ADV Johnson states that as the Head of Office, he sends memorandums capturing the essence of charges, persons to be charged, and makes decisions that are communicated to the DPP office.
“As the I D, I sent the memorandum . We captured the essence of the charges , who is to be charged, where the matter is to be enrolled , and what it is . The document comes from me ... I communicate the decision”
The DPP office was privy to detailed information about the seizure exhibits including dates, times, and handling, but did not express any concern about the crime scene or exhibit integrity though there were issues with compliance to National Instructions.
“In the investigation diary, Warrant Officer Mpangase puts a date and time as to when he sealed them in exhibit bags, where it was done, who was present. Then there is another addendum where he has described the exhibit bag and the colour of bricks in it. So, all of that would have been privy to the DPP's office.”
