Mr Mnisi understood the message about the mandate to Victor to mean Victor must either appoint the seven companies or check their compliance, but he did not entertain the message or confirm either interpretation.

I understood it with those probabilities that it could mean a number of things... that Victor must make sure companies are awarded which he cannot because he sits with a committee of individuals. Secondly, it could have meant that Victor must check compliance, so it is difficult for me to give you an answer. I did not entertain this message. ... I am not going to comment on what that is because I can assure you now, I did not even entertain this thing.

Would either of those mandates given to Victor be lawful? No, he cannot. There is no way he could check compliance. Firstly, tender is closed. He can only by law give clarification on the outcome of the bid. ... Secondly, he is not allowed to get names from external individuals to appoint.

On 4 September 2025, at the BAC meeting, the BEC report was presented but BAC complained it had not received the final probity report, so the process was sent back to get the final probity report.
