Phiri issued deployment instructions and acts on behalf of the appointing department which gave Gubis the instruction to proceed with the service.

“It is Phiri who issued instructions saying he acts on your instructions...It is APS that gave Gubis the instruction to proceed with the service.”

Outstanding payments to security service providers occurred because certification of deployment and budget tracking only happened quarterly and the DCP Police only became aware of the issue late.

“The question of deployment of guards ... it falls precisely under APS ... it was overseen by DC Police. ... They allowed service providers to continue for six months. DC Police says it just happened under his nose. There is coaching every quarter with the directors where you check your budget. ... He could not pick it up the first quarter, he could not pick it up the second quarter ... They sign off invoices, certify them that services have been rendered.”

An inspector in the APS cannot allocate services worth millions of rands to service providers under the Municipal Financial Management Act and Local Government Municipal Systems Act without proper delegation and adherence to procurement protocols; Doctor Madihlaba functioned at the senior superintendent level.

An email sent on 2 October 2024 by Commissioner Bolhuis highlighted the importance and urgency of resolving the issue of non-payment to security service providers under APS.

“Please urgently advise on the slow (non-payment) of security service providers. What are the issues and how can we urgently resolve it? Your immediate attention to this will be highly appreciated.”
