Brigadier Nkhwashu stated that Witness B opposed bail for the accused person Pule Tau, and that his brother-in-law was willing to pay the bail.
“Witness B informed me that she was opposing bail. I then returned and informed Brigadier Nkhwashu that the state is opposing bail... Brigadier Nkhwashu's brother-in-law was willing to pay the bail for the accused person, Pule Tau.”
A major difference exists between Sergeant Tshukudu's statement and Brigadier Nkhwashu's regarding when the conversation about bail occurred relative to when Tau was escorted.
“To me, a major difference, and this is a material difference between Sergeant Tshukudu's statement and your statement, is that in paragraph 3 of Sergeant Tshukudu's statement, this conversation happened before Tau was escorted to his bail hearing.”
Witness Bis is the investigating officer in an Organised Crime docket involving Pule Tau, who was arrested in April, which was already widely known in the town by the time of the call to Brigadier Nkhwashu.
“When I look at the case, it happened in April, and already the case of April, where Pule Tau was arrested, it was all over. It was now the talk of the town. By now, I know that Witness Bis the investigating officer of this case.”
Brigadier Nkwashu learned of Katiso's arrest from Ms Nyangule but was not told the charges initially; eventually he was told Katiso was charged with conspiracy to murder related to Pule Tau's murder.
“When she was telling me that Katiso is arrested... I did not know what he was charged with... your brother-in-law was arrested, he is being charged for conspiracy to murder... This one of Pule Tau.”
