Brown Mogotsi

Mr Matlala had no prior dealings or knowledge of Brown Mogotsi before the call after the SAPS raid on his house.

“I can confirm that I came to know of Mr Brown Mogotsi when he called me at the time that the SAPS had raided my house. Prior to this incident, I had no dealings with Brown Mogotsi.”

Brown Mogotsi impersonated being from the office of the Minister of Police to entice Mr Matlala into giving financial assistance.

“Brown Mogotsi impersonated to me that he was from the office of the Minister of Police, and it would appear that he was using this strategy to entice me into giving him financial assistance.”

Brown Mogotsi called Mr Matlala on Sunday after the Friday raid (6 Dec 2024) offering to help open a case against the police.

“he called and he said to me, he is calling from the Office of the Minister. And then he is here to help me to open the case against the police.”

Mr Matlala gave Brown Mogotsi R20,000 for booking accommodation for police experts to investigate the raid, and later R150,000 for an ANC January 8 celebration.

“I gave him that money. I think it was 20,000, I think. ... I paid also 150,000 to his account for that January 8 celebration of the ANC.”

Former Minister Bheki Cele advised Mr Matlala to continue giving money to Brown Mogotsi to lead them to the bottom of the matter.

“the former Minister of Police said to me, you know what? Continue giving this guy money. Maybe if you do that, then, then he will lead us to, because he is saying that he is close with the Minister of Police.”

Mr Matlala accepted help from an unknown person claiming to be from the Minister's office after a raid on his home because he was frustrated and did not suspect anything initially.

“What he said to me is he is from the office of the Minister. And then by that time, out of frustration, I did not even think that far that how did he end up.”

Mr Matlala paid R50,000 (and flight tickets) on advice of former Minister Bheki Cele to avoid arousing suspicion from Brown Mogotsi and potentially get close to ministers or uncover plans involving General Khumalo and General Khanto in Crime Intelligence.

“It was because of the advice from the former Minister, Bheki Cele. ... To make him not doubt that I no longer trust him. ... Mr Senzo wants to fire General Khumalo and hire General, and replace him with General Khanto that position of Crime Intelligence.”

Brown Mogotsi met Mr Matlala at Sheraton Hotel and Houghton Hotel, pretended to call the Minister, and tried to connect him to open a harassment case at Protea North police station but the case was never registered.

“I met him in Sheraton Hotel next to the Union buildings... I also met him in the other hotel in Johannesburg. I met him twice in the hotel in Johannesburg, the Houghton Hotel. ... He actually tried, because he connected me with some... Protea North. But that case was never registered.”

Mr Matlala was pushed by Brown Mogotsi to open an IPID case regarding assault on his wife during the second raid but did not because his wife refused as she was not assaulted (though poked with rifle causing bruises) and Matlala realized he was being used as a tool against PKTT.

“on the second raid... he is the one also who said I must open a case in IPID. ... the way he was pushing me to open a case in IPID, I figured that this guy and whoever he is working with, they are really fighting with these people from the PKTT, and I am being used as a tool to fight that unit.”

Colonel Padayachee was referred to by a security expert as an enabler attached to Brown-Mogotsi, implying an allegation or negative insinuation.

“We had a security expert... He referred to me as an enabler that is attached to Brown-Mogotsi or similar to Brown-Mogotsi.”

Witness I acknowledges that Mr Mogotsi may have misled the people doing the application and that it was not truly the facts that really happened.

“Brown Mogotsi may be misled the people who were doing the application because it is not truly the facts which really happened”

Advocate Khumalo references evidence led by Advocate Chaskalson supporting Brown Mogotsi’s statements.

In December 2024, Matala referred Brown Mogotsi to a high-ranking police officer known to Witness I, who subsequently met with him, and the officer shared information about an intention to graft a negative finding in respect of the disciplinary hearing against Major General Khan.

“In December 2024, Matala referred me to a high-ranking police officer and I subsequently met him. I knew him as I had conducted an operation with him in the past. He shared information with me of the intention to graft a negative finding in respect of the disciplinary hearing against Major General Khan.”

