Only the Director of Public Prosecutions (DDPP) can allocate cases to junior prosecutors; Mr. Sesoko cannot do so.
“No, he, that does not fall within his mandate”
At the time of the bail proceedings, there was no Deputy Director of Public Prosecutions (DDPP) or senior prosecutor ready, and the matter was run by the most junior prosecutor, forcing an uninvolved person to step in.
“...you knew that day was that there was no DD, there was no senior prosecutor, they certainly did not appear to be ready for the bail proceedings, you had to step in as somebody who is completely not involved. This was run by the most junior prosecutor...”
Concern raised that without a DDPP and senior investigator, the junior prosecutor working unsupervised on such a matter involving senior SAPS generals was problematic.

The matter was proceeding without a DDPP and project owner, implying that even with Advocate Ramsamy assisting, it was still junior prosecutors handling the case, which was a concern due to the involvement of high-level SAPS officials.

Adv Serunye was informed by ID on 8 August that a DDPP would be involved and she was to be part of that involvement.
“ADV SERUNYE”
Advocate Serunye was appointed as supervising DPP for the Lushaba and Khumalo/Mokwele matters, coming in after no DPP was previously appointed to oversee those cases.
“I was coming in as a supervisor... there is no DDPP appointed into the matter, so I am coming in after the fact as a DDPP to oversee the two cases.”
The decision on investigations and prosecutorial matters lies solely with the DDPP after consulting the team; project managers do not make such decisions.
“That decision lies solely with the DDPP on what type of investigations... Project managers do not make those decisions.”
Advocate Johnson said she needed a Deputy Director of Public Prosecutions (DDPP) on the matter for authorisation purposes but would supervise the matter herself.
“Advocate Johnson said that she needed a DDPP on the matter for the purposes of authorisation, but that she would supervise the matter.”
ADV Johnson claims that IDAC operates on a prosecution-led investigative methodology where investigators present evidence to prosecutors who then decide whether to prosecute; this decision is confirmed by the Deputy Director of Public Prosecutions (DDPP).
“IDAC operates on a prosecution - led investigative methodology that I head . Investigators conduct investigations and present evidence to prosecutors in their teams . Prosecutors then evaluate the facts and evidence and decide whether to prosecute . That decision is confirmed by the DDPP is the Deputy Director of Public Prosecutions ...”
