Captain Zungu warned Witness I the attackers may return and suggested temporary relocation and arranged a house for Witness I, which belonged to Mr Matlala.
“Captain Zungu warned that I was injured and that the group may come back and finish the job. He then suggested that I relocate temporarily and that he will arrange a house for me...property belonged to Mr Matlala”
Witness I did not meet or communicate directly with Mr Matlala during his stay at the property, only via Captain Zungu and Brigadier Mokoena later.
“During my stay, I did not meet or talk to Mr Matlala...I have had no direct communication with Mr Matlala until I met him with Captain Zungu and Brigadier Mokoena”
Witness I received a call or was informed by Captain Zungu that individuals wanted a meeting with him, and Mr Matlala did not play a direct role but the call came from Captain Zungu.
“you received a call, or at least you were informed by Captain Zungu that individuals would like to have a meeting with you. Mr Matlala did not play a direct role, instead you were called by Captain Zungu.”
The witness denies having any direct contact or relationship with Mr Matlala and states that Captain Zungu was the one who informed him about the meeting facilitated by Mr Matlala.
“No I would say it is a lie because I never spoke with Mr Matlala, I only spoke with Captain Zungu for the day, even my reason going there.”
On 29 January 2025, Witness met Brown Mogotsi and a CI member at a meeting facilitated by Mr Vusi Matlala through Warrant Officer Faleni Zungu, who is now Captain and was a DPCI member.
“On 29 January 2025, I met Mr Mogotsi and CI member. The meeting was facilitated by Mr Vusi Matlala through Warrant Officer Faleni Zungu, now Captain. Captain Zungu was a member of DPCI but now moved.”
Captain Zungu called Witness to say people want to consult Witness regarding a matter involving General Khan, but did not disclose who they were.
“Captain Zungu called me and said there are people who want to consult with you in respect of a matter. I am a witness to involving General Khan. I asked who the people are which he did not disclose and where can I find them? Captain Zungu said they are at Houghton Hotel in Sandton as we speak and I can find them there.”
Brigadier Mokoena tried to extort Mr Vusi Matlala using Witness I and Captain Zungu, refusing Witness I's request to meet the source relating to a high-profile John Wick scene.
“After the John Wick scene, Brigadier Mokoena claimed the scene was a hit. He asked me and Captain Zungu to call Cata and we met at Corbin Golf Shooting Range. Brigadier Mokoena said he heard a source or a complainant from General Lebeya's office which had evidence to the fact that the John Wick scene was a hit and Brigadier Mokoena wanted to consult Mr Matlala to see how he can fix this. By fixing it meant that Mr Matlala paid something so Brigadier Mokoena can give to the source in order to keep the source quiet.”
Brigadier Mokoena refused Witness I's request to meet the source involved in the John Wick scene and claimed the case was top secret between him, National Head General Lebeya and the source; Witness I and Captain Zungu were being used in an extortion attempt against Mr Matlala.
“At the meeting, I asked Brigadier Mokoena if we could have a meeting with the source and get more details and facts. Brigadier Mokoena refused the request. He said I cannot consult with the source as it is a high-profile matter of top secret dealt with between him, National Head General Lebeya and source. I noted that this is a non-existent as by then Brigadier Mokoena did not have top secret clearance and observed me and Zungu are just being used in an attempt to extort money from Mr Matlala.”
Sergeant Nkosi responded to Mr Mnisi's draft letter with 'Send. We just saw it now. I am with Zungu,' indicating consultation with Warrant Officer Zungu at the Hawks.
“You responded to him : “Send . We just saw it now . I am with Zungu .” So , in fact , you were speaking to Warrant Officer Zungu , who is in the Hawks , together this advice also on how it would be appropriate to respond to this letter from the Hawks .”
Sergeant Nkosi received information from Warrant Officer Zungu that suspects involved in a murder in Vereeniging were known to Mr Mthakathi.
“they are on their way to the scene of crime where one white African male was murdered. And it is alleged that the people who committed that particular murder, they are known to Mr Mthakathi.”
Sergeant Nkosi phoned Mr Mthakathi to inform him about suspects known to him being arrested in relation to the murder in Vereeniging, but Mr Mthakathi did not initially provide names.
