Lieutenant-Colonel Jacobi instructed members to proceed to Isipingo SAPS and requested members from ORS Durban Harbour for assistance.

Colonel Jacob admits he did not call the ORS Durban Harbour commander before moving exhibits from the CHC depot, despite knowing the ORS Durban Harbour had jurisdiction there.
“You never called ORS commander. No, I did not.”
Colonel Jacob acknowledges he knew ORS Durban Harbour worked at the CHC depot area but was unaware they had sole jurisdiction there at the time of the operation.
“I knew they worked there. I did not know they had sole jurisdiction that they were there.”
Original statement by Colonel Jacob included Sergeant Mkhize and Govender from ORS Durban Harbour as present during seal breaking, but later he acknowledges these persons were performing their normal duties at the CHC Depot and were not present during the seal breaking event.
“At paragraph 5 , we have now discounted any Customs member by the name of Ntuthuko Khuzwayo . You say there was Sergeant W Mkhize and P Govender from ORS Durban Harbour .”
The DPCI does not have a formalized inspection report process similar to the ORS Durban Harbour SOP and has never seen such a document before.
“I have not come across it, Commissioner. I have not. I do not know what it even looks like, this inspection report.”
The ORS at the harbour has a formal SOP that requires the compilation and dispatch of an inspection report once a container has been booked for inspection at the licensed depot.
“The inspection report is dispatched from the admin profiler once the container has been booked for inspection at the licenced depot.”
