There was confusion about which officers had custody of the scene: first two accused Officers Mashaba and Magane were initially in charge, but later Officer Phakula claimed to have taken over from them, which LT-COL Sebola denies.
“Mashabaan and Magane arrived first. ... It was never [the case that Phakula was in charge].”
Officer Magane being seated in the vehicle was not associated with General Khane being at the scene, nor was General Khane's role known at the scene.

Officer Magane testified that the only witnesses saw some and not the entire process of counting the items.

Colonel Sebola explained that two members of the South African Police charged with the same offence were charged differently due to their stationing, since charging happens through either the National Commissioner or Station Commissioner according to police disciplinary code and locations.
“... how can we have two members of the South African Police who are alleged to have committed the same offence, then be charged differently in terms of the same disciplinary regulation... This according to me says, this one is at Head Office, this one is at the station... there was nothing wrong to be charged at once.”
