Mandla Mgcina is the nephew of Mr Sibanyoni, which Deputy Chief Dhlamini was unaware of and says he only heard from counsel.
“Mandla Mgcina is the nephew of Mr Sibanyoni. You were aware of that? I am not aware. I heard it from you. I have never seen him. I have never met him”
Deputy Chief Dhlamini admits he has never interacted with Mr Sibanyoni or Mr Mandla Mgcina, but acknowledges that one of his brothers' businesses interacts rarely with Mr Sibanyoni, who is the big boss of SANTACO.
“That is correct, SC...They do, but very rarely. Remember, Mr Sibanyoni is the big boss for, is it SANTACO now? Ja, I think it is SANTACO now.”
Deputy Chief Dhlamini denies knowing Sergeant Nkosi or acknowledging that he is a nephew of Mr Sibanyoni.
“I do not know him.”
Major Phiri denies ever discussing anything related to Mr Sibanyoni with Deputy Mayor Bonzo Modise, despite making calls to him sometimes.
“Have you ever discussed anything relating to Mr Sibanyoni? Never.”
Mr M R M N I S I states he has never met, communicated, or interacted with Mr Sibanyoni in any manner and has never had any direct or indirect engagement with him.
“I reiterate that I have never met, communicated, or interacted with Mr Sibanyoni in any manner whatsoever, nor have I ever had any direct or indirect engagement with him.”
Sergeant Nkosi communicated with Mr Sibanyoni and informed him about a meeting scheduled at 4 o'clock, explaining that he was still at the location of the meeting and Mr Sibanyoni responded with "Let me know how it goes."
“on the 30th of April at page 276 you sent the CFO a PIN with the location of Mr Sibanyoni's residence. On 277, you sent him a screenshot of the chats between yourself and Mr Sibanyoni, explaining that you were meeting Mr Sibanyoni at 4 o'clock and saying that you were still there at the foot of that screenshot. And he wanted to know, his response was: “Let me know how it goes.””
Sergeant Nkosi said Mr Sibanyoni's concern to "let me know how it goes" could refer to Nkosi himself or a meeting with the CFO.
“may be he was just referring to me or a concern about me. Let me know how it goes. Maybe there are possibilities that on that day we were supposed to meet with him, the CFO, or not.”
Sergeant Nkosi confirmed Mr Sibanyoni was concerned for him about the meeting.
“he was just concerned for you, knowing that you were having a meeting with Mr Sibanyoni? That is correct.”
Sergeant Nkosi explained that he informed Mr Sibanyoni about his presence at Mr Sibanyoni's house and ongoing communication, which might explain Mr Sibanyoni's chat message "let us see how it goes."
“There are possibilities that maybe on that day I was supposed to meet him, the CFO. So, when I inform him that I am aware I am going because I am used on taking pictures ... So, this is how maybe he was talking to me that let us see how it goes.”
Sergeant Nkosi acknowledged he has a personal and ongoing relationship with Mr Sibanyoni, describing him as a taxi owner and businessman, and denied trying to distance himself from that relationship.
“I would not want to maybe admit putting it like I am trying to downplay the relationship with myself and Mr Sibanyoni. I never had a problem with him...He is a taxi owner he is a businessman. I have got no other relationship...I have never distanced myself ... I have never distanced in terms of the number, whether it is three or four.”
Sergeant Nkosi denied having been with the CFO and Mr Sibanyoni together or discussing Mr Sibanyoni with the CFO in the presence of General Sibiya.
“No...I have never been to General Sibiya together with the CFO...Neither with Mr Sibanyoni...”
Sergeant Nkosi confirmed having discussed Mr Sibanyoni with Mr Mnisi and sharing a video clip of the launching of Mr Sibanyoni's foundation.
“It is not true you have not discussed Mr Sibanyoni with Mr Mnisi ... You have shared a video clip of the launching of his foundation ... You have also told him ... I am at the house of Sibanyoni ... I am still here ... I will let you know how it goes... Yes ... I have discussed with Mr Mnisi about Mr Sibanyoni.”