Witness I does not dispute that Brown Mogotsi said it was Matala who referred him to Witness I and that he subsequently met Witness I.

“No .”

Brown Mogotsi stated that Witness I wanted money relating to a bag, possibly implying cash but did not explicitly say a bag of cash.

“He spoke about something. He said yes, he was talking about a bag. Maybe he implied cash, but he never said a bag of cash.”

Brown Mogotsi said he had to go back to Matala because the person Matala had referred him to was asking for cash, and that Witness I was asking for cash, which led to the discussion about Major General Khan.

“the person Matala had referred him to was asking for cash. Therefore, he needed to go back to Matala to tell him that you were asking for cash. And that is how it came about that discussion about Khan.”

Witness I denies that Witness I was asking for cash and suggests instead that Brown Mogotsi wanted cash himself, alleging that what was asked was to change the statement to facilitate a promotion and a bag (possibly metaphorical). Witness I says Mogotsi put him in a bad light intentionally.

“I will dispute that. Maybe Mr Mogotsi wanted cash himself, because me, what was asked was that I change the statement, they will facilitate I get a promotion and a bag. Maybe Mr Mogotsi, when he related to other people, he puts me in a picture which he is the one who is doing that, because...”

Witness I asserts that in a meeting it was Brown Mogotsi and another CI guy who offered him a bag and a promotional post.

“On the meeting, it is him and the CI guy who offered me a bag and a promotional post.”

The report leads to a domino effect drawing in General Khan, General Khumalo, General Mkhwanazi, Brown Mogotsi, and the Minister's Office, through processes involving interference and influence, ultimately contributing to the Commission itself.

“The recommendations in your report are what leads to General Khan being charged...General Khumalo getting involved...General Mkhwanazi getting involved...Brown Mogotsi interfering...Minister's Office getting involved...part of the dots that lead to this Commission.”

Witness met Brown Mogotsi, a businessman who reports irregularities in the North West and is perceived as a knowledgeable source, surrounded by rumors of illegal conduct in North West province.

“I first met Mr Mogotsi during 2020 around Rustenburg as a source who gave information about illegal conduct and practices around the North West. He was said to be a businessman who knows a lot of things and frequently reports irregularities within the North West Province.”

Witness was never given illegal conduct reports on North West by Brown Mogotsi and never ran any operations with him.

“No, this is just malpractice within the North West province. No, I have never run any operations with him.”

Witness met Brown Mogotsi in person for the first time in 2020 but did not communicate with him beyond seeing him.

“I saw him in 2020. It is like the first time seeing him, it was that day. But I never communicated with him.”

On 29 January 2025, Witness met Brown Mogotsi and a CI member at a meeting facilitated by Mr Vusi Matlala through Warrant Officer Faleni Zungu, who is now Captain and was a DPCI member.

“On 29 January 2025, I met Mr Mogotsi and CI member. The meeting was facilitated by Mr Vusi Matlala through Warrant Officer Faleni Zungu, now Captain. Captain Zungu was a member of DPCI but now moved.”

At the meeting, Witness found Brown Mogotsi and CI member and suspected something sinister was about to happen.

“At the meeting in the hotel, I was directed to go by the couches next to the reception of hotel. I was surprise to find it was Mr Brown Mogotsi and CI member. I also know the CI member as we worked together at the DSOS scorpion before it was disbanded. I immediately suspected something sinister to come out of this meeting.”

Brown Mogotsi falsely alleged participation in the Sun City operation; the witness only briefed him on the case and corruption in his province.

“Brown Mogotsi alleged he participated in this operation at Sun City, which he was not. I only briefed him of the case and corruption in his province”

Mr. Mogotsi denies ever being an undercover agent or having a record as one in the South African Police Service databases.

“Mr Brown Mogotsi ... has never been in our program as an undercover agent and there are no records that indicate that Mr Mogotsi was ever an agent. ... Mr Brown Mogotsi was never employed or enlisted in the South African Police Service. His name does not reflect on the record system of the South African Police Service. I therefore deny that Mr Brown Mogotsi was ever an undercover agent of the South African Police Service.”
