Nugent Commission

IDAC groups carried historic matters as well as matters generated from recommendations of Commissions of Inquiry such as the State Capture Commission (Zondo Commission), Mpati Commission, and Nugent Commission.

“Each group carried both historical matters and matters generated from the recommendations of the Commissions of Inquiry, that is, the State Capture Commission, commonly known as the Zondo Commission, the Mpati Commission, and the Nugent Commission.”

The group overseen by Advocate Serunye dealt with high-level corruption in the public and private sectors by identifying potential cases from recommendations of Commissions of Inquiry such as the Zondo and Mpati Commissions.

“I was overseeing a group that was dealing with high-level corruption in the public and private sectors. We identified potential cases from the recommendations and evidence of Commissions of Inquiry that I have earlier listed, the Zondo, Mpati, and Nugent Commission.”

IDAC's case referrals mostly consist of cases from other units like the Specialised Commercial Crime Unit or from reports of Commissions of Inquiry such as the State Capture or Nugent Commission.

“At the time of the Adams referral, the bulk of IDAC's cases were either existing cases from other units, such as the Specialised Commercial Crime Unit, or cases emanating from the reports of Commissions of Inquiry, such as the State Capture Commission or the Nugent Commission.”

Advocate Johnson clarifies that IDAC's mandate is to deal with serious, high-profile or complex corruption and related commercial or financial crimes, especially those arising from Commissions of Inquiry like state-capture investigations.

“...serious high-profile or complex corruption is precisely what we were formulated for... to deal with those that arise from these Commissions of Inquiry, the state-captured Mpati and Nugent...”

IDAC states it strictly operates within its mandate and considers matters referred arising from state capture and commissions such as the Justice Mpatia and Justice Nugent Commissions.

“8. The IDAC operates strictly within its mandate. That mandate is set out in section 7 (1) (A) of the NPA Act as amended. It also considers matters referred to it arising from the state capture, the Commissions that were colloquially known as the Justice Mpatia and Justice Nugent Commissions, and any other matter referred to it by the National Director of Public Prosecutions. IDAC has not dealt with matters outside its mandate.”
