Colonel Jacob alleges that he was present during the exercise at the CHC container depot on 1 July 2021, contrary to a statement by a Mega Freight agent who says he was not there.
“I am saying, you have about five, six statements in the inquiry and in the docket which are all before this Commission. None of them references that activity.”
Colonel Jacob denies fabricating or imagining the presence of the Mega Freight agent at the scene.
“Did I fabricate or did I imagine him?”
The Mega Freight agent states in his 2025 statement that he was not aware of the inspection allegedly taking place at the CHC container depot on 1 July 2021 because he was not informed.
“At page 654 the same person, that Mega freight agent, at paragraph 3 states: "I was not aware of the inspection that allegedly took place at the CHC container depot on the 1st of July 2021 as I was not informed."”
ADV SELLO SC says Colonel Jacob did not take the statement of the Mega Freight agent present on 1 July, despite relying on other statements and Ms Pillay's statements.
“Yet that is one person you never took a statement from.”
Ms Pillay's statement on 6 July 2021 corroborates that members and an unnamed official from Mega Freight were present at the container depot on 1 July 2021.
“On the 1st of July these members were present and an official from Megafreight was present, unnamed.”
Colonel Jacob admits he did not take the Mega Freight agent's statement, confirming he took Ms Pillay's statement instead.
“Yes, I did not.”
ADV SELLO SC stated that the Mega Freight agent was approached and provided a statement earlier in the investigation, but Colonel Jacob says that the agent was not asked about the 1 July visit and that his statement does not mention it.
“For the record, the agent was approached and he provided a statement. We dealt with it earlier... But he was not asked... Was he asked about the 1st of July? His statement tells me nothing about the 1st of July.”
Colonel Jacob said the statement taken on 27 October 2025 was taken by the same investigator which likely caused confusion about the date of the inspection at the container depot; the Mega Freight agent said he was not aware of an inspection on 1 July 2021.
“I feel he was confused maybe about the day of the search... This was taken in 27 October 2025... He is talking about... I was not aware of the inspection... on the depot on the 1st of July...”
