Major Phiri confirms knowing Mr Bonzo Eugene Modise, who was a director of Triotic Protection Services before becoming Deputy Mayor, and knows him from Mabopane and Tshwane.

“I know him as a Deputy Mayor , as a Regional Chair of the ANC . I grew up in Mabopane , Winterveld . I know him from Mabopane and when I came to work in Tshwane , I met him here . He was not a Deputy Mayor . He was not a Chair . He was a director of a company called Triotic Protection Services then before becoming the Deputy Mayor .”

Major Phiri has no business relationships with Bonzo Modise except managing his presence at Triotic Protection Services director meetings when Modise was there.

“I have never had , unless managing when he was still at Triotic , coming to director 's meetings and stuff , and then we meet there .”

Deputy Chief Dhlamini denies having any interest or relationship with multiple named companies or their shareholders/directors, including Gubis 85 Solution, Ngaphesheya Construction and Project, Triotic Protection Services, Two Cop Security Services, Vimtsiri Security and Protection Services, and Elshadai Security Services.

“I do not have any interest or relationship, whether directly or indirectly ... with any of their shareholders or directors.”

Ad hoc security services were deployed by the division Assets and Protection for three companies: Triotic Protection Services, Mogalagadi Security Services, with the amount for two companies being 2.8 million.

“these were ad hoc services that were deployed by the division Assets and Protection for three companies, Triotic Protection Services, Mogalagadi Security Services, which for two companies it amounted to 2.8…”

Triotic Protection Services is an entity appointed by the City under TMPD 2, 2016-2017, currently rendering guarding services to the city.

“the entity is one of the entities that are appointed by the city in terms of TMPD 2, 2016-017. And it is currently rendering guarding services to the city”

During evaluation at the BEC, Triotic Protection Services was recommended for appointment among other bidders for TMPD 2, 2016-2017.

“all the bidders including Triotic, I think, they were recommended”

Triotic Protection Services is linked to Mr Eugene Modise.

“Are you aware that that company is linked to Mr Eugene Modise?”

Director Malatji became aware that Triotic Protection Services is linked to Mr Eugene Modise only as the inquiry progressed, not at the time of evaluation.

“At that time, I was not aware. I became aware after - I became aware as we went on, you know, as we went along, that it is linked to Mr Eugene Modise, right.”

According to a News24 article, Triotic Protection Services had lucrative security contracts at ANC Madibeng Municipality in the northwest and Lephalale as of February 2023, with Modise as sole director and shareholder until that time.

“New News 24 has established that Triotic Protection Services , in which Modise was the sole director and shareholder until February 2023 , has got lucrative security contracts at the ANC Madibeng Municipality in the northwest and Lephalale .”

Director Malatji is not certain about the exact directorship documents for Triotic Protection Services at the time of tender evaluation due to passage of time.

“Since this has happened some years back, I would not with certainty say the documents, more especially CIPR documents that were submitted, right, indicated whether he was the sole director or there was somebody else, right. I would not with certainty say that”

Director Malatji accepts that he cannot dispute with certainty that Mr Modise was linked to Triotic Protection Services at the time of the tender.

“I would not be able to dispute it with certainty”

According to a news article, Mr Modise at the time of the tender award was secretary of the ANC in the Tshwane region since 2018, implying he was in the service of the state at that time.

“When the Tshwane Council awarded Triotic , the contract in February 22 , Modise was secretary of the ANC in the Tshwane region , a position he has held since 2018 .”

Director Malatji agrees that if Mr Modise was in the service of the state at the time of the tender award, Triotic should not have been appointed.

“If one assumes that , just to follow the caution from Commissioner Baloyi , Mr Modise was in the service of the state , would you agree that , or anyone , for example , who is a director , would you agree that he ought not to - Triotic would not have been appointed ? I agree .”

Three named companies, Gubis 85 Solutions, Izingwenya 210 Investments, and Triotic Protection Services, will commonly feature in the stream of TMPD due to suspicions of syndicate or cartel interference.

“These are the companies that will be forming the subject matter of our discussion... especially where there is a suspicion of interference by syndicate or so-called cartels... The first three, namely Gubis 85 Solutions, Izingwenya 210 Investments, Triotic Protection Services.”

The January annexure lists companies, sites of deployment, and payments excluding and including VAT made to them, indicating normal payments for ad hoc security by two companies and a larger number of deployments by a third company, Gubis 85 Solutions Security.

“So , this list that Commissioner Dhlamini then submitted to me , it listed the companies on the left - hand side , the sites where they have been deployed to , and then the amount , excluding and including VAT , that have to be paid to these service providers . The first two companies are Triotic Protection Services , who has been deployed to Klipgat Wastewater Treatment Works ... Then the next one for January is Mogalagadi Security ... The third company in the ad hoc services is Gubis 85 Solutions Security , which then lists a total of 37 deployments ...”

Triotic Protection Services is associated with Mr Modise, the Deputy Mayor.

“Triotic is a company group associated with Mr Modise, the Deputy Mayor”