“I phone Mr Mthakathi and informed him that I heard that there are people that you know that have committed murder in Vereeniging. Then Mr Mthakathi said to me, who are those people that committed? I then went back to Warrant Officer Zungu... They did not give me a name”
Warrant Officer Zungu was at the scene or on the way from the DPCI when he contacted Sergeant Nkosi.
“At that time, he was still in DPCI... Warrant Officer Zungu told me that, I cannot remember if they were already at the scene or still going to the scene”
Mr Mthakathi was not helping Sergeant Nkosi with the investigation but there was an exchange of information between them initiated by Sergeant Nkosi after a call from Warrant Officer Zungu.
“Mr Mthakathi was not helping me with investigation. I was not asking him for information. It was exchange of information between myself and Mr Mthakathi. I initiated after I received a call from Mr Zungu”
Warrant Officer Zungu asked Sergeant Nkosi to check with Mr Mthakathi if he knew about the arrested persons linked to murder allegations.
“Check with him. I think something like of sorts was discussed there of hey, check, I heard one of the people that known to Mr Mthakathi are arrested, can you confirm?”
Warrant Officer Zungu wanted Sergeant Nkosi to confirm if Mr Mthakathi knew the suspects allegedly from Atteridgeville who were arrested in relation to a murder.
“Can I confirm if he knows those people because it is alleged that they are from Atteridgeville and they are known to Mr Mthakathi. So I must confirm with Mr Mthakathi if are there such people.”
Danny was confirmed to have been arrested and the case numbers were sent to Warrant Officer Zungu as confirmed by Mr Mthakathi.
“up until Mr Mthakathi phoned me and said, indeed, it is confirmed that Danny has been arrested. And then he sent me the case numbers. It confirmed to Warrant Officer Zungu that indeed, these people were arrested.”
Sgt Nkosi received ID numbers from Mr Mthakathi to confirm the identity of the arrested person named Danny; Warrant Officer Zungu confirmed the ID was correct but did not himself give the name Danny to Nkosi.
“It was the ID number, Commissioner, by Mr Mthakathi. So, Warrant Officer Zungu did not tell me it was Danny. Only it is Mr Mthakathi himself who told me it is Danny. He just received a call it is Danny.”
Sgt Nkosi sent Warrant Officer Zungu's contact number to Mr Mthakathi so that Mr Mthakathi could contact Warrant Officer Zungu directly for confirmation of information.
“The reason that I sent Warrant Officer Zungu's number to Mr Mthakathi, I felt that it was back and forth. Mr Mthakathi's and then Zungu decide, Mr Mthakathi is said the person who has got this information, is Warrant Officer Zungu, phone him.”
Mr Mthakathi contacted Sgt Nkosi more often after getting information from Warrant Officer Zungu about Danny's arrest to get confirmation.
“Now, that is why now you see Mr Mthakathi calling me more often, then I call Zungu more often, then Mr Mthakathi comes back to me and say, I just received information that it was Danny. Any you confirm ?”
Warrant Officer Zungu confirmed to Sgt Nkosi that the ID number given by Mr Mthakathi belongs to the person named Danny.
“They said it is Danny, can you confirm ? Because they said it is Danny, and the ID number is here. Can you confirm that it is Danny ? Can you confirm it is Danny ?”
Sgt Nkosi called Warrant Officer Zungu to confirm whether the ID given by Mr Mthakathi corresponds with Danny, and Zungu confirmed it was correct.
“I did nothing, I called the Zungu again. They said it is Danny, can you confirm ? Because they said it is Danny, and the ID number is here. Can you confirm that it is Danny ? Can you confirm it is Danny ?”
Sergeant Nkosi confirmed having calls exchanged between Mr Mthakathi and Warrant Officer Zungu after giving contact details to Mr Mthakathi, but cannot remember if they spoke before receiving the details.
“After you send him Mr Zungu's contact details, you do have a conversation with Mr Mthakathi... I cannot remember.”
Sergeant Nkosi sent CCTV footage of a murder to Warrant Officer Zungu without immediately notifying Mr. Mthakathi Mswazi, who had access to the footage.
“You opened the footage, forwarded it to Warrant Officer Zungu, but did not call back Mr Mthakathi Mswazi until almost an hour after you had forwarded it to Warrant Officer Zungu.”
Warrant Officer Zungu was not the investigating officer for the case but was responsible for informing Sergeant Nkosi about the CCTV scene and making enquiries on the ground.
