Medicare was previously contracted by SAPS to provide health and risk-related services; the tender has since been terminated.

Mr Matlala is facing pending criminal charges before the Specialised Commercial Crimes Court in respect of the Medicare tender.
“I am currently facing a criminal charge which is pending before the Specialised Commercial Crimes Court with respect to the Medicare tender.”
Mr Matlala has been transferring funds from his Medicare account to Luxor Africa Brand company, which has been charged with money laundering due to monies from the SAPS tender.
“So the funds that, I have been transferring funds from my Medicare account to this company. And so this company has been charged with money laundering because they have been following all the monies that have been coming from the SAPS tender.”
The loan agreement with Mr Suleiman Karim (or his companies) forms part of an ongoing criminal matter (Medicare) pending before court, and answering questions about it may lead to self-incrimination.
“The loan agreement referred to herein is part of an ongoing criminal matter, and as such I am unable to respond to the question posed on the paragraph under reply. I am of the view that I may incriminate myself by answering questions related to this loan agreement as I believe it forms part of the Medicare criminal matter which is pending before Court.”
A financial investigation is being carried out by SAPS with respect to all monies paid by SAPS into Medicare and any transaction made in general within Medicare bank accounts.

The loan from Mr Karim was repaid using monies paid by SAPS into Medicare accounts.

The loan agreement with Mr Suleiman Karim was concluded orally around June 2024 for the purpose of funding the Medicare contract.
“It was oral. ... the purpose of the loan was because of to fund the Medicare contract”
Mr Matlala had a commercial transaction with Mr Steven Motsumi wherein Motsumi's company lent one of Matlala's companies (Medicare) R5 million on the basis of a written agreement at the end of 2024.
“I can confirm that I know Mr Motsumi and that I have done a commercial transaction with him wherein his company had lent me in advance one of my companies an amount of R 5 million.”
Mr Matlala's relationship with Mike van Wyk (CEO of Medicare) is the subject of a pending court matter involving Medicare's SAPS contract, and he claims the right not to incriminate himself.
“My relationship with Mike van Wyk is a subject of the matter that is pending before Court, and as such I am unable to comment on this question. I do not wish to incriminate myself, as Mike was the CEO of my company, Medicare, the very same company that had a contract with SAPS. I therefore claim my right to not incriminate myself.”
Mike van Wyk is a state witness and not an accused in the pending criminal case involving Medicare's SAPS contract.

General Matlou advised General Masemola to consider terminating the contract with Medicare to prevent irreparable financial harm to SAPS, and General Masemola accepted the advice and terminated the contract.
“she then advised General Masemola to consider terminating the contract with Medicare to save SAPS from irreparable harm and to diminish the financial prejudices suffered by SAPS. Then she says General Masemola terminated. So General Masemola accepted the advice.”
General Masemola terminated the SAPS contract with Medicare on or about 15 May 2025 following advice from General Matlou, by which time SAPS had suffered approximately R50 million in financial prejudice.
“having advised the National Commissioner to terminate the contract with Medicare to save the SAPS from irreparable harm and to diminish the financial prejudice being suffered by the SAPS, General Masemola ultimately terminated the contract with Medicare on or about the 15th of May. By that time, SAPS had suffered prejudice of approximately 50 million.”
A 3-year tender valued at R360 million was unlawfully awarded to Medicare.
“there is, in paragraph 2 there is an unlawful awarding of a tender to Medicare for a period of 3 years to the value of 360 million.”
Mr Carrim first disclosed seeing Medicare bank statements over a period in 2024 only in testimony yesterday, though this should have been included in his statement provided earlier.
“Yesterday in evidence, Mr Carrim told us for the first time that he had had sight of Medicare bank statements over a period in 2024. This was material that should have been put in a statement, which in turn ought to have been furnished Friday, not last week, but the week before. It was not put in the statement, which was furnished five days late on Wednesday. So, we hear this for the first time yesterday.”
The notice requiring the witness to personally provide a statement asked for the nature of his relationship with several individuals but does not mention dealings of his companies with Medicare or Tasmica.
“The notice at the relevant paragraphs asks Mr Suleiman Carrim personally to provide a statement ... There is no mention here of dealings of his many companies with anyone, let alone with Medicare”
The witness is accused of withholding information that is relevant to the commission's inquiry about the relationship with Medicare that he knows but chooses to withhold.
