General Mbuso Khumalo

The request to Major General Mbuso Khumalo for case dockets was based solely on the Section 27 affidavit given to the witness on 5 December 2024.

“I refer the Commission to a written request for case dockets that Advocate Johnson instructed me to prepare and address to Major General Mbuso Khumalo... The request was based on dockets referred to in the section 27 affidavit.”

There was a hive of activity on the 6th of December 2024 relating to follow-up on the CJC 3905 authorization, including letters sent to Lieutenant General Mbuso Khumalo and General Senthumele requesting dockets.

“following this authorization that we are dealing with that CJC3905 , page 307 , on that particular day , as well , there was a hive of activity . Two letters written to , I think it is Lieutenant General Mbuso Khumalo , requesting the dockets . A letter to General Senthumule . Your authorization of the panel , the designated members to look into this , and the presentation of himself by Mr Rapetsua and the Inspectorate to go obtain the dockets . The 6th of December was a busy day .”

There was confusion or correction about requesting dockets from Major General Mbuso Khumalo rather than Dumisani Khumalo, as indicated in letters to Lieutenant General Senthumule and Major General Khumalo.

“I do recall having written to Lieutenant General Senthumule, and I recall her then ensuring that the dockets were received accordingly by IDAC.”

Major General Khumalo was to oversee investigations directed by Gauteng Premier Panyaza Lesufi, including multiple dockets from all five districts within Gauteng.

“Major General Khumalo was to oversee those investigations as directed by the Premier of Gauteng, Mr Panyaza Lesufi. The instructions was not limited to the Katiso case. It applied to many dockets from all five districts within the Gauteng Province.”

The Provincial Commissioner General Mthombeni instructed District Commissioners, including the acting District Commissioner for Sedibeng, to collect all dockets involving J50 warrants of arrest and deliver them to Maj-Gen Mbuso Khumalo for oversight and review.

“A complaint was lodged with the South African Police Service Provincial Commissioner, General Mthombeni. General Mthombeni decided to instruct District Commissioners, including me as acting District Commissioner for Sedibeng, to collect all dockets that had J50 warrants of arrest and to deliver them to the Deputy Provincial Commissioner of detective service, which is Maj-Gen Mbuso Khumalo, for oversight and review.”

Brigadier Nkhwashu never made a demand for the Armand Swart murder docket; he was acting on instruction to collect all dockets with J51s of arrest and submit them to Maj-Gen Mbuso Khumalo.

“Brigadier, you mentioned there that you never made a demand for the docket. Instead, at the time, you were acting on instruction from the Provincial Commissioner to collect all dockets that had J51s of arrest and submit them to the Deputy Provincial Commissioner, Crime Detection, Maj-Gen Mbuso Khumalo”

There was a direction from the Premier of Gauteng for Maj-Gen Khumalo to oversee the dockets.

A conversation between Warrant Officer Mills and Witness B on 8 April 2025 involved a request to obtain a copy or a picture of the J50 warrant, with Mills responding with a bowing picture.

“It is a conversation between Warrant Officer Mills and Witness B. I will say the black with the slight shading, that is the text from Warrant Officer Mills, who we have been told is in Maj-Gen Mbuso Khumalo's office. He then reached out to Witness B to obtain a copy or a picture of the J50. This was done on the 8th of April ...”

Maj-Gen Mbuso Khumalo provided ongoing oversight of the investigation docket related to Mr. Tau from around 20 August 2024, including safety guidance and arranging meetings with investigative teams.

“... after Tau was granted bail, the detectives sought assistance from Maj-Gen Mbuso Khumalo, and ... then met with Maj-Gen Khumalo who provided him with a detailed account of the investigation ...”

The docket in question was already overseen by Maj-Gen Mbuso Khumalo, which raises the question why the docket was still being asked for later.

“this docket in particular was already overseen by Maj-Gen Mbuso Khumalo ... why was he still seeking the docket at that stage?”

Lt-General Shibiri indicated that if General Sibiya wanted feedback quickly, he should call Mbuso Khumalo to send the report, but he himself would not give feedback that day.

“No, General, give me time. I will give feedback later, or else if you are in a hurry, you can phone Khumalo to send you the report. Myself, no.”

Lt-Gen Shibiri was trying to contact General Mbuso Khumalo regarding information from a source related to the Swart investigation, but did not have a follow-up conversation about the threats involved.

“I was trying to relay that information I got from the source to him so that he can take appropriate step ... And then it did not happen that he came back to me. Then I went to the person responsible for organised crime... Brigadier Gopane... No. ... No.”

General Mbuso Khumalo is a deputy provincial commissioner responsible for crime detection and all those components fall under him.

“He is a deputy provincial commissioner responsible for crime detection. So, all those components fall under him.”

General Mbuso Khumalo was not informed directly but Brigadier Gopane was informed about the intended bribery and threats.

“You spoke to Brigadier Gopane, but you only informed her about the intended bribery or the attempted bribery and about the threats.”

General Mbuso Khumalo deposed to an answering affidavit responding to Mr Matlala's urgent application.
