Director Malatji became aware that Triotic Protection Services is linked to Mr Eugene Modise only as the inquiry progressed, not at the time of evaluation.
“At that time, I was not aware. I became aware after - I became aware as we went on, you know, as we went along, that it is linked to Mr Eugene Modise, right.”
According to a News24 article, Triotic Protection Services had lucrative security contracts at ANC Madibeng Municipality in the northwest and Lephalale as of February 2023, with Modise as sole director and shareholder until that time.

Director Malatji accepts that he cannot dispute with certainty that Mr Modise was linked to Triotic Protection Services at the time of the tender.

According to a news article, Mr Modise at the time of the tender award was secretary of the ANC in the Tshwane region since 2018, implying he was in the service of the state at that time.
“When the Tshwane Council awarded Triotic , the contract in February 22 , Modise was secretary of the ANC in the Tshwane region , a position he has held since 2018 .”
Director Malatji agrees that if Mr Modise was in the service of the state at the time of the tender award, Triotic should not have been appointed.
“If one assumes that , just to follow the caution from Commissioner Baloyi , Mr Modise was in the service of the state , would you agree that , or anyone , for example , who is a director , would you agree that he ought not to - Triotic would not have been appointed ? I agree .”
There is uncertainty whether Mr Modise was a counsellor or an employee of the state at the time of the tender award in 2022.
“was he or was he not a counsellor or an employee of the municipality ? Because if he was not , then as Commissioner Baloyi suggests , it is questionable whether we should be entertaining this line of questioning . Unless it can be put to Director Malatji that he was in fact an employee and therefore he should not have participated in the tender .”
