Lead investigators and lead prosecutors or chief investigators form part of management and conduct briefing and cascade information to investigation teams, who do not know all the operational details at their level.

The decision to issue section 28 summonses was made by the Chief Investigator and Head of IDA, despite lack of prima facie evidence and Ms Ramsamy's concerns.

“It was clear to me that the decision had been made that the summonses would be issued if both the Chief Investigator and the Head of IDA have decided that it should be.”

Colonel Padayachee admits to conducting a bona fide investigation originating from a briefing by his Chief Investigator, despite acknowledging there were suspicions and allegations surrounding the investigation.

“I did a bona fide investigation ... I proceeded with it ... there are suspicions, allegations surrounding this investigation ... I conducted an investigation that flew from a briefing from my chief investigator.”

Chief investigator is the appropriate person for the Commission to engage with for understanding investigation workflow and section 27 referrals.

“The chief investigator of the team who is responsible for the whole investigation will be in a better position with regards to that and the 27.”

The Chief Investigator confirms Mr Mogotsi was persistently calling after Mr Carrim started giving evidence and threw Mr Mogotsi under the bus.

“The Chief Investigator greets them and then says: “Mogotsi has been calling me nonstop.” ... “Mogotsi has been calling me nonstop since Carrim started giving evidence and threw him under the bus.””

Mr Mogotsi arranged a meeting with the Chief Investigator for 10:00 which did not materialize, and later a 14:00 meeting was also arranged but also did not take place.

“...the 10 o'clock meeting is a meeting that did not materialize. Mr Mogotsi did not show up. And after contact was revived, an arrangement was again made... for a meeting at 14:00 of the same day. That too did not materialize.”
