Deputy Chief Spies

Deputy Chief Spies gave an instruction on 12 March to terminate an adhoc appointment and later wrote a letter terminating the services when Mr Malatji stalled.

“Deputy Spies has given evidence before this Commission. He says on the 12th of March, he gave an instruction to Mr Malatji to terminate this adhoc appointment the following morning, the 13th of March. Mr Malatji did not comply with that instruction... when Deputy Spies realised that Mr Malatji was stalling with these terminations ... he then wrote the letter terminating these services.”

Deputy Chiefs Spies and Dhlamini are equals with separate responsibilities; Spies is responsible for APSS and Dhlamini for Support Services and Finance matters.

“They are both Deputy Chiefs and they are equals with separate responsibilities. The responsibilities of Deputy Chief Spies is APSS. The responsibilities of DC Dhlamini is Support Services and Finance matters.”

Mr Mnisi states he needs to ascertain that Deputy Chief Dhlamini is fully aware that Deputy Chief Spies has terminated the services of Gubis.

“Yes, Commissioner. I need to ascertain myself that he is fully aware of that, yes.”

Deputy Chief Dhlamini asserts that contrary to allegations by Deputy Chief Spies, he did not block a report investigating Sergeant Phiri; the report was sent to him in 2025 but only surfaced in March 2026 after inquiries.

“I think I wanted to bring to the Commission that I think, I am not sure whether that was misinformation given to the Commission, no, it was a deliberate effort perhaps to tarnish me in the Commission that I have blocked this report.”

Deputy Chief Dhlamini states that the report concerning Inspector Phiri was actually sent to him by Director Minnaar on 29 July 2025; Deputy Chief Spies did not personally come to him with the report.

“Because Director Minnaar, it was indicated that he reports to me under internal affairs and he came to me to indicate that, I mean, he was given a mandate by the Deputy Chief Spies to investigate Inspector Phiri... On 29 July, he sent the report to say, I am done with the report, this is the report I am forwarding to D C Spies.”

Deputy Chief Dhlamini denies that he blocked a report about Sergeant Phiri; he says the allegation is misinformation as the report was properly managed and he instructs subordinates to execute assigned work even without his personal sanction.

“I wanted to deal with that assertion that it was incorrect, that it was misinformation, that I blocked them in a report seeking to deal with Sergeant Phiri.”

Deputy Chief Dhlamini states he verbally authorized Director Minnaar to forward the report to Deputy Chief Spies; no formal sign-off was required.

“I told him he can forward it, the report is fine.”

Deputy Chief Dhlamini denies exerting influence on the extension of a security tender; intervention was requested by the Chief of Police after the BAC had not approved the extension report presented by Director Nwandule.

“The second assertion which was made by DCS Spies is that I have influenced the extension of the security tender through the CFO. It is incorrect.”

Director Malatji did not stop the deployment of all ad hoc guards despite being given clear instructions to do so from 13 March 2025.

“you are now given a clear instruction that you must stop deployment of all adhoc guards with effect from tomorrow morning, in other words, with effect from the 13th of March 2025 . But you did not do that . You did not comply with this instruction”

The process of oversight was flawed and could have been more hands-on especially with insufficient staff and systems; improvements occurred when Deputy Chief Spies got involved.

“in hindsight, I would say it is and it was a flawed process ...as he continues to involve himself more and more into this space and putting systems in place and instructions ... it is managed in a much better way”

Mr Phiri was acting in a delegated capacity when Deputy Chief Spies was acting as Chief, signing documents with delegated authority.

“But even when they were signing, it was clear that even then he was still acting under delegation, that two-day extension that he received as the Chief.”

Deputy Commissioner Dlamini consults with Deputy Chief Spies to ensure coordination between related departments and the availability of funds for service payments to avoid budget overburdening.

“he is now consulting with Deputy Chief Spies to ensure sister departments... they make funds available so that these services can be paid and we do not overburden the budget”

Commissioner Bolhuis did not respond to the March 12 email flurry as the issue was already escalated to Deputy Chief Spies, who was instructed by the Chief to address it, meaning it was overtaken by events.

“by the time I saw the flurry of emails, was already at a point where the Chief has already given instruction to Deputy Chief Spies to address the matter... I did not respond to the email... it was overtaken already by events”

Deputy Chief Spies was instructed to cancel all ad hoc services, but the instruction did not address the additional sites added in January and February and who authorized them, an issue for Commissioner Bolhuis as supervisor.

“the instruction to Spies is that ad hoc services must be cancelled... it does not talk to what was added in January and February, and who added it and why, which is your issue... Spies issue is cancel all ad hoc services”

Commissioner Bolhuis ceased being caretaker when Spies took over, after which Spies investigated past financial issues including invoices from prior months and gave evidence.

“at that period of time... I was no more the caretaker. Spies has taken over... he looked into that. He gave evidence to that”

Consultative process between Deputy Chief Spies, the department, Group Human Capital Management and political leaders has been established to fast-track the absorption process of security guards.

“Since the appointment of Deputy Chief Spies, there has been a real movement. I do know for a fact I have sat in some of the meetings. There has been consultative process between Deputy Chief Spies, the department, and Group Human Capital Management and political leaders and leaders of the city to fast-track this process”

The Commissioner Bolhuis was informed about a report intended to facilitate the transition of the Asset Property Protection Service (APPS) from the City Manager's Office to the Tshwane Metro Police Department, which report was provided by Paledi Marota, received nine months late on 10 April 2025.

“The Chief of Police, Yolande Faro, testified that when she received an instruction that there has to be a transition of the APPS from the city manager's office to the TMPD's office, that she tasked you to oversee that process... she testified that she received this report, unfortunately, somehow nine months later, and this report came from a lady called Paledi Marota... The correct date would have been the 10th of April 2025... And lastly, on that score, you would have, at least at that stage, when this report came to your knowledge, you would have ceased acting or at least being a caretaker of the SP... That is correct. I already provided a full handover in writing in the month of March to the newly appointed Deputy Chief Spies.”
