The initial section 27 referral dockets contained only the complainant's A1 statements and no other evidence, making it impossible to determine proper jurisdiction.

“Onl y the complainant 's A 1 statements are contained in the six dockets . No other evidence is contained in the dockets . ... The current information contained in the dockets is scanty and too vague to formulate charges against any suspects . As a result , Legal Services are unable to confirm that the required elements of any offence are contained in the dockets .”

Colonel Phillips expresses the view that the affidavits in the dockets are basic and lack the element of a crime but directs all dockets to Legal Services for an opinion.

“The affidavits in the dockets are basic and , in the opinion of this office , lack the element of a crime . The author expresses that view , sends the dockets to Legal Services and say , can we get an opinion whether or not what is in the dockets discloses a crime ?”

Major General Motsepe wrote an email seeking legal opinion about the witness's post-promotion and attached a disciplinary hearing letter from Major General Khan.

“Major General Motsepe wrote an email to Legal Services... In her email, she attached the letter that was produced by Major General Khan at his disciplinary hearing... The letter from DPP Gauteng Local Johannesburg that stated the case against us will be enrolled soon.”
