SAP 13 register

No SAP 13 register entry was made on the day (22nd) the exhibits were restored at Port Shepstone offices.

There was no SAP 13 register entry on the 22nd and hence a need to return to Port Shepstone the following day to deal with SAP 13 register issues.

Warrant Officer Mpangase justifies the lack of SAP 13 registration upon moving exhibits from Isipingo to Port Shepstone by presuming no necessity to register them in SAP 13 at Isipingo since they were already stored at Port Shepstone.

“I presume because of the fact that we have already stored them in the Port Shepstone, there was no necessity that we register them on SAP 13 in Isipingo – Port Shepstone, by the way .”

Advocate Baloyi asks if at that time Warrant Officer Mpangase did not know that the national protocol requires exhibits to be recorded in SAP 13 and accounted for.

“Does it mean at that time you did not know that the protocol the national instruction requires that exhibits must be recorded in SAP 13 ? They must always be accounted for ?”

Warrant Officer Mpangase made an entry that booked the exhibits out of the SAP 13 register on the basis they were going for analysis, knowing that the investigating officer might not take them for months, making the entry misleading.

“And yet you have made an entry that says, that books them out underlining booking them out of the SAP 13 register ... on the basis that they are going for analysis ... As you sit there, can you ever, ever say that that makes sense? That your entry makes sense?”

Warrant Officer Perumal was approached by Colonel Jacob from DPCI who informed him about the recovery of a huge quantity of drugs from CHC containers in Prospecton, and the intention was to book it into the SAP 13 register, sign for it, and take it away without intending to store it at Isipingo.

“On the 22nd of June 2021, I was approached by Colonel Jacob from DPCI who informed me that they recovered a huge quantity of drugs from CHC containers in Prospecton, and they want to book it into our SAP 13 register and sign for it and take it away.”

All property and exhibits seized must be entered in the SAP 13 register of the relevant police station where the crime was committed or property found, then transferred to the relevant unit and entered in the SAP 13 of that unit.

Without approval as contemplated in SAP 13 sub 1, Port Shepstone DPCI office cannot retain a SAP 13 register.

MAJ-GEN FLYNN has no knowledge that the Port Shepstone DPCI offices have ever been approved to retain such an SAP 13 register.

The exhibits at Isipingo police station were already contaminated unless the colleagues handling them wore gloves, and they were not properly photographed, sealed in exhibit seal bags, or entered into the SAP 13 register, causing risk during transport to Port Shepstone.

An entry in the SAP 13 register dated 2021-06-22 stating 'items taken for analysis' is a false entry as the exhibits were never taken for analysis on that date and instead were moved from Isipingo to Port Shepstone and never submitted for analysis.

“this entry is a false entry, because the exhibits was never taken for analysis on that date. It is completely misleading. Of course, the exhibits went from Isipingo to Port Shepstone and was never submitted for analysis as depicted here”

There was no SAP 13 register at the Port Shepstone police unit to record reception of exhibits, causing booking in to be done via paperwork only.

“... there was no SAP 13 register at the unit in Port Shepstone, and that is why, in order to obtain a reference number for the exhibits, that is why it was just booked in, the paper exercise, at Port Shepstone Police Station.”

At the time officers entered exhibits into the SAP 13 register, the exhibits were not sealed and had no seal numbers.

Officers entered only a description of the exhibits into the SAP 13 register without seal numbers due to the lack of sealing.
