Mandla Mgcina

Mandla Mgcina is making calls to the CFO and Sergeant Nkosi sends screenshots of such communications to Deputy Chief Dhlamini.

“missed call and a voice call for five minutes. And then there is a screenshot that the CFO sends of a missed call from Mandla Mgcina to the CFO at 8:55 and two calls between Mandla Mgcina and the CFO at 9:33. And that is what Sergeant Nkosi sends you.”

Deputy Chief Dhlamini did not take into account Mandla Mgcina's calls to the CFO because he never met Mandla Mgcina.

“I never took that into account of Mandla Mgcina because I never met with Mandla Mgcina”

Mandla Mgcina is the person receiving a large part of the proceeds of Gubisi's contracts with the City of Tshwane.

“Mandla Mgcina , the evidence will show , is the one who is receiving a large part of the proceeds of Gubis' contracts with the City of Tshwane”

Mandla Mgcina is the nephew of Mr Sibanyoni, which Deputy Chief Dhlamini was unaware of and says he only heard from counsel.

“Mandla Mgcina is the nephew of Mr Sibanyoni. You were aware of that? I am not aware. I heard it from you. I have never seen him. I have never met him”

Deputy Chief Dhlamini admits he has never interacted with Mr Sibanyoni or Mr Mandla Mgcina, but acknowledges that one of his brothers' businesses interacts rarely with Mr Sibanyoni, who is the big boss of SANTACO.

“That is correct, SC...They do, but very rarely. Remember, Mr Sibanyoni is the big boss for, is it SANTACO now? Ja, I think it is SANTACO now.”

Mr Mnisi denies knowing Mandla Mgcina and characterizes him as an associate of Sergeant Nkosi, whom he met coincidentally and had no common interests with.

“I had nothing to do with him. I had no common interests with him. ... He is an associate of Sergeant Nkosi.”

Mr Mandla Mgcina called Mr M R M N I S I unexpectedly shortly after Gubis were told the only gateway was him.

“out of the blue , shortly after Gubis are told that the only gateway is you , you get two unprecedented calls from Mandla Mgcina”

Mandla Mgcina asked Mr M R M N I S I for a meeting or coffee or a drink but did not explain the reason.

“He was asking me if we could have a meeting , or if we could meet for coffee or a drink.”

Mr M R M N I S I says the call from Mandla Mgcina was out of the blue and unrelated to an outstanding Gubis payment issue, which would have triggered contact from Mr Calvin Mahlangu.

“It was out of the blue for me as well . Had there been an issue on the outstanding Gubis payment , Mr Calvin Mahlangu had direct contact details of mine , he would have called me on that . That is the pure reason why we even had a light moment of this matter . It was purely out of the blue for me .”

Mr M R M N I S I met previously with Mandla Mgcina at a restaurant and exchanged numbers.

“I did give him my evidence that we met at a restaurant , we had some pleasant tries , we exchanged numbers .”

Mr M R M N I S I eventually understood Mandla Mgcina kept raising the matter persistently despite being told twice that it could not be done.

“Hence , I say , Chair , at this point I started to understand as well that he is not saying it in general terms , I see , but obviously he is still touting for the matter to proceed .”

Mr Mnisi confirms he met Mr Mandla Mgcina introduced by Sergeant Nkosi in a social setting coincidentally, exchanged pleasantries, provided contact details on request, but denied any prior meeting, engagement, or interaction of any nature.

“I confirm that I did meet Mr Mandla Mgcina, and I was introduced to him by Sergeant Nkosi. The introduction happened in a social setting and from my, I think, view was entirely coincidental... My interaction with Mr Mgcina was limited to being introduced to him, where we briefly exchanged pleasantries... I reiterate that no meeting, engagement, or interaction of any nature ever took place between myself and Mr Mandla Mgcina, to his or another's intervention.”

Mandla Mgcina is someone known to Sergeant Nkosi from Soshanguve and is a nephew of Mr Sibanyoni.

“He is someone I know from Soshanguve.”

Mandla Mgcina is trying to get hold of the CFO on behalf of Gubis, who has approval from the CFO for this course of action; Mgcina is repeatedly calling the CFO who is not answering.

“The General has had a meeting with Mr Mandla Mgcina in relation to Gubis. He said do not speak to me, speak to the CFO. The CFO has then approved of that course. And now Mr Mgcina is desperately trying on behalf of Gubis to get hold of the CFO. That is what we are seeing.”

Sergeant Nkosi refuses to comment on missed calls of the CFO from Mandla Mgcina.

“I would not comment on the missed calls of the CFO.”

Despite refusing to comment on the missed calls, Sergeant Nkosi admits sending laughing emojis and a message that Mandla Mgcina 'is looking for you'.

“But you did comment at the time. You sent four laughing emojis and the message he is looking for you.”

Sergeant Nkosi says he cannot comment on the missed calls of the CFO but acknowledges that Mr Mgcina is frustrated because the CFO does not answer his phone calls.

“I am saying I am not going to comment on what you said earlier that the General has turned down Mr Mandla Mgcina. Now Mr Mgcina is frustrated. He is calling the CFO and the CFO do not answer his phone. I am saying I cannot comment on that.”

Adv Chaskalson SC alleges Gubis initially was not included on a vehicle priority list dated 25 March but ended up on the tender list after complaints and intervention by Mandla Mgcina with CFO, with instructions from the General to use only the CFO as the official gateway.

“there were seven companies which did not include Gubis ... The General said, do not speak to me, there is only one gateway, it is the CFO ... Mandla Mgcina then started calling the CFO regularly and then lo and behold, Gubis found their way onto the list.”
