There was suspicion and investigation into the changing of exhibit bags involving Warrant Officer Morriss and Captain Nortje, because of discrepancies between forensic reports and statements.

“We noticed the drugs were removed from Booysens and later were at Pretoria College, with rumors of drugs stolen; wanted a separate investigation on the changing of exhibit bags.”

Assistant Director Maphosho posed detailed questions to General Khan concerning the crime scene attendance, knowledge about the crime scene, the complaint, roles in the investigation, arrest at Booysens on case CAS 98/7/2021, charges against the suspect, information about the truck driver and cargo receiver, the origin of the drugs, and the outcome of case Booysens CAS 8/7/2021.

“On or about 9th July 2021 , did you attend the crime scene at Aeroton ? ... What was the role at the crime scene and throughout the entire investigations ? Who effected the arrest at the scene of Booysens on CAS 98/7/2021 and what was the charges brought against the suspect and what informed the charges ? ... Was the origin of the drugs ever established during your investigations ? What happened to the case in question , Booysens CAS 8/7/2021 ?”

On 2021-07-09, during the investigation of Booysens CAS 98/07/2021, Colonel Nkoana Joseph Sebola confiscated the cellular telephones of Marumo Magane, Boy Steve Phakula, Samuel Mashaba, and Tumelo Nkuas as part of the investigations.

Warrant Officer Magane says that during conversations with Chief Mashaba and Booysens, there was no mention or agreement to leave the scene before processing the scene and that conversations only concerned the detention and booking of the exhibit.

“there is nowhere in our conversation between myself, Chief Mashaba, and the Booysens, there was nowhere I said or we said we are leaving. The only thing that we said, it was, we were talking about the detention of the suspect and the booking of the exhibit.”

Warrant Officer Magane admits that before the arrival of the Booysens they did not create any cordon at the crime scene.

“With the assistance of the Booysens . ... No , t h a t w a s n o t d o n e . ... Yo u h a d n o t c r e a t e d a n y c o r d o n a t a l l . ... T h a t w a s n o t d o n e .”

Warrant Officer Magane failed to call all relevant units like LCRC, SANEB, Dog Unit, Forensic Lab, VISPOL, and Booysens to the crime scene during the drug bust operation.

“You did not call LCRC, you did not call SANEB, you did not call Dog Unit ... You did not try to call the Forensic Lab, you did not call VISPOL, you did not call Booysens, you did not call anyone that is relevant.”

Small tears were discovered in some evidence bags when handed over at the Forensic Service Lab, likely caused by multiple movements of the bags from crime scene to Booysens to College to Forensics.
