In litigation involving President Zuma's medical certificate, the contest was over the validity of the medical certificate used to excuse him from another Commission, which had to be impugned first before excusing the witness from giving evidence.

Lieutenant Colonel Sibiya states that after the meeting with the depot managers, they were accompanied by a lady who introduced herself as Mrs Pillay and showed them the container which was stacked with other containers on top and had container numbers to distinguish it.
“They came back with a lady, I think. She introduced herself as Mrs Pillay and other people that were accompanying them. And then she pointed at the container that we were interested in, but the container was stacked with other containers on top. They have got the container numbers, so that they used to distinguish which container is this.”
Ms Pillay's statement on 6 July 2021 corroborates that members and an unnamed official from Mega Freight were present at the container depot on 1 July 2021.
“On the 1st of July these members were present and an official from Megafreight was present, unnamed.”
Colonel Jacob admits he did not take the Mega Freight agent's statement, confirming he took Ms Pillay's statement instead.
“Yes, I did not.”
Colonel Jacob notes that Ms Pillay's second statement references his visit on 22 June 2021 but not the visit on 1 July 2021.
“And in this statement she says it is a further statement. She references the one we just went through. No. She speaks of your visit on the 22nd of June 021, and that is at paragraph 3. You see that?”
Neither Ms Pillay nor Tim Floweday mention the 1 July unpack incident, only COLONEL JACOB's statement mentions it, possibly prompted.
“how come Ms Pillay says nothing about it? How come Mr Floweday says nothing about it? They both say nothing about it and the only place that Ms Pillay says anything about the 1st of July is in the statement taken by you”
Warehouse manager Ms Pillay and other warehouse staff were present during the operation that included DPCI members and Captain Duma from Crime Intelligence.
“at the end, where we land is the only people who were present in this operation were the DPC members, led by yourself, and Captain Duma from Crime Intelligence. And warehouse staff. Not only Ms Pillay, some other warehouse staff as well. But the manager was Ms Pillay.”
Lt-Col Duma did not interact directly with the ORS or his Commander at the time regarding the container; his interaction was with Ms Pillay and the DPCI.
