General Jacobs reported to the office of the Minister of Police on the progress of the matter every 10 working days.

“I was informed by General Jacobs that he was reporting to the office of the Minister of Police on the progress of the matter every 10 working days.”

General Matlou's department (Internal Audit Risk and Integrity Management) received a request from the Minister of Police on 9 January 2025 initiating an internal audit process.

“And at paragraph 3, General Matlou states that her department, Internal Audit Risk and Integrity Management, received a request from the Minister of Police on the 9th of January 2025 and that is what initiated this process.”

Advocate Johnson recalls having one meeting with the Minister of Police and his Chief of Staff, where the Minister wanted to meet and greet and talked about IDAC, but cannot remember discussing the PKTT with the Minister.

“I recall having one meeting with the Minister and his Chief of Staff, and then there was that second meeting that I had with General Lebeya. The first meeting that I had, from my recollection, the Minister wanted to meet and greet and he talked to me about IDAC. I cannot remember talking to him about the PKTT.”

Advocate Johnson indicates he requested the National Director to advise the Minister of Police not to summon him to any meetings except the Minister of Justice.

“I did indicate to the National Director that she must kindly advise the Minister of Police that he is not allowed to summon me to any meetings. The only Minister who is allowed to summon me to a meeting would have to be the Minister of Justice.”

In a meet and greet meeting, the Minister of Police wanted to know about IDAC, how it works and operates, and briefly discussed IDAC's relationship with the police and stated they get along with the DPCI.

“I recall that as a meet and greet. He wanted to know what we do at IDAC. ... I think we did talk about IDAC's relationship very briefly with the police and I said we all got along together with the DPCI.”

Emails dated 283 and 284 in the record (MK15) were specifically referred to as the complaint from Mr Adams to the Minister of Police, describing opened cases and intercepted dockets and requesting a report to be filed by 4 November 2024.

“... And from Mr Adams. If you look overleaf at 284, ... hastily ask for the Minister to intervene and ensure the integrity of investigative processes. ... if you go back to 283, then we see communication from Mr Nkabinde to Major General Sebola, referring this complaint and requesting a report be filed with the Minister or the Minister's Office by Monday, the 4th of November. ...”

Emails on 1 November 2024 triggered a flurry of activity culminating in urgent requests to deal with a complaint and to provide a report by 4 November regarding interference matters raised by Honourable Adams at 8:00 in the morning.

“So our next date is this flurry of activity on the 1st of November triggered by Honourable Adams' complaint to the Minister at 8.00 in the morning ... engage the province directly ... urgent request to deal with”

Potential conflicts of interest among senior management in the South African Police Service (SAPS) are identified and reported annually by the Public Service Commission, with around 30 cases reported each year.

“In the Parliamentary questions, there is this response where the acting Minister of Police mentions, I believe every year it was around roughly 30 changes, potential conflicts of interest that were reported by the Public Service Commission among the senior management service.”

Draft questions to the Minister of Police inquire about any relationship with convicted druglord Timmy Marimuthu and alleged discussions involving Crime Intelligence and removal of General Jacobs as Head of Crime Intelligence.

“Questions to Minister of Police ... Do you have any relationship with convicted draglord Timmy Marimuthu ... discussed Crime Intelligence matters ... removal of General Jacobs as Head of Crime Intelligence?”

General Mkhwanazi's complaint of interference by the Minister of Police dates back to 2011, during which he unlawfully complied with ministerial interference.

“interference by the Minister of Police , is something that happened way back in 2011 , at which time General Mkhwanazi elected to unlawfully comply with said Ministerial interference”

Cedric Nkabinde was dismissed or resigned from IPID and then became Chief of Staff for the Minister of Police.

“It is the same Cedric Nkabinde who was subsequently dismissed or resigned from IPID and subsequently surfaced as the Chief of Staff for the Minister of Police”

Two Crime Intelligence officials placed in IPID by the Minister of Police managed investigations but absconded from IPID after Robert McBride was reinstated and returned to Crime Intelligence.

“These two officials absconded from IPID and never came back. They went back to Crime Intelligence... placed by the Minister of Police”

General Mkhwanazi colluded with illegal interference by the Minister and President in relation to the Freedom Under Law litigation to cover up executive interference in SAPS, which he knew was unlawful.

“General Mkhwanazi's collusion with the illegal interference of the Minister and the President is even more stark... he assisted to cover up the executive interference in the SAPS, which he knew to be unlawful”

General Mkhwanazi stated in Parliament that the decision to withdraw charges was made on or dictated by higher authority but never specified that the higher authority was the Minister of Police, resulting in criticism for lack of transparency.

“General Mkhwanazi had already said in Parliament that he made the decision on higher authority or it was dictated by higher authority ... He did not say the higher authority is the Minister.”

There was a cover-up because General Mkhwanazi was asked what higher authority instructed the withdrawal of charges but refused to answer, implying concealment of the Minister's role.

“At the Parliamentary Committee, it was asked what higher authority? He could not answer. He should have said the Minister of Police instructed me. Instead, he covered the thing up.”

Lieutenant Dramato authored a letter dated 23 April 2012 that relates to a meeting chaired by Advocate Hadebe at police headquarters concerning interference by the Minister of Police.

“At the bottom of 363 is paragraph 39 that gives a date on 23rd April 2012, Lieutenant Dramato authored a further letter ... he says: 'Interference by the Minister of Police' ... I chaired this meeting at the police headquarters.”

General Mkhwanazi did not disclose knowing of an unlawful instruction from the Minister of Police until 8 years later, despite frequent media coverage and court proceedings.

“the only time this comes out is here, 8 years later. It never came out before then, never.”

Mr. O'Sullivan states that during the period when President Zuma was in power, the Acting Commissioner would have known that for their affidavit to be truthful, he would have had to state he received an instruction from the Minister of Police to reappoint General Mdluli.

“he would have had to say ... he got an instruction according to his version ... from the Commissioner, from the Minister of Police to reappoint General Mdluli”

Police protocols require that the person in charge of the crime scene, regardless of rank, must be obeyed, and failure to follow protocol by members must result in consequence management.

In 2013, Phakula transferred to National Investigation Unit at Head Office Pretoria focusing on high-profile cases determined by top police and political leadership.

“In 2013, I was transferred to the National Investigation Unit at Head Office in Pretoria. My duties included investigation at national level of blue light robberies, airport following robberies, head office enquiry files, and high-profile cases as determined by the Minister of Police, the Deputy Minister of Police, the National Commissioner, the Deputy National Commissioner, and the Divisional Commissioner, and the political leaders.”
