General Mkhwanazi allegedly turned a blind eye to unlawful political interference during his time as Acting National Commissioner in 2012 and acquiesced to unlawful instructions, then helped cover it up.

“During his period as Acting National Commissioner in 2012, General Mkhwanazi himself turned a blind eye to unlawful political interference relating to the then Divisional Commissioner of Crime Intelligence, Lieutenant General Richard Mdluli. In fact, General Mkhwanazi not only turned a blind eye, but he also acquiesced to patently unlawful instructions, then later helped to cover it up.”

Mr. O'Sullivan expresses disbelief that a senior police official could have been unaware of media reports about Richard Mdluli, stating it is inconceivable that no close police colleagues informed him and that he became aware because he laid a grievance.

Mr. O'Sullivan alleges that the Acting Commissioner of Police unlawfully reinstated Richard Mdluli to work, which forced civil society to bring urgent applications to get him out of office.

Mr. O'Sullivan states that the individual who unlawfully reinstated Richard Mdluli had an opportunity to come clean about the truth in 2012 but remained silent until the State Capture Commission years later.

Mr. O'Sullivan criticizes lack of transparency about delaying disclosure of the truth about unlawful actions by a senior police official related to reinstating Richard Mdluli.

“I just think it should have been a lot more transparent ... I believe he should have put it out there a lot sooner”
