Mr Nkosi reports he managed to download the documents given to them last night before noon but struggled to download them on receipt due to preparation for the hearing.
“I managed to download what has been given to us yesterday at night, before 12... the very same documents that I am saying I struggled to download because at the same time I was preparing to come here.”
Documents went missing during a tender process that led to litigation and awards being made without an evaluation process taking place.
“part of what was alleged in the litigation was that documents had gone missing. And in the end, an award was made, or awards were made without the evaluation process having taken place.”
There was a complaint and lawsuit regarding the tender documents being removed and some missing, leading the municipality to attempt to cancel the tender, but the court ordered the tender must proceed with evaluation, stating no basis to cancel.
“the municipality cancelled this tender because of a complaint about documents having been removed and being retained, some documents missing. Then it went to court, and the court directed that this tender must continue. There is no basis to cancel it, and the processing or the evaluation of the tender should proceed”
Sergeant Nkosi denies that the documents explaining the money were created after the event to explain the money.
