Calvin Mahlangu

Calvin Mahlangu, director of Gubis, had called the CFO on 4 March about unpaid invoices, and Deputy Chief Dhlamini was aware of this before his intervention on 5 and 6 March.

“I am saying that is what the CFO indicated to me on the 4th of March when he was requesting my intervention.”

Deputy Chief Dhlamini criticized Calvin Mahlangu's initial approach to speak directly to the CFO instead of maintaining a single communication line, which he believes should be kept consistent.

“The initial approach of Mr Mahlangu was to speak to the CFO. So, I find it amazing that why would he drop the ball to the lower level and now want to engage with me on such matters.”

Major Phiri confirms that Calvin Mahlangu is a director of Gubis and involved in financial transactions with Gabotje Logistics.

“He is a director of Gubis ... those are transactions, financial transactions that were made by Mr Calvin Mahlangu ... paying monies into Gabotje Logistic ...”

Adv MosiKili alleges that funds paid by Mr Calvin Mahlangu or Gubis to Gabotje Logistics ultimately make their way to Major Phiri's account, a connection Major Phiri denies.

“the information put to us demonstrates a clear connection of funds from the director of Gubis to Gabotje and ultimately those payments making their way to your account ... No, I do not accept that.”

Major Phiri admits receiving a payment on 13 May but denies that the payment was made by Calvin Mahlangu or that the source of R150,000 is documented.

“I am saying to Commissioners, it must be clear, he paid me on the 13th and I agree, I say I requested a loan, he gave me ... I do not see the money here on the 13th, so I do not know what are the relations ...”

There are payments amounting to R3.9 million and R5.9 million involving Gubis and other entities including Mr Calvin Mahlangu and Papador.

“there is an amount of 3,9 million. Again, that comes from Gubis. And similarly, you will see that Mr Calvin Mahlangu's name also features. And lastly, Papador, which also made payment to Mr Phiri, also received, at least on the face of it, 5.9 million, or at least there was an exchange of 5.9 million between Papador and Gubis”

Sergeant Nkosi overheard a telephone conversation between Mr. Mnisi and Mr. Calvin Mahlangu where complaints were made about the City owing considerable outstanding payments and legal action being contemplated if unresolved.

“Sergeant Nkosi overheard a telephone conversation between me and Mr Calvin Mahlangu, during which he complained about the City owing his company a significant amount in outstanding payments. He indicated that legal action against the City was being contemplated, should the matter remain unresolved.”

Mr Mnisi admits that while speaking to Mr Mahlangu, Sergeant Nkosi called Deputy Chief Dhlamini and handed the phone to Mr Mnisi so he could speak directly to the Deputy Chief.

“While we were driving, just as I was about to conclude my discussion with Mr Calvin Mahlangu, Sergeant Nkosi was already phoning the Deputy Chief. At that point, he gave me his phone and I spoke to the Deputy Chief.”

Mr M R M N I S I says the call from Mandla Mgcina was out of the blue and unrelated to an outstanding Gubis payment issue, which would have triggered contact from Mr Calvin Mahlangu.

“It was out of the blue for me as well . Had there been an issue on the outstanding Gubis payment , Mr Calvin Mahlangu had direct contact details of mine , he would have called me on that . That is the pure reason why we even had a light moment of this matter . It was purely out of the blue for me .”

There were claims related to invoices for ad hoc security services allegedly rendered to the City's Group Water and Sanitation Business Unit, guarded by TMPD personnel.

“He further indicated that there were claims related to invoices for ad hoc security services allegedly rendered to the City's Group Water and Sanitation Business Unit...they were guarding Rooiwal Wastewater stations and other stations of that nature.”

There was initial lack of assistance from TMPD on the invoice claims, prompting referral for further clarity and resolution.

“The representative from his department had already been in contact with individuals from several individuals from TMPD, but he had not received the necessary assistance or attention...I therefore informed him that I would refer the matter to TMPD for further clarity...”

Director Malatji requested a report from Gubis through Mr Calvin Mahlangu, the director of Gubis Security Solutions, to verify the services rendered and deployment details.
