General Khana

General Khana engaged in communications with Mr Vally about a tender contested by several unsuccessful bidders involving companies AHK, Keegan's Jamie, and DAR, indicating collusion or coordination among these three companies.

“Mr Vally sends General Khana screenshot of the Notice of Motion ... He says: 'Do you have the affidavits he is referring to?' ... Mr Vally says: 'No, bro.' ... General Khan says: 'What did AHK get awarded?' ... Mr Vally responds immediately to say: 'No, marf, it is Keegan's Jamie partnering with AHK and DAR. Those three are all taking this on.'”

Mr Vally from Kaizen treated General Khana as a person who could unlock access to tender opportunities and facilitated modifications to tender specifications via contacts including Mr Molefe Fani in procurement.

“Mr Vally from Kaizen treats General Khana as a person who can unlock access ... General Khana arranged meetings with a contact within procurement and obtained information from that contact. That contact is Mr Molefe Fani. Mr Vally requested General Khan to modify the tender specifications ... to assist in the modification of tender specs.”

General Khana received procurement information during a live process, passed it to Mr Vally, and the two shared information on purchase orders and buyouts, discussing stashing money and making sure it does not enter the system, with ongoing engagement after tender award to make contract work.

“General Khana receives information during the procurement process ... receives information and passes it on to Mr Vally. Mr Vally sharing information with General Khan on issues of purchase orders and buyouts and requesting assistance from General Khan. Mr Vally talks about him and General Khan stashing the money, getting a big slice, making sure it does not enter the system ... after the award ... continued engagement between the two on making the contract work.”

Warrant Officer Phakula was taking seals to Major General Khana to have them photographed for forensic purposes.

“No, I was innocently taking those seals to – remember, I left the photographer with Major General Khan. So, I was taking those seals to her to take photos of those seals, and obviously she was supposed to take them further to Forensic.”

A BMW 7 Series vehicle and its occupant were involved in an incident where the occupant was told to sit in his car by General Khana and later arrested and taken to Booysen's Police Station.

“What happened to the BMW 7 Series and the occupant of that vehicle? Was he also arrested? ... He was arrested with you and taken to Booysen's”

The witness only became involved in the June 2021 Durban cocaine seizure matter after his appointment as the head for serious organized crime investigation, succeeding Maj-Gen Khana.

“as I have testified earlier, I only became involved in this matter after my appointment as the competent head for serious organised crime investigation at head office after the departure of Maj-Gen Khana. So, after I took up the position, obviously I engaged with the investigators on the matter and that is how I became privy to the facts of this matter”

Sergeant Nkosi identifies a person as an expert in kidnapping cases who worked with SAPS to solve such cases, mostly collaborating with General Khana and members of the intelligence kidnapping team.

“This person is working in- when I came to organise crime, when we were still working on kidnappings, this is the person whom we were given to work with. According to the head office, he is an expert in kidnapping cases... Mostly he would work closely with General Khana and some members of intelligence kidnapping team.”
