Paul O'Sullivan considered launching an urgent application against Vodacom after discovering phone records were in possession of Radovan Krejčér, but was advised against it by Senior Counsel and did not proceed.

“I planned to launch an application... against Vodacom... I drafted a sworn statement for it, but I never actually launched. And the reason I never launched was because when I got Senior Counsel's opinion, he said that I might fail with that application. So, I decided to keep my powder dry.”

Vodacom disclosed to Paul O'Sullivan that they had received section 205 requests for call data related to cases of kidnapping, assault, theft, armed robbery and murder, connected to investigations in Tokoz and Primrose.

“Vodacom is obligated to disclose this information if we receive a section 205 to do so... There were three applications made... Primrose Case 09/03/2011 kidnapping, assault and theft; Tokoza case 26/04/2011 armed robbery; and the third one is Tokoza case 31/06/2011 murder.”

Cell phone data from Vodacom shows that the cell phone number with MSISDA belongs to Tu m e l o N k u and that this phone was used on those phones shown by the IMEI numbers.

LT-Genshibiri said he was looking for itemized billing for his private state phone to verify calls, but Vodacom could not assist in November 2025. He believes he phoned Brigadier Nama on 7 December about the unit that made the arrest.

“I was also looking on my itemized billing for the state phone ... I phoned first Brigadier Nama on the 7th ... because I did not know which unit from the province have made such an arrest when I was asked to establish on the 7th.”

Lieutenant-General Sibiri stated that he went to Vodacom and the cyber office to get WhatsApp data but they could not help him, contradicting the suggestion that he chose not to provide WhatsApp messages.

“I indicated on my statement that I went to Vodacom and they could not help me. And I went to our cyber office, also, they could not help me. I indicated even the name of the Colonel I spoken to. So not to say I chosen not to.”

Vodacom only provides itemized billing for calls and SMS, and cannot assist with WhatsApp message retrieval.

“Vodacom could only help you with itemized billing which would be your calls and your SMS's. They were not going to be able to assist you with WhatsApp.”

Lt-Gen Sibiri admitted he did not know Vodacom could not assist with WhatsApp data at the time he sought help but accepts that now.

“I accept now because I know now. I did not know that time.”

Lt-General Shibiri could not see itemized billing on his Vodacom phone and went to Vodacom to look for it; his phone does not show itemized billing for WhatsApp texts.

“I could not see them, hence I even went to Vodacom to look for the itemized billing. But I am not saying it does not remain, it does not show but on my phone I do not know where does it show”
