There was communication from within the City of Tshwane to an outsider alerting the outsider that a particular tender was non-compliant and suggesting urgent correction to make the tender compliant.

Director Malatji states he has no knowledge of anything wrong with the tender TMPD 2 he was involved with.

“Commissioner, I am not having knowledge, as I am seated here, of anything that might have gone wrong with the tender TMPD2 that I was a member of.”

Malatji asserts that during his participation in the tender TMPD 2 (2016-2017) as a BEC member, there was no complaint or indication that documents were tampered with.

“I can assure the Commissioner and this Commission, that from the beginning to the end, we never had a situation where there was a complaint to the effect that documents were tampered with, and so forth and so on.”

The tender TMPD 2 was subject to awards made under a court order due to litigation concerning missing documents.

“But it is this tender that was, or rather, in respect of which awards were made pursuant to a Court Order, is it not? It is so, Commissioner.”
