receivers of the cargo under arrest”
Major General Khan disarmed Chief Mashaba and Lieutenant Colonel Maluleka saw a whimpering driver under arrest walking away from the crime scene.
“He disarmed Chief Mashaba. Lieutenant Colonel Maluleka saw a whimpering walking with the driver away from the crime scene, the driver who was placed under arrest.”
Chief Mashaba calls the witness for assistance with manpower, and the witness confirms this is within his function to work outside the station when required.
“when Chief Mashaba calls you for assistance with manpower, you say, that is what you say. That is correct,”
The request for assistance from Chief Mashaba does not fall under the witness's listed functions in paragraph 3, which include duties from 3.1 to 3.10, such as environmental scanning and dealing with crimes at scenes.
“It does not fall under paragraph 3.”
Chief Mashaba's request for assistance fell outside the jurisdiction of the witness's station, because Chief Mashaba was at Londi in Alberton, while the witness's jurisdiction was Zonkizizwe prison.
“the CSC members are only allowed to work within our, the jurisdiction or the prison of Zonkizizwe. So when Mashaba was asking this assistance, he was at Londi, Londi which falls under Alberton.”
At the location after being called by Chief Mashaba, the witness met Chief Mashaba and a gentleman named Mr Tumelo Nku, who was introduced as an informant and explained information about a truck allegedly carrying or transporting drugs.
“Upon my arrival at the said location, I met Chief Mashaba driving a grey VW Golf 7 and another gentleman unknown to me driving a charcoal BMW 7 series... This man came to be known to me as Mr Tumelo Nku... After a detailed explanation of the information by Mr Nku, Chief Mashaba further requested Mr Nku to further explain the information to me in detail.”
Contrary to transcript wording, only Chief Mashaba and the witness went inside the truck stop at Yellow Jersey Company, Mr Nku was left behind.
“I think here the statement, it is only me and Chief Mashaba who went to that truck stop, not Mr Nku. Mr Nku was left behind.”
Chief Mashaba was driving a grey VW that was a police vehicle.
“No, it was a police vehicle.”
Mr Nku is the informant of Chief Mashaba.
“Informant, yes. ... Mr Nku, that is correct there.”
Mr Nku used to work at Transnet and had information about a truck due to Transnet's role in container transport from harbours, but the source of the informant's information was never interrogated in detail.
“Mr Mashaba explained to me that Mr Nku used to work at Transnet, so he still have information about Transnet matters... According to the information that was given to me ... I then assumed that he got it maybe through his source or in whatever way. ... I did not go deep into getting more information from Mr Nku as to how is he getting this information, because he was no longer working at Transnet.”
Warrant Officer Magane taking the contact details of Mr Hardug was done because he felt part of the team despite it being a Traffic Department operation, while Chief Mashaba did not do so.
“Before we left the premises ... I left my numbers with Mr Hardug and he also ... gave me his numbers ... Did Chief Mashaba do the same? No, no, no, only me did that ... I felt that I can just leave my numbers because we are a team ... It is a Traffic Department operation”
Warrant Officer Magane received instructions on handling an informant from Chief Mashaba and would not dictate to Mashaba how to handle the informant.
“this is the explanation that I got from his handler, Chief Mashaba and I would not dictate for Mashaba to how he must handle his informant”
Warrant Officer Magane acknowledged relying on Chief Mashaba's previous experience in the handling of an informant and defended Mashaba's decisions.
“I would not have power to say, Mr Mashaba, tell your informant, because I suggested ... If he had problems ... he would have said, maybe advise Mr Nku not to be part of the operation”
Major General Khan arrived at the warehouse, met with Scania management, and ordered the police to stop their operation, later disarming Chief Mashaba of his service firearm to prevent warehouse searching.
“Major General Khan went straight to the warehouse and met with the Scania management and after that he came back to us and ordered us to stop with our operation. He asked who was the driver of the bakkie which was loaded with the black bags, and I answered it was me. He then instructed me to go inside the bakkie. Then a big argument ensued between Major General Khan and Chief Mashaba, whereby Major General Khan ended up disarming Chief Mashaba of his service firearm and stopped the guys from docking it from searching the warehouse.”
Warrant Officer Magane was made to sit in a car and photographed as if he were a suspect during the police operation at the warehouse, while drugs were being counted with some bags already opened, and several senior officers were in charge of the counting.
“I was made to sit in the car while I was photographed as if I am a suspect. Members of DPCI from Germiston and Johannesburg arrived at the scene with Major General Kadwa, the Provincial Head of DPCI. There seems to have been a briefing between Major General Khan, Brigadier Sekgobela, Lieutenant Colonel Mabaso and Captain Sebola. Right after that, Warrant Officer Phakula, Chief Mashaba, Mr Nkua and myself were arrested and put at the back of a Booysens SAPS bakkie which was driven by Sergeant Ndou and Constable Makwambiri. We were kept at the back of the bakkie for some time. At some stage, we were then taken from the back of the bakkie to observe the counting of the drugs. To our surprise, we find that already 10 bags were already opened. Brigadier Sekgobela, Captain Dale, Captain Sebola, the arresting officer, are the ones who were in charge of the counting, in counting the drugs.”
