On 23 March, Deputy Chief Dhlamini communicated with Sergeant Nkosi about arranging a meeting to get clarity on a matter involving Gubis and to check with the CFO on advice.
“Afternoon, Captain. ... Cain called me on Friday and asked if Gubis want to meet up with me on Saturday. I then pushed the meeting to Monday ... Please check with him on this and his advice, if I should go or drop them ...”
Deputy Chief Dhlamini discussed the unpaid invoice process with Cain, Andrew, and others in a meeting, explaining the steps to be followed and internal processes.
“The explanation was done in a meeting that we had, Commissioner, with Cain and them, Andrew, and here they were just requesting a meeting”
Deputy Chief Dhlamini communicated via Sergeant Nkosi to the CFO regarding a meeting with Cain and others, instructing that they should go back to KuMfowethu as he is the only gateway and no back door should be used.
“I had a meeting with Cain and those guys today as I indicated. I told them that they should go back where they have started kuMfowethu. I said to them he is the only gateway. They cannot go with a back door. I will only be able to assist if I get an indication from kuMfowethu. Protocol must be observed at all costs.”
Deputy Chief Dhlamini confirms that Cain is the head of supply chain and that parties have direct contact with the CFO, questioning why they would need him to assist with appointments.
“they have direct contact with the CFO. Why would they need me to assist them?”
The General sent a message to Sergeant Nkosi seeking confirmation if Mr Mnisi had spoken to Cain regarding processing at GUBIS, but Mr Mnisi never received this message and cannot comment on it.
“The General messages Sergeant Nkosi saying : “ Good day, Captain. Please check with Mfowethu if he has spoken to Cain about Gubis for processing . He just called me to say Mfowethu has given a go-ahead .” This message was never forwarded to myself . I have never received it . I cannot comment on that .”
On 7 February, an email from Gubis Security Services to the CFO stated that invoices had not been paid despite having certified work done by relevant departments. The witness escalated this matter immediately to TMPD officials Mr Tshukudu Malatji and Cain without copying others.
“on the 7th of February, good day, CFO. We have this issue. Our invoices have not been paid. But within that is an attached letter, statement of account, and invoices, which appear to have been certified as correct and work done by the relevant departments. So what I do from there, also within GM23, as per my bundle, I escalate that further immediately. I say, TMPD, I directed that matter to Mr Tshukudu Malatji, who was on the email. I then cc Cain, or I direct to Cain. I do not cc him. I reply all. But replying all, I isolate the two individuals whom I think should be in a position to resolve this matter.”
A message from a General indicated a meeting with Cain and others concerning Mfowethu, instructing that protocol must be observed and Mfowethu is the only gateway.
“After noon, Captain. I had a meeting with Cain and those guys today, as I indicate. I have to told them they should go back where they started Mfowethu. I said to him he is the only gateway, they cannot go with the back door. I will only be able to assist if I get an indication from Mfowethu. Protocol must be observed at all costs.”
The General instructed to let him meet with Gubis and Cain and then report back, refusing to meet them directly.
“Let the General meet him and then he will brief us of the outcomes of the discussion when we meet later Mfowethu. So when we see this message at page 522, four days after that exchange with the General and the CFO, we see a message saying: Afternoon, Captain. I had a meeting with Cain and those guys today, as I indicate. I have to told them they should go back where they started Mfowethu. I said to him he is the only gateway, they cannot go with the back door. I will only be able to assist if I get an indication from Mfowethu. Protocol must be observed at all costs.”
Sergeant Nkosi denies having been instructed to hold a meeting with Gubis and Cain that he was to report on afterwards without the CFO.
“No.”
