General Phahlane

Senior SAPS members implicated in corruption matters included Acting National Police Commissioner General Phahlane, General Ngwenya, General Nematunzela, and various other senior SAPS officials.

“The accused in those matters included, amongst others, then Acting National Police Commissioner General Phahlane, General Ngwenya, who was our first black female Deputy National Police Commissioner in the SAPS, and also at the time, the wife of Lieutenant-General Shadrack Sibiya, General Nematunzela, who was the Head of Analysis at Crime Intelligence, and various other very senior SAPS officials.”

There are current IDAC matters involving General Phahlane and others, based on section 27 referrals from SAPS, which are either part-heard or set down for trial but not yet finalized.

“The ones in IDAC currently are matters that are either part heard or matters set down for trial. They are not finalised yet.”

The senior members of SAPS implicated in those matters included then Acting National Police Commissioner General Phahlane, General Ngwenya (first black female Deputy National Police Commissioner), General Nematunzela (Head of Analysis at Crime Intelligence), and various other very senior SAPS officials.

“The accused in those matters included, amongst others, then Acting National Police Commissioner General Phahlane, General Ngwenya, who was our first black female Deputy National Police Commissioner in the SAPS, and also at the time, the wife of Lieutenant-General Shadrack Sibiya, General Nematunzela, who was the Head of Analysis at Crime Intelligence, and various other very senior SAPS officials.”

Feroz Khan was not investigated, while Phahlane was targeted without evidence.

“Why did you not investigate Feroz Khan, but you went for Phahlane, whom you do not have a single evidence of what he has done.”

Mr Hongwemp questioned why Paul O'Sullivan and Sarah-Jane Trent focused investigations on General Phahlane rather than General Khan, despite many allegations against Khan.

“I was probing that when it comes to General Phahlane, they already had proof of the sound system. And he answered, u Paul O’Sullivan, he loves South Africa, that is why he is investigating. So that is why I asked him, as a lover of South Africa, how do you then generate who you want to target, where you see the allegations of General Khan are so many, but you focus on Phahlane? That is the issue.”

O'Sullivan carried out extensive investigations and criminal complaints against General Phahlane between 2015 and 2017, including lodging complaints with IPID and informing national leadership including Cyril Ramaphosa.

“Between 2015 and 2017, I carried out extensive investigations and lodged various criminal complaints against General Phahlane with IPID ... I supplied copies of my criminal complaint to then-Deputy President of South Africa, now-President Cyril Ramaphosa .”

O'Sullivan alleges he was singled out for unlawful acts by corrupt police officials instigated by General Phahlane and senior officers, including multiple arrests, raids, kidnapping, torture, unlawful imprisonment, and attempted proxy murders.

“I was singled out for unlawful action by corrupt police officials at the instance of both General Phahlane and other senior officers . The crimes against me included multiple arrests, multiple raids on my home and offices, kidnapping, torture, unlawful imprisonment, and multiple attempts at murder by proxy .”

General Phahlane is currently on trial on various trials involving corrupt contracts exceeding R500,000,000.

“the evidence will show that he is currently on trial, on various trials, and the sum total of the corrupt contracts exceeds R500000000”

The DPCI judge's report made findings largely concerning the conduct of Major General Mokotedi and recommended action against him to National Commissioner General Masemola, not against General Phahlane.

“The DPCI judge's report makes findings, is in large part concerning the conduct of Major General Mokotedi and makes findings as you have tabulated them at page 14 ... deserves the attention of National Commissioner General Masemola ... was action invited to be taken against Major General Mokotedi and not General Phahlane ... I do not mention General Phahlane.”

General Phahlane was the target of a criminal complaint opened by Mr O'Sullivan, and the conduct listed against him happened to Mr O'Sullivan and others connected to him, driven mainly by Major General Mokotedi acting on instructions from General Ntlemeza and General Phahlane.

“The only thing it is to do about General Phahlane is that all of this conduct happened against me because I opened a criminal complaint against General Phahlane ... but the driving force, according to the DPCI judge's report, was Major General Mokotedi who was acting on the instructions of both General Ntlemeza ... and General Phahlane.”

Mr O'Sullivan opened a criminal complaint against General Phahlane in February 2016 alleging very serious corruption.

“I opened that complaint in February 2016. And in that complaint, I alleged very serious corruption on the part of General Phahlane”

A copy of Mr O'Sullivan's complaint was supplied to General Phahlane instead of being investigated, leading to attacks against him and his staff.

“the complaint I laid was, a copy of it was supplied to General Phahlane instead of the matter being investigated, and that led to the attacks against myself and my staff”

IPID formed a task team to manage Mr O'Sullivan's complaint against General Phahlane, headed by Humbulani Innocent Khuba, now Limpopo Director of IPID.

“IPID formed a small task team, and my understanding is that the task team was headed up by this gentleman Humbulani Innocent Khuba. And he is currently the Limpopo Director of IPID... he was brought to Pretoria because they wanted somebody from outside the province to case manage my complaint against General Phahlane”

General Phahlane attempted to derail investigations through various means including appointing a so-called North West Team led by General Mabula to find dirt on IPID investigators and Mr O'Sullivan.

“there were a number of legs where General Phahlane attempted to derail the investigations into him, and those legs took various forms... One of the forms was the appointment of the so-called North West Team, which was General Mabula and a whole lot of Brigadiers and Colonels. And their job was to try and find dirt on the IPID investigators and myself”

General Mkhwanazi was driving a narrative that the speaker had taken over IPID and was trying to discredit the speaker by sarcastically calling IPID 'OPED'.

“That was being driven by General Phahlane that I had captured IPID... General Phahlane would even go on TV and refer to it as OPED... Very sarcastic”

The Phahlane matter was significant and taking life, possibly implying serious consequence or impact.

“including that the Phahlane, General Phahlane matter was taking life”

General Mkhwanazi was involved in unlawful prosecutable conduct relating to General Phahlane in 2017 and 2018, attempting to prevent investigations and prosecutions.

“unlawful prosecutable conduct of General Mkhwanazi pertaining to General Phahlane relating to offences, I believe, were committed in 2017 and 2018, when General Mkhwanazi was involved in unlawful attempts to prevent investigations and prosecution of General Phahlane”

Cedric Nkabinde was recruited into the Phahlane camp by General Mkhwanazi and provided a sworn statement in a failed High Court case to have charges against General Phahlane dismissed.

“Cedric Nkabinde, he went across to the other side. He left IPID and he went into the Phahlane camp and he was recruited into the Phahlane camp by General Mkhwanazi, and he provided a sworn statement in a High Court case where General Phahlane launched an application to try and have the charges against him thrown out of court, and he failed”

Mandla Mahlangu refused to sign a statement related to Cedric Nkabinde and was subsequently murdered because of it.

“we found out that it was Mandla Mahlangu who had not signed and he refused to sign. Unfortunately, he was murdered because of it”

During the relevant period, there were multiple attempts to derail the IPID investigation against Phahlane by false claims that Paul O'Sullivan was taking over IPID, which were false.

“multiple attempts trying to derail the investigation by IPID against Phahlane, Phahlane was going into the public domain and making these comments that Paul O'Sullivan was taking over IPID, which of course were false comments, absolutely false”

Mr Kistiah is currently on trial with General Phahlane for corruption involving vast sums of money.

“Inbanathan Kistiah is currently on trial with General Phahlane for corruption, involving vast sums of money, millions and millions.”