Warrant Officer Magane agreed the scene was not properly managed and that he and Chief Mashaba initially stuffed it up before it came under control of DPCI members.
“the scene was not properly managed... Initially it was myself and Chief Mashaba... because now at this time, the scene was already under the control of DPC members...”
The occupant of the BMW 7 Series vehicle who was an informer was allowed to remain at the scene despite being exposed publicly, which is unusual and concerning in police operations involving informers.
“... Nku had previously given information to other police ... a handler explained ... Nku was told that they did not find anything ... He was sitting in his car ... And you can not explain why he remained at the crime scene ... I have a worry that the presence of that person there was to look at those drugs and see what was to happen to them ... An informer follows the police and goes to the scene and remains until he is arrested, which is troubling ... he was always in his car ... an informer does not expose themselves and show who the perpetrator is ...”
Warrant Officer Magane says that during conversations with Chief Mashaba and Booysens, there was no mention or agreement to leave the scene before processing the scene and that conversations only concerned the detention and booking of the exhibit.
“there is nowhere in our conversation between myself, Chief Mashaba, and the Booysens, there was nowhere I said or we said we are leaving. The only thing that we said, it was, we were talking about the detention of the suspect and the booking of the exhibit.”
Warrant Officer Magane let Chief Mashaba be the owner of the scene and did not comply with National Instruction 84A and B regarding first responder responsibilities.
“You get there, and you let him be in charge of the scene, notwithstanding that which you read, 84A and B. You did not comply with that.”
Warrant Officer Magane asked Chief Mashaba why he contacted people outside of his own Traffic Department instead of his colleagues and was told that the matter related to Roodekop in Alberton and that Warrant Officer Pokongwane was referred to handle it.
“Yes. And the reason was that this thing, the information was about Roodekop, which happened to be in Alberton. That is when he thought about Warrant Officer Pokongwane and that Warrant Officer Pokongwane referred him to me.”
Warrant Officer Magane asserts he was not the right person in terms of jurisdiction and was merely asked by Chief Mashaba to assist with getting someone for an operation.
“No, no, no. When Mr Mashaba phoned me, he said can you please assist with getting someone ? He said, can you please assist me ? I have got information. It was just an open invitation. Not that I had something or I was special in something.”
Warrant Officer Magane does not know if Chief Mashaba informed his superior about the operation but is not in a position to confirm it.
“Unfortunately, Commissioner, I would not be in a better position to say he informed his supervisor. But fair enough.”
Deputy Director Dumisani Pompi stated that Chief Mashaba did not inform him about the activity he was performing at the time of his arrest and that Mashaba acted without his boss knowing.
“He calls him Acting Deputy Provincial Inspector Mashaba : 39; o n duty of the activity he was performing at the time of his arrest and he did not even inform me about it . 39; So, that is what his superior says. So, Mashaba went and did his own thing without his boss knowing .”
Deputy Director Dumisani Pompi says Chief Mashaba kept communicating with him as his supervisor regarding his duties and Mashaba called Pompi for a meeting but then Mashaba was arrested by the Hawks related to an undercover drug operation.
“His supervisor, Dumisani Pompi filed a statement at the time and said that, and I will just pick parts of it that make the point, he says : “ Chief Mashaba, in all his work engagements, he keeps communicating with me as his supervisor with regards to his duties . 39; Right ? That is the one thing he says . And then he says that morning he called Mashaba for a meeting and Mashaba said he is busy . And then at about 11 : 26 he heard from Deputy Director that Chief Mashaba has been arrested by the Hawks .”
Deputy Director Dumisani Pompi says he was told Mashaba could not tell him about the undercover drug operation and Mashaba's superior indicated that SAPS responsible for the operation will discuss misunderstandings with the Intelligence General Khan.
“He then told me and then he called him and then he told me he could not tell me that they had an undercover operation of drugs . This is Mashaba now . He finds him on the phone . After now he is arrested . That the operation was successful but they are just having a misunderstanding with other members of Crime Intelligence . The indication from him was that they are fine and they will handle the situation . This is Mashaba to his superior . And then this is what the superior says in the statement : “ for me this denote(d) that the responsible person for SAPS that approved this operation will discuss the misunderstanding with the General from Intelligence . ” This was a reference to General Khan, a telephone call from General Khan .”
Chief Mashaba was responsible for the operation but his boss confirms he did not place Mashaba in charge of it and Mashaba acted without informing his boss.
“I can confirm that I did not place Mashaba … on duty of the activity he was performing at the time of his arrest and he did not even inform me about it .”
Senior members of SAPS like Chief Mashaba from Traffic should know that large drug consignment matters are DPCI matters and contact DPCI accordingly.
“In my opinion, he should have known as a senior member, yes, Commissioner.”
