By the time the City receives service provider invoices, the contract may no longer be operative, but the invoices relate to a period when the contract was operative.

Mr M N Isi conceded Sergeant Nkosi was involved but stated no completely sensitive or confidential information was shared in the payment process relating to the termination letter which had already been sent to the service provider.
“I did concede that Sergeant Nkosi involved himself . ... there was nothing completely sensitive or confidential within the payment process ... In terms of this termination letter , it had already gone out to the service provider”
Mr Mnisi asserted that the termination letter was related to the issue of outstanding payables and is a major issue impacting the service provider, requiring all parties to work together for resolution.
“it does because it is related. It is a related matter where it is a major issue in the service provider. The service provider could have a deployment letter that we are not aware of. So this must be dealt with accordingly and that all parties involved must work together.”
According to Advocate Chaskalson SC, the service provider had received a letter stating they may not provide any services effective from 1 July, and there are no deployment letter issues affecting the next financial year.
“The service provider has received a letter that says you may not provide any services with effect from 1 July. Next financial year, you may not provide any services. Service provider cannot, there are no issues with deployment letters that might affect the next financial year in the face of that letter.”
Mr Mnisi states that once colleagues raise a matter, the onus is on the service provider to take the matter forward and he does not intervene, requesting only feedback as part of resolving matters.
“I need to accept that as the status quo, meaning the onus is now on the service provider to take the matter forward. Meaning I am not breaching our processes because I am not actively intervening. I was requesting for feedback, and that is normal in terms of resolving matters.”
General Dlamini instructed the service provider to go back to Mfowethu, which is problematic because the onus is supposed to be on the service provider to submit necessary documents.
“Dlamini says, I have told the service provider to go back Mfowethu. That is a problem I have. That right now you say that the onus is on the service provider, and I accept that. They must submit the necessary documents.”
Purchase orders in this context are documents issued by the Municipality to service providers detailing required services like security guards, vehicles, and rates, which the service provider then invoices on basis of.
“purchase orders to be documents that would go out from the Municipality to a service provider and in this context , the document would say we require the services of security guards at such and such a site and what we require are X number of security guards , X number of vehicles and at the rates , which total X amount over such and such period . And then the service provider would then render these services on that basis and obviously would then invoice”
Service provider was told by Director of Protection Services that Metro Police Cost Centre owner did not want to pay them, and original invoices were not hand-delivered despite requests.
“Further to unprofessional conduct, the service provider was told the Metro Police Cost Centre owner does not want to pay them. I am still waiting for the original invoices to be hand-delivered as per the promise of the ladies I spoke to (Winnie and Ulander).”
The problem in payment was with the TMPD (security department) who had not processed or signed off invoices, delaying the CFO's ability to pay the service provider.
“The problem lay with the TMPD... They had to do something before the CFO could pay - they had to sign off on the invoices.”
Sergeant Nkosi forwarded the confidential SAPS audit report to Mr Matlala because he assumed Mr Matlala was entitled to receive it as a service provider.
“He is a service provider there... I also assumed at the time, I thought as a service provider, he was also issued with such officially, so I took it on that level.”