“Warrant Officer Zungu was not an investigating officer. Warrant Zungu happens to be the one who informed me about this particular scene, making enquiries, as I have mentioned earlier. ... Warrant Officer Zungu is an operator. He works on the ground. Time and again we share information, not that maybe it was this particular one that was shared ...”
Sergeant Nkosi forwarded CCTV footage to Warrant Officer Zungu at 14:57 on the same day he opened the file, implying he had viewed the footage by then.
“at 14:57 you forwarded the CCTV footage to Warrant Officer Zungu”
Sergeant Nkosi forwarded a video related to the file to Warrant Officer Zungu without explanation, only sharing it as part of their communication.
“I sent it to Warrant Officer Zungu. Remember, he was the one who had knowledge about this. So, it was our communication... Then I shared it with him.”
Sergeant Nkosi denies that Mr Mthakathi Mswazi was giving him the ID number to confirm with Warrant Officer Zungu and asserts that he was given the ID for another purpose.
Sergeant Nkosi did not communicate again with Warrant Officer Zungu because he felt it was no use since he had already given Mr Mthakathi Mswazi the number of Warrant Officer Zungu for communication.

The purpose of Mr Mthakathi Mswazi giving Sergeant Nkosi the name and ID number at 09:59:58 PM was so that Sergeant Nkosi could convey it to Warrant Officer Zungu to confirm the person in custody was the person known by Mr Mthakathi Mswazi.
Sergeant Nkosi stated that after Mr Mthakathi Mswazi sent him the ID number to confirm the arrested person, he assumed Mr Mthakathi Mswazi would communicate with Warrant Officer Zungu and thus did not follow up.
“At that time , I repeat again , Mr Mthakathi sent me the ID number . He said he just received a call that indeed this people were arrested , I must confirm with Warrant Officer Zungu that is indeed this person . That is when he sent me the ID . So to me , I then said , because I have already sent the Warrant Officer Zungu 's contact number , he was going to communicate with him . That is the reason after he sent that thing , I just kept quiet .”
Sergeant Nkosi did not think it was prudent to check with Warrant Officer Zungu that the suspected murderer had the correct identity, leaving it to Mr Mthakathi Mswazi to convey the information.
Sergeant Nkosi was content to leave it to Mr Mthakathi Mswazi to give information to Warrant Officer Zungu about the arrested person without personally verifying the identity.
Sergeant Nkosi explained that the presence of TOMS and Warrant Officer Zungu at the scene justified why Warrant Officer Zungu needed to check the details of an arrested person.
“It is because of TOMS was there or on their way there . But the bottom line is TOMS and Zungu , they were there .”
Sergeant Nkosi claims he was with Captain Zungu and General Sibiya when he received a call, and maintains the words that he had pressure from the Deputy Minister.
“When he called, I was with Captain Zungu in a vehicle and General Sibiya was on speaker. I still maintain the words. He said that.”
The six tickets for the concert included three VIP tickets and three general admission tickets allocated among Sergeant Nkosi, Captain Zungu and three other members from the tracking team.
“Captain Zungu, the one that I was with, and three other members from the tracking team that we found there. That is correct.”
Mr Khawula was not present at the Kroon Park Holiday Resort concert where six policemen from Gauteng attended an operation in Kroonstad.
“the tickets for the concert where you failed to find Mr Khawula ... the concert was held at Kroon Park Holiday Resort ... So this operation took six policemen from Gauteng to Kroonstad ... With the possibility of a seventh , the investigating officer . ... It was never ever intended for the investigating officer to be there ... No , no , no , it was . It was intended ... So , he was recently appointed now in our office ... So , at the time of this operation , he was now in your office ? ... That is correct .”
Sergeant Nkosi confirms that when he went to Kroonstad to execute the warrant with Captain Zungu, he had those other warrants related to organised crime, attempted murder, and failure to appear in court on his phone.
Lt-Gen Shibiri informed investigators about the names of persons present at court who might know suspects to facilitate the investigation and confirmation of information received from a source.
“The people I told them the names, which I thought they might know, is that one which I was told by the source to say there is a Zungu from Toms, there is a Johnny from JMPD, an unknown lady from Johannesburg. Because they were there at court, I thought they might have seen them and know them and confirmed the information to me.”
