Crime Intelligence Office

A bail condition was imposed that the accused must not go to any Crime Intelligence office in the country, which was not requested by the State but was issued by the Magistrate after engagement with Ms Hlatshwayo concerning witness protection.

“the bail condition , the contentious bail condition was imposed , which is the accused , they must not go to a Crime Intelligence office anywhere in the country... that condition was not asked for by the State , but we also know from the appeal record that there was an engagement between the Magistrate and Ms Hlatshwayo about the need to protect witnesses”

The accused were given a bail condition by a Magistrate prohibiting them from going to any Crime Intelligence office, which effectively suspended them from their offices and employment, though this condition was not asked for by the State prosecution in open court.

“a condition of this type, which is the accused are prohibited going to any Crime Intelligence office across the country... the consequence of that condition is effectively they get suspended from their offices, from employment.”

The attachments to the email were photographs of an A1 statement and an audio file related to a complaint against General Khan by Brigadier Phetlhe for assault and intimidation on 26 June 2018.

“The email file contained photos of the A1 statement of Brigadier Phetlhe, a female Crime Intelligence Officer who had made a criminal complaint against General Khan for an incident on 26 June 2018 at the Crime Intelligence office. She had accused General Khan of assault and intimidation. ... The audio file contained a recording of parts of the incident between General Khan and Brigadier Phetlhe.”

On 2023-06-07 and 2023-06-08 various letters requesting warning statements were hand-delivered to the Crime Intelligence Office in Pretoria for General Khan and to Germiston DPCI office for General Kadwa, Brigadier Sekgobela, Colonel Steyn, and Lieutenant Colonel Sebola.

“On 2023-06-07 , the request letter was hand-delivered to Crime Intelligence Office in Pretoria for General Khan . On 2023-06-08 , the other request letter was hand-delivered at Germiston DPCI office for General Kadwa . On the same day , the other letter delivered at Germiston DPCI for Brigadier Sekgobela , Colonel Steyn , and Lieutenant Colonel Sebola”

Warning statements from General Khan, General Kadwa, Brigadier Sekgobela, Colonel Steyn, and Lieutenant Colonel Sebola were obtained from IPID offices between 2023-11-15 and 2024-02-06.

“On 2023-11-15 , warning statement of General Khan was obtained at Crime Intelligence office . On 2023-11-27 , warning statement of General Kadwa , Brigadier Sekgobela and Colonel Steyn were obtained at IPID offices . On 2024-02-06 , warning statement of Lieutenant Colonel Sebola was obtained at IPID offices”