Sergeant Nkosi exchanged WhatsApp messages with Mr Sibanyoni and Mr Mnisi involving an access code to Centurion Residential Estate for a 4 o'clock meeting on 30 April 2025.
“you send a screenshot of your chats with Mr Sibanyoni to Mr Mnisi ... He sends back an access code to Centurion Residential Estate ...this screenshot is sent on the 30th of April ... you say to Mr Sibanyoni at 18:31: "Kgotsong Sion, I am ready." ... he sent you an access code, entry code, to a residential estate for a 4 o'clock meeting”
Sergeant Nkosi could not recall why he informed Mr Mnisi that he was still at the location of Mr Sibanyoni when he sent the screenshot of the chats.
“I cannot remember as to why did I tell him ... may be myself and Mr Mnisi were supposed to be, or to go somewhere ... then something came up ... then I informed him that this thing has come up, I have to go somewhere”
Sergeant Nkosi could not recall the purpose of the meeting with Mr Sibanyoni at his home on 30 April 2025 and did not have many meetings at that home.
“What was your meeting with Mr Sibanyoni about on the 30th of April 2025? I cannot remember ... Do you have many meetings with Mr Sibanyoni at this home? No ... About how many have you had at this home? One or two, I am not sure”
Sergeant Nkosi sent details of his conversation with Mr Sibanyoni along with the PIN to Mr Mnisi.
“Why would you have sent details of your conversation with Mr Sibanyoni together with the PIN to Mr Mnisi? ... Yes, the PIN and the screenshot”
General Mkhwanazi requested Sergeant Nkosi to arrange a meeting with Mr Sibanyoni to make inquiries regarding specific allegations.
“Fannie, can you arrange a meeting with Mr Sibanyoni? We need to make enquiries about this”
Sergeant Nkosi was tasked with setting up a meeting with Mr Sibanyoni related to allegations brought by the Msibi family and he did so.
“Did you set up the meeting with Mr Sibanyoni? That is correct.”
Mr Sibanyoni was a friend of Mr Msibi but they were not on good terms before Mr Msibi died.
“Remember now, Mr Sibanyoni was Mr Msibi's friend. So on those basis, I knew him. ... It is because before Mr Msibi died, they were no longer in good terms, they were fighting.”
Mr Sibanyoni expressed condolences in relation to the death of Mr Msibi in a chat with Mr Mandla Gcaba, which Sergeant Nkosi saw.
“That is correct. ... He did express condolences in relation to the death of Mr Msibi. He did, Mr Sibanyoni.”
Sergeant Nkosi regularly communicated with Mr Sibanyoni while monitoring the status of Mr Msibi's taxi, which was stopped by queue marshals and refused passengers loading.
“His taxi will be stopped by the queue marshals and then they will refuse him to load the passengers and then he will phone me and I will go back to Mr Sibanyoni and inform him ... I was regularly communicating with Mr Sibanyoni on those bases.”
General Mkhwana requested Sergeant Nkosi to intervene in a case between two families owning taxis because he knew both families and trusted Nkosi could broker peace.
“when General Mkhwana made that request to you ... he knew that I knew Mr Sibanyoni and I knew Mr Mswazi because I once introduced Mr Sibanyoni to General Mkhwanazi”
Mr Mthakathi Mswazi sent Sergeant Nkosi a list of case numbers concerning Mr Sibanyoni that relate to an investigation and expects Nkosi to look into those cases.
“he sent to you a list ... about the case numbers of Mr Sibanyoni ... the last part is actually what happened is he sent it to you to say look at the cases. Looking inside these cases.”
Sergeant Nkosi received a list from Mr Mthakathi Mswazi about cases related to Mr Sibanyoni, whom Mswazi is considered an enemy by Nkosi.
“the list of cases that relate to Mr Sibanyoni, they come from his enemy, in quotes...”
