Major Phiri confirmed that the bank statement being examined is correct and belongs to him and that it is an ABSA bank account.
“It is correct ... It is ABSA ... That is my account number.”
Major Phiri uses multiple bank accounts for different purposes because his Standard Bank account is constantly hacked and he receives Police Station affidavits, so he prefers to have his money go to ABSA accounts.
“I am using ABSA, I am using Standard Bank for salary, but because at Standard Bank I am constantly being hacked and I am forever at the Police Station writing affidavits... all my money will go to ABSA, but it will not come here.”
The chat logs between Sergeant Nkosi and Natasha show a payment of R500 made to Natasha with instructions on how to withdraw cash, implying a corrupt transaction involving exchange of information about Musa Khawula.
“That conversation culminates in Sergeant Nkosi eventually saying: 'Hey, Natasha. I have just sent you R500 to withdraw the cash from any Absa. Remember to select Cash Send withdrawal when you go to withdraw the cash.'”
Sergeant Nkosi does not always deposit the cash payments from Mr Mampane into his brother’s bank account, sometimes keeping the money in cash.
“No, I keep it cash sometimes ... I do not know it by heart, but I know it is called ABSA and FNB.”
LT-GEN SHIBIRI phoned Sergeant Nkosi to ask about attending General Sibiya's son's engagement party; Nkosi was expected to escort him but other people could not assist so he phoned Absa directly for assistance.
“During the day, on Saturday, I spoke to Nkosi who seems to be there by the General's assisting, asking if I am coming. I said, ja, I think I will come, but I will decide in the afternoon. ... I had a puncture, and then I again phoned Nkosi and the other people to assist. They could not assist. I phoned Absa directly to come and assist me.”
Adv Khumalo SC challenged Lt-Gen Shibiri that despite different versions about payment method, the money for the Thanksgiving event was available in his cheque account.
“You started by saying you used your ABSA cheque account... You then said, oh no, it is in the linked credit card... You are now saying it was cash contributions from members of the family... So that money was all available to you to be used to repair the vehicle.”
