Mr Mogotsi met with Cat on 7th December, a day after a raid on Mr Matlala.
“I met Cat on the 7th of December.”
Cat (a plant from North Africa) must be submitted to the forensic science laboratory within a specific period before it rots; only samples are taken for analysis, not the entire consignment, similar to dagga where entire consignment submission is impractical.
“Cat is a plant that is originating from North Africa. Obviously, and that plant needs to be submitted to FSL within a specific period because otherwise it becomes rotten. So only samples are taken and then submitted to FSL. That is the only sampling. With dagga, obviously, it means that when a cultivation facility is dismantled, you might sit with a whole warehouse full of dagga. So, it is just not practically possible to submit that whole consignment for analysis to the forensic science laboratory. So, it is all about practicality.”
Sergeant Nkosi shared the article about Mr Matlala with Mr Msibi and possibly others because Cat was head of security for Mr Msibi, and Mr Nkosi wanted to inform Mr Msibi about what was happening regarding Cat.
“I think now the explanation would be because at that time, Cat was the head of security for Mr Msibi. I was informing Mr Msibi that this is happening about Cat.”
Sergeant Nkosi denies that General Sibiya ever said Cat should come to the function to pick up his wife who was drunk.
“I do not recall him saying that .”
Sergeant Nkosi forwarded messages about termination of Mr Matlala's contract to several people including Cat and Mr Motsumi.
“I forwarded to Cat myself. I forwarded to Mr Motsumi. These are people that I remember”
Sergeant Nkosi believes that the relationship between Mr Cat and Brigadier Bokaba and General Fannie involves people in the offices of Brigadier Bokaba and General Fannie.
“I am saying within the office of General Fannie and the office of Brigadier Bokaba, there are people there.”
Sergeant Nkosi forwarded messages from General Sibiya to Mr Matlala despite knowing Mr Matlala was about to face contract termination by SAPS.
“So when you forwarded all of this, all of these messages from General Sibiya to Cat, or to Mr Matlala... SAPS are threatening to terminate his contract. That is correct, is it not? That is correct.”
Sergeant Nkosi reported to Lieutenant-General Shibiri that Cat had arrived at a certain location, which was understood as a confirmation rather than a question.
“He is reporting to you that Cat has arrived there. That is what he is telling you. Cat has arrived there. He is telling you that Cat is there”
ADV Baloyi SC challenged General Shibiri's understanding, asserting that Sergeant Nkosi was informing him of Cat's arrival, not asking a question.
“It is not a question, General. He is reporting to you that Cat has arrived there. That is what he is telling you.”
General Shibiri did not know that Cat invited Mr Matlala and informed the commission that he was invited by the General (himself) to attend, having communicated with Sergeant Nkosi beforehand and arrived around 7-8pm.
“So what I am saying is I did not know that Cat is invited, he will be there. I was invited by the General to be there. I have spoken to Nkosi earlier on asking me if I am coming... I arrived there around past seven to eight.”
General Shibiri described the seating arrangement at the event, noting Cat sat away from him and he never proposed any loan to Cat, only discussing an accident and his financial difficulties.
“He was not seated where I have seated... We talked about the accident and how I am going to get some money to do that because I do not have enough... And he offered. So, to the proposition that I knew that he would be there as if there was a pre-planned meeting with him, I was going to see him. This is what I am insinuating.”
